In this essay, I employ qualitative discourse analysis of eleven purposively selected literature to examine how “Nigerian scam” became an established yet detached signifier of advance-fee fraud in global discourse. I do not treat this association as a reflection of offender identity or national inclination. Instead, the analysis traces how attribution is produced through representational repetition, institu tional uptake, and the circulation of familiar narrative cues. Using qualitative discourse analysis and an interpretive approach, this paper distinguishes among the socio-technical conditions that enable fraud, the institutional processes that stabilize attribution, and the semiotic dynamics through which national categories acquire durability. …

It is of great importance that research investigates the impact of sexual offender treatment programmes given the damage caused by sexual offences to victims and society more broadly. However, psycho-criminological literature has focused on reporting post-treatment recidivism outcomes for people who have sexually offended homogeneously and has not investigated the unique experiences of Indigenous people. Therefore, we systematically collated and critically appraised studies reporting recidivism outcomes for Indigenous people who have received treatment for sexual offences. Fourteen studies were identified utilising a sample of 5,635 individuals (30.7% Indigenous or First Nations). Recidivism was lower for Indigenous and First Nations people …

Sexual offending by young people causes significant harm to victims, families and communities. Treatment engagement and completion are therefore important for reducing future harm; however, young people who drop out of, or refuse to engage in, treatment present a unique challenge for clinicians and justice systems. Drawing on Bronfenbrenner’s (1979) ecological systems theory, this study explored clinicians’ perspectives on the barriers to treatment engagement and completion for young people who have sexually offended in the Australian context. This essay reimagines the meaning of home and privacy for Black Americans by interrogating the legal and technological systems that routinely collapse the sanctity of the homeplace. Using the no-knock warrant as a central case study, this essay illustrates how state-sanctioned intrusions transform a space of rest, memory, and self-making into a site of violence. Although Fourth Amendment doctrine purports to guard against unreasonable searches, its prevailing binary framework–distinguishing only between “inside” and “outside” the home–renders Black domestic spaces uniquely vulnerable. This study examines the predictors of fear of crime (FOC) across three Canadian municipalities: Hamilton, Ontario; Brantford, Ontario; and North Battleford, Saskatchewan. Data from 1,956 survey responses were analyzed to understand how certain factors shape FOC across different municipal contexts in Canada. This study uses descriptive statistics, reliability analyses, correlation matrices, and Ordinary Least Squares regression models to examine whether FOC, and the predictors of FOC, operate consistently across municipalities. The findings indicate that the predictors of FOC are relatively reliable across municipal contexts. However, the influence of the predictors of FOC can vary across municipalities. Indigenous Peoples across Turtle Island experience disproportionately high rates of violence and homicide compared to other racial groups. Rooted in coloniality and sustained by Western institutions, this epidemic is recognized as the Missing and Murdered Indigenous Relatives (MMIR) crisis. In response, Indigenous women have mobilized the MMIR Movement to raise awareness and advocate for institutional change. Although scholarship on MMIR has expanded, limited research has explored the experiences of MMIR advocates. Studies of crime and place have long asked how much random processes contribute to the spatial and spatiotemporal concentration of crime. Traditionally, simulations assume that crime incidents occur randomly across microgeographic units—such as block groups, street segments, and parcels—by selecting geographic units at random with replacement. This dissertation takes a different approach, modeling crime incidents as random selections among potential targets, also with replacement. In this framework focusing primarily on burglary, simulated patterns reflect the spatial distribution of potential targets (i.e., properties). How do pathways between childhood victimization, drug use, and offending behavior vary for recordholders of different races and genders? Prior literature and theory indicates that there are distinct processes that can link childhood victimization to drug use and other offending behavior. จากการศึกษาเปรียบเทียบการกำกับดูแลการผูกขาดในประเทศสหรัฐอเมริกาและประเทศญี่ปุ่น ผู้เขียนได้ค้นพบว่าวัตถุประสงค์ของกฎหมายต่อต้านทรัสต์ของประเทศสหรัฐอเมริกาคือ “ประสิทธิภาพ” และ “สวัสดิการผู้บริโภค” ทำให้ในยุคเศรษฐกิจดิจิทัล หน่วยงานบังคับใช้กฎหมายต่อต้านทรัสต์ของประเทศสหรัฐ อเมริกาประสบปัญหาในการกำกับดูแลการผูกขาดโดยบริษัทแพลตฟอร์มอิเล็กทรอนิกส์ที่มีอำนาจเหนือตลาด เนื่องจากผู้บริโภคได้ประโยชน์จากการผูกขาดดังกล่าว แม้ว่าผู้มีส่วนได้เสียอื่น โดยเฉพาะอย่างยิ่งคู่ค้าที่เป็นบริษัทขนาดกลางและขนาดย่อม (Small and Medium Enterprise: SME) จะถูกเอารัดเอาเปรียบก็ตาม ส่วนในประเทศญี่ปุ่น วัตถุประสงค์ของกฎหมายป้องกันการผูกขาด คือ การสนับสนุนและรักษาไว้ซึ่ง “การแข่งขันที่เสรีและเป็นธรรม” ซึ่งหมายความรวมถึงการปกป้อง SMEs จากการถูกเอารัดเอาเปรียบและพฤติกรรมการปฏิบัติทางการค้าที่ไม่เป็นธรรม (Unfair Trade Practices) ของบริษัทขนาดใหญ่ด้วย ส่วนวัตถุประสงค์ของกฎหมายแข่งขันทางการค้าในประเทศไทยมีความคล้ายคลึงกับประเทศญี่ปุ่น จึงมีบทบัญญัติเกี่ยวกับพฤติกรรมการปฏิบัติทางการค้าที่ไม่เป็นธรรมเช่นเดียวกัน ผู้เขียนจึงเสนอแนะให้หน่วยงานบังคับใช้กฎหมายป้องกันการผูกขาดของประเทศไทยออกกฎหมายลำดับรองเพื่อกำกับดูแลพฤติกรรมของผู้ประกอบธุรกิจแพลตฟอร์มตัวกลางการซื้อขาย (E-Commerce) ที่มีอำนาจเหนือตลาดในประเทศไทย

