Social science research has studied the role of neighborhood order in explaining perceptions of crime and official crime statistics for decades. When citizens perceive their neighborhood to be socially and/or physically disordered, community and interpersonal relationships diminish, mistrust increases, including negative perceptions of police legitimacy, and overall individual wellness decreases. บทความนี้มีวัตถุประสงค์เพื่อศึกษาประสบการณ์ของระบบกฎหมายฝรั่งเศสในการจัดกลุ่มกฎหมายที่มีคุณค่าในระดับรัฐธรรมนูญ โดยอาศัยคณะตุลาการรัฐธรรมนูญเป็นองคาพยพในการจัดกลุ่มและพัฒนาหลักการทางรัฐธรรมนูญที่มีความเป็นพลวัตให้เกิดความชัดเจนภายใต้ทฤษฎีการจัดลำดับศักดิ์ของกฎหมาย โดยผลการศึกษาพบว่า คณะตุลาการรัฐธรรมนูญได้อาศัยบทบัญญัติของรัฐธรรมนูญแห่งสาธารณรัฐฝรั่งเศส ค.ศ. 1958 ที่กำหนดให้คำวินิจฉัยของคณะตุลาการรัฐธรรมนูญมีผลผูกพันทุกองค์กรมาใช้ในการพัฒนากลุ่มกฎหมายที่มีคุณค่าในระดับรัฐธรรมนูญ โดยการวินิจฉัยให้เอกสารทางกฎหมายอื่น ๆ ถือเป็นส่วนหนึ่งของกลุ่มกฎหมายที่มีคุณค่าในระดับรัฐธรรมนูญ ซึ่งประสบการณ์ดังกล่าวสามารถนำมาปรับใช้กับระบบกฎหมายไทยได้ในกรณีที่ต้องมีการตีความเอกสารทางกฎหมายที่มีมาก่อนการประกาศใช้รัฐธรรมนูญให้มีสถานะดังเช่นรัฐธรรมนูญ รวมถึงการตีความหลักการทางกฎหมายที่เคยปรากฏในรัฐธรรมนูญฉบับก่อนแต่ไม่ปรากฏในรัฐธรรมนูญฉบับปัจจุบัน

ความตกลงที่ครอบคลุมและก้าวหน้าสำหรับหุ้นส่วนทางเศรษฐกิจภาคพื้นแปซิฟิก (Comprehensive and Progressive Agreement for Trans-Pacific Partnership: CPTPP) กำหนดนิยามของสินค้าใช้แล้วที่ผ่านกระบวนการผลิตซ้ำ ว่าเป็นสินค้าที่มีส่วนประกอบของวัสดุเดิมที่มีการนำมาปรับแก้บางส่วนหรือทั้งหมด ทั้งมีอายุการใช้งานเท่าสินค้าใหม่และสามารถใช้งานได้เหมือนกับหรือใกล้เคียงกับสินค้าใหม่ และมีการรับประกันจากโรงงานเช่นเดียวกับสินค้าใหม่ อย่างไรก็ดี CPTPP ได้กำหนดห้ามมิให้ประเทศสมาชิกเลือกปฏิบัติต่อสินค้าดังกล่าว ซึ่งกฎหมายเกี่ยวกับเครื่องมือแพทย์มิได้กำหนดหลักเกณฑ์เกี่ยวกับเครื่องมือแพทย์ลักษณะดังกล่าวไว้ ดังนั้น หากประเทศไทยเข้าร่วมเป็นสมาชิกเป็นข้อผูกพันจะต้องยอมรับเครื่องมือแพทย์ใช้แล้วที่ผ่านกระบวนการผลิตซ้ำ ก็จำเป็นต้องพิจารณาตัวอย่างการกำกับดูแลเครื่องมือแพทย์ของต่างประเทศประกอบกับการบริหารจัดการความเสี่ยง ไม่ว่าจะเป็นความเสี่ยงต่อผู้รับบริการสาธารณสุข บุคลากรด้านสาธารณสุข ผู้ใช้แรงงานในอุตสาหกรรมการผลิตเครื่องมือแพทย์ ตลอดจนความเสี่ยงด้านสิ่งแวดล้อม ทั้งนี้ เพื่อจัดทำมาตรการทางกฎหมายในการกำกับดูแลเครื่องมือแพทย์ใช้แล้วที่ผ่านกระบวนการผลิตในประเทศไทยตั้งแต่ขั้นตอนการผลิตก่อนออกสู่ตลาด ระบบเฝ้าระวังและการติดตามตรวจสอบ รวมทั้งการจัดการขยะเครื่องมือแพทย์ที่เหมาะสม

