The Online Sex Sting, Michael Cryan 2015 Bridgewater State University

The Online Sex Sting, Michael Cryan

Undergraduate Review

The Youth Internet Safety Surveys are indicative of a small subset of minors who have had contact with sexual offenders in person. Internet sex stings serve to target these adults through the use of police deception, but their use has been on the decline. Sexual offenders are a heterogeneous group; laws often mistakenly lump these various members together. This paper discusses different sources that can take responsible action to prevent online predators from reaching minors and the issue of vigilantism against offenders. Our current laws on sexual predators do not reflect the deeper, more prevalent issue of acquaintance rape.

High Times: Is The Federal Legalization Of Marijuana Next? What The Food And Drug Administration Could Learn From Its Existing Regulations, Christopher B. Erly

American University Journal of Gender, Social Policy & the Law

This student comment examines the efficacy of marijuana being regulated by the Food and Drug Administration. The author discusses and applies potential FDA regulatory models that could be used to regulate marijuana. The comment concludes marijuana could be easily regulated under the current Food and Drug Administration regulatory scheme and suggests that marijuana should be regulated in a manner akin to tobacco rather than as a drug.

Alleviating Risks Of Parental Incarceration Through Mentorship, Sonia Murrey 2015 Walden University

Alleviating Risks Of Parental Incarceration Through Mentorship, Sonia Murrey

Walden Dissertations and Doctoral Studies

The focus of the present study was on the lack of positive socialization of children affected by parental incarceration. Researchers have indicated the need to broaden the examination of the effects of parental incarceration on children. Mentorship has demonstrated a positive influence for youth who display at-risk behaviors. However, there is little research regarding the effectiveness of mentorship programs for youth who have experienced the negative effects of parental incarceration. The purpose of this transcendental phenomenological study was to describe the experiences of youth who have completed an individualized mentorship program following parental imprisonment. Flyers were distributed to case managers …

Critical Factors In Police Use-Of-Force Decisions, Orville Nickel 2015 Walden University

Critical Factors In Police Use-Of-Force Decisions, Orville Nickel

Walden Dissertations and Doctoral Studies

This study investigated law enforcement officers' perceptions of the legal, normative, and practical considerations that are implicit in their decisions when faced with using physical force. Law enforcement officers observe and protect fundamental human rights. A significant problem, however, is that physical force is sometimes misused, impacting public confidence in police services. The study was framed by Durkheim's conflict theory and Beirie's concepts of police corporate culture and social control. It used a grounded theory method and predeveloped case scenarios presented to 2 male focus groups of 7 and 6 participants respectively, and 2 female focus groups of 5 and …

General Strain Theory As A Predictor Of Occupational Fraud, Timothy Bergsma 2015 Walden University

General Strain Theory As A Predictor Of Occupational Fraud, Timothy Bergsma

Walden Dissertations and Doctoral Studies

The world economy loses an estimated $3.5 trillion annually due to fraud. A weakened economy leads to additional hardships for individuals, families, and organizations. General strain theory (GST) posits that certain strains lead to negative emotional responses, and the result is delinquent behavior. The purpose of this research was to analyze the relationship between strain and occupational fraud through the theoretical framework of GST. The research questions addressed (a) occupational frauds as measured by strain levels of perpetrators, (b) the relationship between strain scores and the different occupational fraud types, and (c) the significance of the relationship between fraud motivation …

Predictors Of Recidivism For Offenders With Mental Illness And Substance Use Disorders, Linda Buckmon 2015 Walden University

Predictors Of Recidivism For Offenders With Mental Illness And Substance Use Disorders, Linda Buckmon

Walden Dissertations and Doctoral Studies

Mental illness and substance use disorders have been determined to be leading predictors for recidivism among criminal offenders in the United States who are released to community supervision. Women make up an increasing in percentage of this criminal justice population; however, few studies have explored the role that gender plays in determining men and women's recidivism. Offender's education, employment, and peer association have also been reported to be predictors increasing the likelihood of recidivism among criminal offenders. This study was designed to determine if gender, mental illness, substance use disorder, employment, education, and peer association predicted recidivism. Differential association theory …

Police Perceptions And Decision Making Related To Domestic Minors Trafficked Through Prostitution, Donna Sue Belin 2015 Walden University

Police Perceptions And Decision Making Related To Domestic Minors Trafficked Through Prostitution, Donna Sue Belin

Walden Dissertations and Doctoral Studies

In spite of a paradigm shift redefining domestic minors trafficked through prostitution as victims instead of criminal offenders, many police officers experience uncertainty in the way they evaluate the nature of domestic minor sex trafficking (DMST) and assess the culpability status of prostituted minors. This problem often results in revictimizing children and hindering their ability to access needed services. The purpose of this multiple case study was to explore police officers' perceptions of minors engaged in prostitution and derive an understanding of the experiences, beliefs, and values that underlie these perceptions. The study also focused on how these factors influence …