หลักความคาดหวังอันชอบธรรมเป็นกลไกสำคัญในระบบกฎหมายปกครองสมัยใหม่ที่มุ่งคุ้มครองความไว้วางใจของประชาชนต่อการกระทำของรัฐ บทความนี้ศึกษาพัฒนาการและสาระสำคัญของหลักการดังกล่าวในระบบกฎหมายเปรียบเทียบ ได้แก่ ระบบกฎหมายเยอรมนีที่หลักความคาดหวังอันชอบธรรมได้รับการยอมรับเป็น “หลักรัฐธรรมนูญทั่วไป” ภายใต้หลักนิติรัฐ และเชื่อมโยงกับหลักความมั่นคงแน่นอนทางกฎหมายและหลักความได้สัดส่วน ในอังกฤษหลักนี้มีจุดเริ่มต้นจากแนวคิดเรื่องความเป็นธรรมในกระบวนการก่อนขยายไปสู่การคุ้มครองผลประโยชน์เชิงเนื้อหาโดยใช้หลักการถ่วงดุลกับประโยชน์สาธารณะ ส่วนประเทศอื่น เช่น ออสเตรเลีย แคนาดา โปแลนด์ อินเดีย และฝรั่งเศส ต่างมีลักษณะการปรับใช้เฉพาะที่สะท้อนเป้าหมายร่วมกันในการจำกัดอำนาจรัฐและคุ้มครองความไว้วางใจของประชาชน สำหรับประเทศไทย ศาลปกครองไทยได้วางหลักการตีความสำคัญหลายประการทั้งการคุ้มครองเชิงเนื้อหาที่รับรองฐานะทางกฎหมายแม้คำสั่งจะถูกเพิกถอนในภายหลัง การชั่งน้ำหนักระหว่างความคาดหวังส่วนบุคคลกับประโยชน์สาธารณะ การเชื่อมโยงหลักความคาดหวังอันชอบธรรมกับหลักนิติรัฐ ข้อยกเว้นกรณีประมาทเลินเล่อร้ายแรงและการปกปิดข้อเท็จจริงที่มีสาระสำคัญ อย่างไรก็ตาม การปรับใช้ยังขาดความสม่ำเสมอในสาระสำคัญของการคุ้มครองความไว้วางใจของประชาชน บทความจึงนำเสนอแนวทางการพัฒนากฎหมายปกครองไทย ทั้งการปรับปรุงกฎหมายที่มีอยู่ให้ครอบคลุมรูปแบบความคาดหวังที่หลากหลาย การพัฒนาแนวทางการตีความของศาลที่ยอมรับการคุ้มครองทั้งในเชิงกระบวนการและเชิงเนื้อหา และการสร้างกลไกทางกฎหมายใหม่ เช่น คณะกรรมการไกล่เกลี่ยข้อพิพาท อันจะนำไปสู่การพัฒนาระบบกฎหมายปกครองไทยที่เป็นธรรม โปร่งใส และสอดคล้องกับหลักนิติรัฐอย่างแท้จริง

