Effects Of Two Versions Of An Empathy-Based Rape Prevention Program On Fraternity Men’S Rape Survivor Empathy, Rape Myth Acceptance, Likelihood Of Raping, And Likelihood Of Committing Sexual Assault., John D. Foubert, J. T. Newberry

John D. Foubert

Fraternity men (N = 261) at a small to midsized public university saw one of two versions of a rape prevention program or were in a control group. Program participants reported significant increases in empathy toward rape survivors and significant declines in rape myth acceptance, likelihood of raping, and likelihood of committing sexual assault. Program participants’ scores significantly differed from an untreated control group in several areas. Implications for describing a male-on-male rape to increase men’s empathy toward female survivors and other related attitudes are discussed.

Asymmetric Parenthood, Katharine K. Baker Dec 2005

Asymmetric Parenthood, Katharine K. Baker

Katharine K. Baker

This analysis of the American Law Institute's Principles of Family Law, Chapter 3, examines how the Principles perceive the origins and extent of parental obligation. What is that makes someone financially responsible for a child? Perhaps surprisingly, the Drafters of this key chapter of the Principles spend remarkably little time analyzing that question. Instead, to determine who has parental obligation, the Principles rely on extant legal paternity and parenthood doctrine that is itself completely muddled. To determine the extent of parental obligation, the Principles employ a binary biological ideal of parenthood that fails to reflect reality for close to half …

From J.C. Bach To Hip Hop: Musical Borrowing, Copyright And Cultural Context, Olufunmilayo B. Arewa Dec 2005

From J.C. Bach To Hip Hop: Musical Borrowing, Copyright And Cultural Context, Olufunmilayo B. Arewa

Olufunmilayo B. Arewa

Musical borrowing is a pervasive aspect of musical creation in all genres and all periods. Copyright doctrine does not adequately reflect the reality of such borrowing. Instead, copyright doctrine incorporates notions of Romantic authorship that assume independent and autonomous authorship and even genius in the creation of original musical works. This individualistic and autonomous vision of musical authorship, which is central to copyright law, has deemphasized the importance and continuity of musical borrowing practices generally. The tension between conceptions of musical production and actual music practice is particularly highlighted in the case of hip hop music, which is now the …

Towards New Web Services Based Supervisory Systems Dedicated To Nomadic Operators, Djilali Idoughi, Christophe Kolski

Professor Djilali IDOUGHI

This paper outlines new approaches and motivations about supervisory HMI, such as mobility and information access by different human actors belonging to the organization, by using diverse interaction devices, exploiting Web Services and their underlying technologies. The basic concepts are explained in the context of industrial supervision adopting a service oriented architecture (SOA) design approach which makes it possible to integrate real time information from different systems more easily than traditional ones. A representative supervisory scenario which illustrates the approach is described and discussed.

Changing Expectations Of Privacy And The Fourth Amendment, Robert Power Dec 2005

Changing Expectations Of Privacy And The Fourth Amendment, Robert Power

Robert C Power

Public attitudes about privacy are central to the development of fourth amendment doctrine in two respects. These are the two “reasonableness” requirements, which define the scope of the fourth amendment (it protects only “reasonable” expectations of privacy), and provide the key to determining compliance with its commands (it prohibits “unreasonable” searches and seizures). Both requirements are interpreted in substantial part through evaluation of societal norms about acceptable levels of privacy from governmental intrusions. Caselaw, poll data, newspaper articles, internet sites, and other vehicles for gauging public attitudes after the September 11 attacks indicate that public concerns about terrorism and the …

Negotiated Rulemaking And The Sunshine Law: Can It Help Local Law Enforcement And The Press Get Along?, Daxton R. Stewart Dec 2005

Negotiated Rulemaking And The Sunshine Law: Can It Help Local Law Enforcement And The Press Get Along?, Daxton R. Stewart

Daxton "Chip" Stewart

The Negotiated Rulemaking Act can provide guidance to press and law enforcement representatives to help them come to a negotiated agreement on handling the grey areas of open records law that have long frustrated employees of both. A negotiated protocol could be extremely helpful in easing the tensions inherent in this daily effort, and it could even serve to better inform and protect the public interest.

The Trafficking Of Domestic Workers Into Lebanon, Khaled A. Beydoun Dec 2005

The Trafficking Of Domestic Workers Into Lebanon, Khaled A. Beydoun

Khaled Beydoun

This article examines the trafficking of Ethiopian domestic workers into Lebanon. Since 1989, the number of domestic workers from Ethiopia trafficked into Lebanon has skyrocketed. The majority of these domestic workers are neither extended protection from their native or host states, which coupled with local racism and xenophobia, exposes these domestic workers to economic exploitation, abuse, and violence. This article provides a survey of this under-examined maid trade, and proposes prescriptive measures aimed at protecting the human rights of Ethiopian domestic workers in Lebanon, and combating illegal trafficking.

Heidegger E Foucault, Críticos Da Modernidade: Humanismo, Técnica E Biopolítica, Andre De Macedo Duarte Dec 2005

Heidegger E Foucault, Críticos Da Modernidade: Humanismo, Técnica E Biopolítica, Andre De Macedo Duarte

Andre de Macedo Duarte

I intend to discuss Foucault’s and Heidegger’s critical diagnosis of Modernity emphasizing its continuities. Generally speaking, it is possible to argue that in Heidegger philosophical reflection assumes itself as essentially historical, while in Foucault’s case historical investigation assumes itself as an essentially philosophical task. Although recognizing the differences between Foucault’s and Heidegger’s general theoretical approaches, I argue that both consider that, in order to understand who we are today, it is necessary to elaborate a critical understanding of Modernity. In both cases, Modernity is viewed as a historical epoch characterized by humanism, i.e., by the projection of human beings as …

Force Rules, John C. Yoo Dec 2005

Force Rules, John C. Yoo

John C Yoo

This piece criticizes U.N. proposals to reform the international legal rules on the use of force. While they properly identify threats to international peace and security as arising outside the context of great power warfare, they make it even more difficult for nations to address these new challenges. They codify a rule that gives the Security Council complete authority over all uses of force short of national self-defense, rather than providing nations with flexibility. They expand the size of the Security Council, which will only aggravate the body's collective action troubles in authorizing force. Reform should begin by modifying the …

Who's So Afraid Of The Eleventh Amendment, John C. Yoo, Jesse Choper Dec 2005

Who's So Afraid Of The Eleventh Amendment, John C. Yoo, Jesse Choper

John C Yoo

This Article argues that critics have exaggerated the impact and importance of the Eleventh Amendment cases. This is not to deny that revived judicial security for states' rights has become the signature issue of the Rehnquist Court. We examine whether the subject deserves the enormous importance that many, including a number of commentators and several Justices, have given it. We conclude that it does not. A series of doctrines, both internal and external to the Eleventh Amendment, allow the federal government to achieve its policy objectives. Preventing private plaintiffs from suing states for retrospective money damages poses at most a …

Building A Market: From Personal To Impersonal Exchange, Vernon L. Smith, Erik Kimbrough, Bart J. Wilson Dec 2005

Building A Market: From Personal To Impersonal Exchange, Vernon L. Smith, Erik Kimbrough, Bart J. Wilson

Bart J Wilson

Adam Smith identified two key components in the wealth creation process of human societies: exchange and specialization. More than two centuries later relatively little is understood about the underlying process by which people build exchange systems and discover comparative advantage. In this chapter we report on a pilot experiment that explores the social mainsprings that give rise to the market. Specifically, using cash-motivated participants we compare and contrast the personal, social interactions within a village with those of the participants engaged in long-distance trade among a system of interconnected virtual villages.
