The Pracademic And Academic In Criminal Justice Education: A Qualitative Analysis, James E. Mccabe, Stephen A. Morreale, John R. Tahiliani

Criminal Justice Faculty Publications

Over the past several years, a few hundred colleagues involved in criminal justice education have participated in panel discussions and roundtables to discuss the trials and issues that have been observed by practitioners turned academics, or “pracademics.” Some complained of having difficulty breaking into academia. A debate has occurred in a number of colleges and universities over the benefit of having faculty with traditional academic credentials versus hiring non-traditional scholars with a blend of educational and practical experience. Similarly, there have been lively discussions over the appropriateness of a J.D. or professional doctorate as opposed to a Ph.D. in criminal …

A Method And A Case Study For The Selection Of The Best Available Tool For Mobile Device Forensics Using Decision Analysis, Shahzad Saleem, Oliver Popov, Ibrahim Baggili

Electrical & Computer Engineering and Computer Science Faculty Publications

The omnipresence of mobile devices (or small scale digital devices - SSDD) and more importantly the utility of their associated applications for our daily activities, which range from financial transactions to learning, and from entertainment to distributed social presence, create an abundance of digital evidence for each individual. Some of the evidence may be a result of illegal activities that need to be identified, understood and eventually prevented in the future. There are numerous tools for acquiring and analyzing digital evidence extracted from mobile devices. The diversity of SSDDs, types of evidence generated and the number of tools used to …

Analysis Of The Federal Aviation Administration's Small Uas Regulations For Hobbyist And Recreational Users, Jon Loffi, Ryan J. Wallace, Christopher S. Ison

International Journal of Aviation, Aeronautics, and Aerospace

Widespread proliferation of small Unmanned Aerial Systems (sUAS), particularly those used for hobby and recreational purposes, have become a growing problem for the Federal Aviation Administration (FAA) in recent years. Reports of aircraft and sUAS near misses are on the rise and several similar anecdotes of ground injuries and property damage can be traced back to sUAS operations. This study sought to explore recent regulatory and policy initiatives in place to deter unsafe hobby and recreational sUAS use and hold operators accountable for hazardous sUAS activities. Using document analysis, case study, and conceptual analysis methodology, researchers analyzed 40 information sources. …

Charging The Poor: Criminal Justice Debt & Modern-Day Debtors' Prisons, Neil L. Sobol 2016 Texas A&M University School of Law

Charging The Poor: Criminal Justice Debt & Modern-Day Debtors' Prisons, Neil L. Sobol

Faculty Scholarship

Debtors’ prisons should no longer exist. While imprisonment for debt was common in colonial times in the United States, subsequent constitutional provisions, legislation, and court rulings all called for the abolition of incarcerating individuals to collect debt. Despite these prohibitions, individuals who are unable to pay debts are now regularly incarcerated, and the vast majority of them are indigent. In 2015, at least ten lawsuits were filed against municipalities for incarcerating individuals in modern-day debtors’ prisons. Criminal justice debt is the primary source for this imprisonment.

Criminal justice debt includes fines, restitution charges, court costs, and fees. Monetary charges exist …

Interrupting The Silence: An Action Research Study To Transform A Juvenile Justice Culture For Lesbian, Gay, Bisexual, Transgender, And Intersex (Lgbtqi) Youth, Dawn N. Mcrae

Theses and Dissertations

This action research (AR) study explored practitioners’ knowledge of Lesbian, Gay, Bisexual, Transgender, Questioning, and Intersex (LGBTQI) youth issues in a juvenile justice setting. A research and service approach was employed to develop a LGBTQI policy and training. This study was motivated by three research questions. Does sensitivity training increase practitioner knowledge concerning LGBTQI youth in juvenile justice? What are the attitudes of juvenile justice practitioners concerning the stigmatization of LGBTQI youth in a juvenile correctional setting? How can the findings of this study improve support networks for LGBTQI youth in a juvenile correctional setting? To examine these questions, pre-test …

The Effect Of Cognitive Load On Liars And Truth Tellers: Exploring The Moderating Impact Of Working Memory Capacity, Sarah Jordan 2016 CUNY Graduate Center

The Effect Of Cognitive Load On Liars And Truth Tellers: Exploring The Moderating Impact Of Working Memory Capacity, Sarah Jordan

Dissertations, Theses, and Capstone Projects

Two studies are presented. The purpose of the first study is to examine the moderating impact of working memory capacity (WMC) on the cognitive load produced by both the type of statement a person is making and the manner in which the person is interviewed in a mock crime scenario. The moderating impact of suspects’ WMC (measured using the automated operation span task) on this process was also assessed. Suspects were instructed to tell the truth, a relatively easy lie, or a more difficult lie. Suspects were then interviewed in a relatively easy manner, a moderately more difficult manner, or …

When Human-Leopard Conflict Turns Deadly: A Cross-Country Situational Analysis, Julie S. Viollaz 2016 CUNY Graduate Center

When Human-Leopard Conflict Turns Deadly: A Cross-Country Situational Analysis, Julie S. Viollaz