การรอการกำหนดโทษหรือรอการลงโทษ ตามประมวลกฎหมายอาญา มาตรา 56 เป็นมาตรการที่มีความสำคัญในกระบวนการยุติธรรมทางอาญา ซึ่งเป็นมาตรการที่บัญญัติขึ้นโดยมีวัตถุประสงค์ให้ศาลใช้ดุลพินิจรอการกำหนดโทษหรือรอการลงโทษสำหรับคดีที่มีอัตราโทษจำคุกระยะสั้นหรือโทษปรับ ตามทฤษฎีการลงโทษเพื่อแก้ไขพฤติกรรมของผู้กระทำความผิด กล่าวคือ ในคดีความผิดอาญาที่มีโทษจำคุกหรือปรับ และศาลจะลงโทษจำคุกไม่เกิน 5 ปี ทั้งนี้ เพื่อมิให้ผู้กระทำความผิดเล็กน้อยนั้นเข้าไปปะปนกับผู้กระทำความผิดเป็นอาจิณและเลียนแบบพฤติกรรมนั้นจนกลับมากระทำความผิดซ้ำอีก และเพื่อให้โอกาสผู้กระทำความผิดได้รู้สำนึกถึงสิ่งที่ได้กระทำลงไป รวมถึงสามารถกลับมาดำเนินชีวิตในสังคมได้อย่างเป็นปกติ แต่ในทางกลับกันเมื่อพิจารณาจากการบังคับใช้ประมวลกฎหมายอาญา มาตรา 56 ศาลสามารถใช้ดุลพินิจได้กับทุกฐานความผิด แม้ลักษณะของฐานความผิดนั้นจะกระทบกระเทือนต่อความปลอดภัยของสังคมมากเพียงใด แต่หากโทษจำคุกที่ศาลลงมีกำหนดไม่เกิน 5 ปี ศาลก็สามารถสั่งรอการกำหนดโทษหรือรอการลงโทษได้กับทุกกรณี ซึ่งอาจจะขัดหรือแย้งกับทฤษฎีการลงโทษทางอาญาประการอื่น กล่าวคือ ทฤษฎีการลงโทษเพื่อแก้แค้น การลงโทษเพื่อข่มขู่ยับยั้ง การลงโทษเพื่อตัดผู้กระทำผิดออกจากสังคมรวมถึงการลงโทษเพื่อป้องกันอาชญากรรม อันส่งผลกระทบต่อความรู้สึกและการได้รับความยุติธรรมของผู้เสียหาย หรือเหยื่อในคดีอาญารวมทั้งประชาชนในสังคม เนื่องจากในบางกรณีเป็นฐานความผิดที่มีความร้ายแรง และเป็นอันตรายต่อสังคม แต่ผู้กระทำความผิดกลับไม่ถูกลงโทษ ยิ่งไปกว่านั้นอาจทำให้ผู้เสียหายไม่ได้รับความยุติธรรม และบุคคลทั่วไปย่อมเข้าใจว่าการกระทำร้ายแรงเช่นนั้นสามารถกระทำได้โดยไม่ต้องรับผลใด ๆ จากการกระทำดังกล่าว ฉะนั้นจึงควรปรับปรุงแก้ไข และจัดทำคำแนะนำเกี่ยวกับวิธีการรอการลงโทษหรือรอการกำหนดโทษให้มีความชัดเจนยิ่งขึ้น โดยการกำหนดแนวทาง หรือข้อพิจารณาที่ผู้ใช้กฎหมายควรให้การคำนึง และให้ความสำคัญยิ่งขึ้นเกี่ยวกับฐานความผิดร้ายแรงที่ไม่ควรรอการกำหนดโทษหรือรอการลงโทษ เพื่อให้การลงโทษเป็นไปตามสัดส่วนของการกระทำความผิด และตรงตามทฤษฎีวัตถุประสงค์ของการลงโทษ

การโฆษณาโดยเจาะจงตัวบุคคลส่งผลกระทบต่อสิทธิในความเป็นส่วนตัวของเด็กทั้งในรูปแบบของการเฝ้ามองพฤติกรรมทางออนไลน์ การเก็บรวบรวม ใช้ หรือการเปิดเผยข้อมูลส่วนบุคคลโดยไม่ได้รับความยินยอมหรือไม่มีกฎหมายให้อำนาจไว้ การทำโปรไฟล์ หรือการนำเสนอโฆษณาที่ตอบสนองต่อความต้องการหรือลักษณะเฉพาะของตัวเด็ก สามารถชักจูงความคิดหรือกระตุ้นความต้องการของผู้รับโฆษณาได้โดยเฉพาะเพื่อแสวงหาประโยชน์ในทางเศรษฐกิจ สังคม การเมือง หรือวัตถุประสงค์อื่นใด การที่เด็กซึ่งเป็นบุคคลกลุ่มเปราะบางของสังคมอาจมีความรู้ความเข้าใจในการใช้งานเทคโนโลยีดิจิทัลและเครือข่ายออนไลน์และมีวิจารณญาณในการรับสื่อโฆษณาที่ไม่เพียงพอ ส่งผลให้เด็กมีความเสี่ยงจากการตกเป็นเป้าหมายของการแทรกแซงสิทธิในความเป็นส่วนตัวและการแสวงหาประโยชน์อันไม่ชอบจากการกระทำดังกล่าวได้โดยง่าย จากการศึกษาพิจารณาได้ว่า กฎหมายภายในของไทยในปัจจุบันอาจมีไม่เพียงพอสำหรับการคุ้มครองสิทธิในความเป็นส่วนตัวของเด็กจากการโฆษณาโดยเจาะจงตัวบุคคลตามมาตรฐานระหว่างประเทศ ดังนั้น บทความนี้จึงมีวัตถุประสงค์ในการศึกษาแนวทางการพัฒนามาตรการทางกฎหมายที่เหมาะสมกับสถานการณ์ในปัจจุบันเพื่อคุ้มครองสิทธิในความเป็นส่วนตัวของเด็กให้สอดคล้องกับพันธกรณีของประเทศไทยที่มีอยู่ตามกฎหมายระหว่างประเทศ