Predictors Of Community Supervision Failures Among Female Offenders, Fayola Wolfe 2015 Walden University

Predictors Of Community Supervision Failures Among Female Offenders, Fayola Wolfe

Walden Dissertations and Doctoral Studies

This study explored the predictors of community supervision failures amongst female offenders in the United States criminal justice system. Female offenders have, in comparison with male offenders, particular challenges for community reintegration. This study used the relational theory and Maslow's hierarchy of needs theory to investigate the effects of childhood trauma on adult female offenders' behaviors, including substance use disorder and mental health issues. Secondary archival data were obtained from the Court Services and Offender Supervision Agency's AUTO Screener and Supervision and Management Automated Record Tracking System; this data pool included information on 1,085 female offenders who had served at …

The purpose was to identify internal/external factors as well as initiation methods in order to develop programs to reduce or prevent female gang membership.

Understanding The Victim-Offender Overlap: An Exploratory Study, Christine Kay Hannis 2015 Missouri State University

Understanding The Victim-Offender Overlap: An Exploratory Study, Christine Kay Hannis

Graduate Theses/Dissertations

The strong and consistent relationship between criminal involvement and victimization is one of the most persistent documented findings within criminological research. The current problem associated with this relationship involves the lack of studies on the nature and extent of why this overlap exists, with even less research focusing on the perspectives of the offenders who identify themselves as victims. The current study attempts to better understand the victim-offender overlap by analyzing the experiences of criminal offenders who also identify as victims of crime, within the context of various theoretical perspectives. Various themes emerge to elaborate on the nature of the …

The Influence Of A Juvenile's Abuse History On Support For Sex Offender Registration, Cynthia J. Najdowski, M. C. Stevenson, J. M. Salerno, T. R. A. Wiley, B. L. Bottoms, K. M. Farnum 2015 University at Albany, State University of New York

The Influence Of A Juvenile's Abuse History On Support For Sex Offender Registration, Cynthia J. Najdowski, M. C. Stevenson, J. M. Salerno, T. R. A. Wiley, B. L. Bottoms, K. M. Farnum

Psychology Faculty Scholarship

We investigated whether and how a juvenile’s history of experiencing sexual abuse affects public perceptions of juvenile sex offenders in a series of 5 studies. When asked about juvenile sex offenders in an abstract manner (Studies 1 and 2), the more participants (community members and undergraduates) believed that a history of being sexually abused as a child causes later sexually abusive behavior, the less likely they were to support sex offender registration for juveniles. Yet when participants considered specific sexual offenses, a juvenile’s history of sexual abuse was not considered to be a mitigating factor. This was true when participants …

The field of psychology and law, including forensic psychology, is an exciting concentration of research activity and student training and has grown rapidly, but to what extent have teaching and training efforts in the field been systematically catalogued and evaluated? We conducted a historical review and content analysis of the American and Canadian literature on the scholarship of teaching and training in the field. This review catalogs (a) information related to the development of training and teaching, (b) descriptions of programs and courses at various levels, and (c) articles on teaching resources or techniques in this field. We hope it …

The Impact Of Jury Instruction Formatting And Insanity Defense Consistency On Juror Knowledge And Decision-Making, Elaine Tsao 2015 Scripps College

The Impact Of Jury Instruction Formatting And Insanity Defense Consistency On Juror Knowledge And Decision-Making, Elaine Tsao

Scripps Senior Theses

Past literature has indicated that jury instructions are not written in ways that result in optimal juror comprehension, and can be improved through various ways of simplification. Prototypes of the insanity defense have also been found to influence juror decision-making. Additionally, individual factors such as attitudes toward and myth endorsement of the insanity defense can influence verdict. The following study explored these effects of jury instruction format, insanity defense consistency, and participant factors on jury understanding and decision-making. Three hundred and eighty jury eligible community members were recruited online for this study. Participants were first asked questions pertaining to attitudes …

Culpability And Modern Crime, Samuel W. Buell 2015 Duke Law School

Culpability And Modern Crime, Samuel W. Buell

Faculty Scholarship

Criminal law has developed to prohibit new forms of intrusion on the autonomy and mental processes of others. Examples include modern understandings of fraud, extortion, and bribery, which pivot on the concepts of deception, coercion, and improper influence. Sometimes core offenses develop to include similar concepts, such as when reforms in the law of sexual assault make consent almost exclusively material. Many of these projects are laudable. But progressive programs in substantive criminal law can raise difficult problems of culpability. Modern iterations of criminal offenses often draw lines using concepts involving relative mental states among persons whose conduct is embedded …