หลักหน่วยทางเศรษฐกิจเดียวกัน ซึ่งได้รับการพัฒนาขึ้นโดยศาลสหภาพยุโรป เป็นหลักที่เอื้ออำนวยให้ผู้ใช้กฎหมายแข่งขันทางการค้าสามารถพิจารณาความเป็นผู้ประกอบธุรกิจและวินิจฉัยคดีที่เกี่ยวข้องกับกฎหมายแข่งขันทางการค้าได้อย่างสอดคล้องกับความเป็นจริงทางเศรษฐกิจ อย่างไรก็ดี วิจัยฉบับนี้พบว่า พระราชบัญญัติการแข่งขันทางการค้า พ.ศ. 2560 มิได้ให้การยอมรับหลักหน่วยทางเศรษฐกิจเดียวกันในฐานะหลักในการพิจารณาความเป็นผู้ประกอบธุรกิจ ด้วยเหตุนี้เอง จึงมีความจำเป็นที่จะต้องแก้ไขนิยามของผู้ประกอบธุรกิจตามพระราชบัญญัติฉบับดังกล่าว เพื่อให้เกิดการยอมรับหลักหน่วยทางเศรษฐกิจเดียวกันอย่างถูกต้องและเหมาะสม

หลักเกณฑ์ในการพิจารณาความรับผิดทางอาญาของผู้กระทำความผิดที่มีสภาวะจิตผิดปกตินับเป็นปัญหาสำหรับศาลและนักกฎหมายมาช้านานในอดีต เนื่องจากผู้กระทำความผิดบางรายอาจกระทำความผิดไปโดยไม่รู้สึกตัว เพราะมีสาเหตุมาจากความบกพร่องทางประสาท สมอง จิตใจ อารมณ์และความเครียด ซึ่งความผิดปกติทางจิตขนาดใดจึงจะนำมาพิจารณาว่าผู้นั้นไม่มีความผิด หรือมีความผิดแต่ควรยกเว้นโทษหรือลดโทษนี้ ศาลของประเทศอังกฤษได้วางหลักสำคัญไว้ในการพิจารณาคดี McNaghten’s (1843) ว่าต้องสันนิษฐานไว้ก่อนว่ามนุษย์ทุกคนมีจิตปกติ เว้นแต่จะมีข้อสันนิษฐานซึ่งสามารถพิสูจน์ได้ว่าขณะกระทำความผิดจำเลยได้รับความเจ็บปวดจากโรคทางจิตจนไม่ทราบเนื้อหาและสาระสำคัญของการกระทำ กล่าวคือไม่สามารถรู้ได้ว่าสิ่งนั้นถูกหรือผิด หลักเกณฑ์ดังกล่าวนี้ได้ถูกนำไปใช้อย่างแพร่หลายทั้งในสหรัฐอเมริกาและประเทศในภูมิภาคยุโรป ซึ่งนำไปสู่การตัดสินว่าจำเลยไม่มีความผิดโดยศาลจะมีคำสั่งให้ควบคุมตัวจำเลยไปรับการบำบัดรักษาที่สถานพยาบาล สำหรับการพิจารณาถึงความรับผิดของผู้ที่มีจิตบกพร่อง โรคจิต หรือจิตฟั่นเฟือน ตามแนวทางในการพิจารณาคดีของศาลนั้นหากผู้กระทำไม่รู้สำนึกของการกระทำย่อมไม่มีความผิดตามประมวลกฎหมายอาญา มาตรา 59 ถ้าหากผู้กระทำรู้สำนึกแต่ไม่สามารถรู้ผิดชอบ หรือไม่สามารถบังคับตนเองได้ถือเป็นเหตุยกเว้นโทษ และถ้าผู้กระทำความผิดยังสามารถรู้ผิดชอบอยู่บ้าง หรือยังสามารถบังคับตนเองได้บ้าง ผู้นั้นต้องรับโทษสำหรับความผิดนั้น โดยศาลจะลงโทษน้อยกว่าที่กฎหมายกำหนดไว้สำหรับความผิดนั้นเพียงใดก็ได้ตามมาตรา 65 ซึ่งจะเห็นได้ว่าในกรณีที่ศาลตัดสินว่าจำเลยไม่มีความผิดนี้อาศัยความตามมาตรา 59 ถือว่าผู้กระทำความผิดไม่รู้สำนึกซึ่งใช้หลักเกณฑ์เดียวกับบุคคลทั่วไปซึ่งหากไม่รู้สำนึกในการกระทำก็ย่อมไม่มีความผิด ดังปรากฏตามคำพิพากษาฎีกาที่ 8743/2544 คำพิพากษาฎีกาที่ 2590/2562 แต่สำหรับผู้กระทำความผิดที่มีจิตบกพร่อง โรคจิต หรือจิตฟั่นเฟือนนั้นได้กระทำความผิดไปโดยไม่รู้ถึง “สภาพ” และ “สาระสำคัญ” ของการกระทำจึงควรบัญญัติแยกไว้เป็นอีกมาตราหนึ่งให้ผู้นั้นไม่มีความผิดและหากผลของการกระทำความผิดมีความร้ายแรงต่อชีวิต ร่างกายหรือทรัพย์สินของผู้อื่นก็ควรให้เป็นดุลพินิจของศาลในการมีคำสั่งให้ส่งตัวผู้นั้นเข้ารับการบำบัดรักษาในสถานพยาบาลได้เช่นเดียวกับที่บัญญัติความไว้ใน มาตรา 48 นอกจากนี้ หากผู้กระทำความผิดยังสามารถรู้ผิดชอบหรือยังสามารถบังคับตนเองได้บ้างก็ควรมีเกณฑ์ลดโทษตามความร้ายแรงของการกระทำความผิดดังเช่นหลักเกณฑ์ตามประมวลกฎหมายอาญาของสาธารณรัฐฝรั่งเศสเพื่อให้เกิดความเป็นธรรมต่อผู้เสียหาย ทั้งยังควรนำวิธีการคุมประพฤติมาใช้บังคับหลังจากที่จำเลยพ้นโทษในกรณีที่ผู้นั้นได้กระทำความผิดร้ายแรงดังเช่น สาธารณรัฐฝรั่งเศสและประเทศอังกฤษ เพื่อป้องกันมิให้ผู้นั้นกลับมากระทำความผิดซ้ำขึ้นอีก