Dissertations, Theses, and Capstone Projects

Habitat destruction and pollution are two of the main causes for the decline of the planet’s biodiversity. Yet environmentalists are now recognizing that illegal wildlife killings, both poaching and retaliatory killings due to human-wildlife conflict, are perhaps the next major threat. Biologists have researched illegal killings and their effect on species conservation, but few researchers have applied criminological principles of crime reduction to them. This research will explore the situational factors that drive retaliatory leopard killings in parts of South Africa, Kenya, and India. These factors, human and environmental, include local expectations from wildlife, sensitivity to environmental issues, communication between …

Through The Gateway: Marijuana Production, Governance, And The Drug War Détente, Michael Polson 2016 CUNY Graduate Center

Through The Gateway: Marijuana Production, Governance, And The Drug War Détente, Michael Polson

Dissertations, Theses, and Capstone Projects

Since the 1996 voter approval of medical marijuana laws in California, marijuana policy has become increasingly liberalized. Producers, however, have remained in the greyest of grey market zones. Federal anti-drug laws and supply-side tactics have intensively targeted them even as marijuana has become more licit. In this legally unstable environment, marijuana patient-cultivators and underground producers have articulated and asserted themselves politically and economically, particularly as the likelihood of full legalization has increased. This dissertation explores how producers navigated the nebulous zone between underground and medical markets. I argue that even as producers supplied marijuana to a formalizing, regulated medical industry …

Empowerment From Within: Supporting Palestinian Women’S Struggle Against Violence, Ortal Bensky 2016 CUNY Graduate Center

Empowerment From Within: Supporting Palestinian Women’S Struggle Against Violence, Ortal Bensky

Dissertations, Theses, and Capstone Projects

Recent reports by the United Nations and local non-governmental organizations present a troubling increase in incidents of violence against Palestinian women in Palestine. These are cases of domestic violence, where the attackers are Palestinians, and political violence, where the attackers are Israeli settlers and soldiers. These violent incidents include attacks on body and property. Most incidents are neither dealt with by the Palestinian authorities nor by the Israeli government and judicial system. There is not sufficient international pressure to enforce justice. The purpose of this study is to offer alternative ways to prevent violent crimes, enforce relevant laws, and provide …

Locked In: Melancholia In The Modern American Prison Literature Of R. Dwayne Betts And Jarvis Jay Masters, Johnna Scrabis 2016 CUNY Graduate Center

Locked In: Melancholia In The Modern American Prison Literature Of R. Dwayne Betts And Jarvis Jay Masters, Johnna Scrabis

Dissertations, Theses, and Capstone Projects

This thesis explores the theme of melancholia in the writing of currently and formerly incarcerated African American men during the late 20th and early 21st century. Melancholia, with its rich history in literature from ancient times to the present, is discernable in the works of many people with prison experience. In their writing, melancholia is expressed primarily as a loss and as a disconnection with time, as well as an empowering creative force. The work of Jarvis Jay Masters and R. Dwayne Betts reflects the paradox of melancholia: just as it shows the depressive element of the condition, …

Psychopathology And Crime Causation: Insanity Or Excuse?, Meagan Cline

Fidei et Veritatis: The Liberty University Journal of Graduate Research

One of the most controversial topics in the criminal justice industry is the "insanity defense" and its applicability or validity in prosecuting criminal cases. The purpose of this assignment is to identify and discuss psychopathology and crime causation in terms of mental illness, research, and the insanity defense. For this evaluation, information was gathered from scholarly research, textbooks, dictionaries, and published literature. These sources were then carefully reviewed and applied to the evaluation in a concise, yet informative, manner. This assignment also addresses some of the key terms in psychopathology and crime causation, including various theories, definitions, and less commonly …

"Safer" Harbor: The Impact Of Different Models Of Safe Harbor Laws On The Criminalization Of Commercially Sexually Exploited Children In The United States, Priscila Borges Marques dos Santos 2016 Marshall University

"Safer" Harbor: The Impact Of Different Models Of Safe Harbor Laws On The Criminalization Of Commercially Sexually Exploited Children In The United States, Priscila Borges Marques Dos Santos

Theses, Dissertations and Capstones

Commercially sexually exploited children (CSEC) are commonly treated as criminals and punished for offenses committed as a result of being trafficked. Recent state-level legislative efforts have sought to prevent minors from being held criminally liable for being commercially sexually exploited. This study offers an analysis of the effects of such laws on the criminalization of CSEC through the use of ordinary least squares (OLS) regression. Data on the number of child arrests for prostitution (1995-2014) and safe harbor laws were collected from the FBI Uniform Crime Reports, the Polaris Project website, and the 2015 ECPAT report. The findings of the …

Improving Forensic Software Tool Performance In Detecting Fraud For Financial Statements, Brian Cusack, Tau’aho Ahokov 2016 Auckland University of Technology

Improving Forensic Software Tool Performance In Detecting Fraud For Financial Statements, Brian Cusack, Tau’Aho Ahokov

Australian Digital Forensics Conference

The use of computer forensics is important for forensic accounting practice because most accounting information is in digital forms today. The access to evidence is increasingly more complex and in far greater volumes than in previous decades. The effective and efficient means of detecting fraud are required for the public to maintain their confidence in the reliability of accounting audit and the reputation of accounting firms. The software tools used by forensic accounting can be called into question. Many appear inadequate when faced with the complexity of fraud and there needs to be the development of automated and specialist problem-solving …
