This Essay addresses an anomaly in trespass law. Trespass law is generally understood as the paradigmatic example of property-rule protection: an owner can obtain an injunction against the trespasser and have him removed from her land. The property-rule protection enjoyed by the owner protects her right to exclude others and to set the price for the use of her property. However, the property-rule protection only exists ex ante: it avails only against imminent or ongoing trespasses. Ex post, after a trespass ends, the owner can only recover compensation measured by the market value of the unauthorized use, i.e., the going …

According to the preliminary investigation the incident is caused due to a pressure applied to the mine from the heavy RAKE (the excavation tool) used by the deminer and the deminer didn’t expect to find a mine in that spot with that depth and may like accident could be avoided by using the metal detector to locate the non visible mine before using the standard RAKE drill.

Don't Judge A Book By Its Cover: An Ethnography About Achievement, Rap Music, Sexuality & Race, Bettina L. Love

The purpose of this ethnographic study was to explore how youth consumption of rap music informed their ideas of gender, race, sexuality, and education at a local community center in Atlanta, Georgia. The participants in the study were comprised of three male and six female Black students from working class families, ranging in age from 13–17 years old. The data collection process included 60 formal interviews, 55 informal interviews, 27 focus group interviews, 103 participant observations, and document analyses of media materials. This study investigates principals’ perceptions about the importance and degree of building relationships with Hispanic/Latino families in highly diverse schools in an Atlanta area school district. Over the past ten years, the school district’s Hispanic/Latino student population increased by more than 12,000 students. The school district’s current Hispanic/Latino enrollment is almost 15,000 students, which is 14.4% of the total student body. Six principals from different elementary and middle schools with growing Hispanic/Latino student populations participated in this qualitative study involving in-depth, one-on-one interviews, informal observations, and artifact collection. The data analysis process involved transcribing the interview tapes verbatim, analyzing the …

What is the developmental trajectory of the skills that underlie emergent literacy during the preschool years? Are there individual characteristics which predict whether a child will be at-risk for difficulties in acquiring literacy skills? Does a child’s experience in a high-quality early care and education environment enhance the development of his or her emergent literacy? The present study is an investigation of the individual and environmental factors relevant to children’s emergent literacy skills as they unfold in time. In the springtime, fifth grade students at the Williamsburg Elementary School in rural Western Massachusetts ask to snack on sorrel and chives from the school garden, between planting potatoes and building a shade structure for their outdoor classroom. They are members of the first cohort of the curriculum-integrated program initiated by Fertile Ground, a grassroots organization in western Massachusetts. The children’s delight in the fresh greens they have grown marks a national phenomenon: the farm-to-school movement. Preservation of and reinvestment in the built environment as a redevelopment tool has been used by cities and towns across the country, in many cases providing significant social, economic and environmental benefits. Potential social effects have often been the least explored aspect of sustainable development, especially with regard to preservation, yet they are often the most challenging, particularly given the potential for displacement.
This thesis reviews literature where the issues of preservation, redevelopment and sustainability intersect. A set of best practices was developed that can be applied to other cities and towns to help balance preservation- and equity- enhancing activities. …

In 2005, the Massachusetts Youth Risk Behavior Survey reported 21.9% of males and 26.1% of females were bullied in schools. Little research has been conducted into showing an association between childhood bully victimization and risky behaviors. In addition, knowledge is limited about the connection between victimization and risky behaviors among different ethnic groups. We propose to assess the association between victimization and risky behaviors, using the Massachusetts Youth Risk Behavior Survey among 3,116 students in grades 9 through 12 in 2007. This thesis identifies and explores the effects that new parking strategies and policies could have on transit-oriented development (TOD) success levels. Additionally, it makes the case for TOD parking regulation reform, and is designed to educate planners and stakeholders on how to successfully and responsibly shape parking regulation in the planning and implementation process, so that land use in the region allows the synergistic provision of sustainable transportation specifically to the Boston region.

Since its launch in 2008, Commonwealth Compact has grown steadily, employing several strategies to promote diversity statewide. The Benchmarks initiative has collected data, analyzed in this report, on a significant portion of the state workforce. Guided by Stephen Crosby, dean of the McCormack Graduate School of Policy and Global Studies at UMass Boston, Commonwealth Compact has conducted newsmaking surveys of public opinion and of boards of directors statewide. In addition, it has convened ongoing coalitions with its higher education partners, and established a collaborative of local business schools aimed specifically at increasing faculty diversity. One of the primary roles of a supervisor is to manage worker performance. Performance management is the "continuous process of identifying, measuring, and developing the performance of individuals and teams and aligning performance with the strategic goals of the organization" (Aguinis, 2007, p. 2). Supervisors must regularly assess current performance levels and take steps to improve performance in a way that is congruent with agency goals. The ultimate goal is to achieve agency objectives through individual and team performance.
To effectively manage performance, supervisors must know what the performance expectations are for workers and clearly communicate these expectations to workers. …

In this chapter, the focus is on recruiting and selecting new staff and on the steps agencies can take to ensure that they are doing the best possible job to attract and hire a high-performing, committed workforce. This chapter reviews a number of strategies for improving recruitment and selection processes and provides case examples from the authors' work with child protection agencies in several states. These projects have been accomplished by a team of researchers at the University of Nebraska-Lincoln's Center on Children, Families, and the Law (CCFL).