บทความวิชาการนี้มุ่งเน้นศึกษาบทบาทของศาลกฎหมายทะเลระหว่างประเทศในการให้ความเห็นแนะนำเกี่ยวกับการเปลี่ยนแปลงสภาพภูมิอากาศ โดยเป็นการวิเคราะห์สาระสำคัญของความเห็นแนะนำ Request for an Advisory Opinion submitted by the Commission of Small Island States on Climate Change and International Law (Request for Advisory Opinion submitted to the Tribunal) Case No.31 และวิเคราะห์และสังเคราะห์ผลประโยชน์ที่ประเทศไทยในฐานะรัฐภาคีของอนุสัญญาสหประชาชาติว่าด้วยกฎหมายทะเล ค.ศ. 1982 จะได้รับจากความเห็นของศาล โดยผลการศึกษาพบว่าประเทศไทยจะได้รับผลประโยชน์ทั้ง 2 ด้าน คือ 1. ผลประโยชน์ในแง่กระบวนการพิจารณาของศาล และ 2. ผลประโยชน์เกี่ยวกับการออกนโยบายและมาตรการเกี่ยวกับการป้องกัน ลด และควบคุมภาวะมลพิษของสิ่งแวดล้อมทางทะเลและการปกป้องและรักษาสิ่งแวดล้อมทางทะเลจากการเปลี่ยนแปลงสภาพภูมิอากาศ

อำนาจของผู้จัดการมรดกตามกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายเป็นเรื่องที่มีความสำคัญ โดยเฉพาะอย่างยิ่งในสภาพการณ์ปัจจุบันที่โลกได้ก้าวเข้าสู่ยุคแห่งความไร้พรมแดนจึงอาจทำให้ทรัพย์สินของเจ้ามรดกกระจัดกระจายอยู่ได้ในหลายประเทศ การที่จะพิจารณาว่ากฎหมายของประเทศใดเป็นกฎหมายที่ใช้บังคับกับนิติสัมพันธ์ในเรื่องอำนาจของผู้จัดการมรดกนั้นย่อมเป็นหน้าที่ของกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมาย สำหรับระบบกฎหมายขัดกันว่าด้วยอำนาจของผู้จัดการมรดกนั้นอาจแบ่งได้เป็น 2 ระบบ กล่าวคือ ระบบที่แยกเรื่องผู้จัดการมรดกออกจากเรื่องทรัพย์มรดก และระบบที่ไม่แยกเรื่องผู้จัดการมรดกออกจากเรื่องทรัพย์มรดก ในขณะที่เมื่อพิจารณาถึงกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายนั้น กฎหมายขัดกันของแต่ละประเทศได้ให้การยอมรับจุดเกาะเกี่ยวในการค้นหากฎหมายที่ใช้บังคับกับเรื่องอำนาจของผู้จัดการมรดกไว้แตกต่างกัน โดยกฎหมายขัดกันของอังกฤษได้อาศัยกฎหมายภายในกำหนดถึงอำนาจของผู้จัดการมรดก ในขณะที่กฎหมายขัดกันของประเทศจีนได้อาศัยกฎหมายแห่งถิ่นที่ทรัพย์นั้นตั้งอยู่เป็นจุดเกาะเกี่ยวส่วนภายใต้ระบบกฎหมายขัดกันของไทยนั้นไม่ได้มีการกำหนดกฎเกณฑ์ในการเลือกกฎหมายเพื่อใช้บังคับกับเรื่องอำนาจของผู้จัดการมรดกไว้เป็นการเฉพาะ จึงต้องใช้กลไกการอุดช่องว่างของกฎหมายตามมาตรา 3 พระราชบัญญัติว่าด้วยการขัดกันแห่งกฎหมาย พุทธศักราช 2481 ซึ่งกำหนดให้ใช้กฎเกณฑ์ทั่วไปแห่งกฎหมายระหว่างประเทศแผนกคดีบุคคลบังคับ

This study encompasses the following urban wetlands: "La Kisst," situated in the city center, and "María Eugenia," located in the southern part of the city of San Cristóbal de las Casas. There are four wetlands within the municipality, all of which have been protected as natural areas by a Ramsar decree since 2008. This research brief summarizes about half a dozen courtroom observations and a dozen interviews conducted with practitioners and court representatives affiliated with the Grand Forks Domestic Violence Court (GFDVC). About 43% of women and 31% of men in the state of North Dakota have experienced some form of sexual, physical, or stalking violence in their lifetime (Smith et al., 2023). Rates of intimate partner violence (IPV) against women in the state generally matches that of the broader nation, though the state ranks as one of the lowest in terms of violence against men.

The 2023 Elder Fraud Report serves to illuminate trends in elder fraud reports throughout the 50 U.S. states, Washington, D.C., Puerto Rico, Guam, U.S. Minor Outlying Islands, American Samoa, U.S. Virgin Islands, and Northern Mariana Islands. This fact sheet focuses on elder fraud data for the Mountain West states of Arizona, Colorado, Nevada, New Mexico, and Utah.

Objective

This study examines patrol officer and supervisor perceptions of an artificial intelligence (AI) tool to assist with officer report writing. We compare attitudes among patrol officers randomly assigned to use the AI tool against those who were not.

Methods

Following a randomized controlled trial within a single agency, we conducted a post-intervention survey of patrol officers and supervisors.

Results

Patrol officers expressed generally favorable perceptions toward AI-assisted report writing, though no significant differences emerged between treatment and control groups in perceived utility, speed improvement, or quality enhancement. This study examines the relationship between adverse childhood experiences (ACEs) and cybercriminal behavior among 238 active hackers with verified website defacements identified through the Zone-H archive. Drawing upon General Strain Theory, this research investigates whether childhood trauma influences both the developmental timing and motivational aspects of hacking activities. Using ordinary least squares and ordered logistic regression analyses with country-clustered standard errors, the study tested two hypotheses: (1) that higher ACE scores would be associated with earlier onset of hacking behavior, and (2) that higher ACE scores would predict increased likelihood of engaging in revenge-motivated hacking. The goal of International Humanitarian Law (IHL) is purported to be the humanization of wars. Nonetheless, the atrocities committed in wars and the war criminals’ impunity suggest the failure of IHL. Notwithstanding, some voices call for reforming and developing IHL. In contrast, this thesis argues that IHL should be rejected entirely since the distinction between privileged and unprivileged combatants indicates that IHL is biased against anti-colonizers. Currently, little research explores how prosecutors have made sense of these reforms and how discovery changes have impacted their day-to-day routines. Often, the people who must spend most of their time in these spaces, people experiencing homelessness, are barred by local or state law from being there. Fort Worth, Texas, implemented a camping ban in 2019 that prohibits camping on public or private property. "Police discharge their firearms more often at dogs than humans, and as a profession, kill thousands of dogs every year. The number of dogs killed by police during these encounters has government officials declaring that an “epidemic” is occurring within policing itself, with some commentators referring to this trend as “puppycide” or “canicide.” The purpose of this article is to examine how the judiciary rationalizes canicide, or the police killing of dogs, and the role canicide plays in the justification of police violence. This fact sheet also reports the number of people affected by mass shooting events (MSEs) as originally reported in “Association Between Markers of Structural Racism and Mass Shooting Events in Major US Cities,” published by The Journal of the American Medical Association (JAMA) Surgery. The original article derives data from 865 MSEs across 51 MSAs in the United States.