การพัฒนาที่ยั่งยืน (Sustainable Development) เป็นแนวคิดด้านการพัฒนาที่ได้รับการยอมรับในระดับสากลและมีบทบาทเป็นแนวทางการพัฒนาที่ทุกประเทศนำไปปรับใช้ โดยมีนิยามว่า การพัฒนาที่ตอบสนองความต้องการของคนรุ่นปัจจุบัน โดยไม่กระทบต่อความสามารถในการตอบสนองความต้องการของคนรุ่นอนาคต โดยมี สามเสาหลักแห่งการพัฒนาที่ยั่งยืน (The three pillars of sustainability) เป็นหัวใจสำคัญของหลักการ ซึ่งการบูรณาการมิติด้านการพัฒนาทั้งสามด้าน ได้แก่ เศรษฐกิจ สังคม และสิ่งแวดล้อม ให้สอดคล้องกัน ซึ่งประเทศไทยมีพันธกิจในระดับสากลในการนำหลักการพัฒนาที่ยั่งยืนมาปรับใช้กับการพัฒนาภายในประเทศทุกภาคส่วน รวมถึงการจัดการป่าไม้อันเป็นทรัพยากรธรรมชาติภายในประเทศ บทความฉบับนี้จึงเป็นการศึกษาและวิเคราะห์กฎหมายป่าไม้ของไทย โดยศึกษาในเชิงประวัติศาสตร์กฎหมายนับตั้งแต่ก่อนการก่อตั้งกรมป่าไม้ในสมัยรัชกาลที่ 5 ซึ่งเป็นช่วงแรกเริ่มของการตรากฎหมายป่าไม้ มาจนถึงกฎหมายป่าไม้ในช่วงเวลาปัจจุบัน เพื่อชี้ให้เห็นว่ากฎหมายป่าไม้ของไทยได้นำเอาหลักการพัฒนาที่ยั่งยืนมาปรับใช้จริงและมีความสอดคล้องกับพัฒนาการของหลักการพัฒนาที่ยั่งยืน โดยปรากฏผ่านหลักการของกฎหมายป่าไม้ในหลายภาคส่วนที่แสดงให้เห็นถึงการบูรณาการทางเศรษฐกิจ สังคม และสิ่งแวดล้อม ซึ่งเป็นหัวใจสำคัญของหลักการพัฒนาที่ยั่งยืน

บทความวิจัยนี้ศึกษาพันธกรณีภายใต้ความตกลงระหว่างประเทศว่าด้วยการลงทุนที่เกี่ยวข้องกับการกระทำทางตุลาการ และแนวคำชี้ขาดของคณะอนุญาโตตุลาการที่ระงับข้อพิพาทระหว่างรัฐกับนักลงทุน เพื่อวิเคราะห์นัยของพันธกรณีของรัฐตามความตกลงดังกล่าวต่อการทำหน้าที่ของศาลโดยเฉพาะอย่างยิ่งในการกำกับดูแลการอนุญาโต ตุลาการทางพาณิชย์ มีหลายคดีที่นักลงทุนกล่าวหาว่าการกระทำของศาลในการกำกับดูแลการอนุญาโตตุลาการทางพาณิชย์ละเมิดพันธกรณีของรัฐตามความตกลงระหว่างประเทศว่าด้วยการลงทุน ซึ่งทำให้คณะอนุญาโตตุลาการต้องทบทวนคำพิพากษาและคำสั่งของศาลภายใน จากการศึกษาพบว่าคณะอนุญาโตตุลาการมีแนวโน้มที่จะยอมรับดุลพินิจของศาลภายใน กรณีที่ถือว่าการกระทำของศาลเป็นการละเมิดพันธกรณีตามความตกลงระหว่างประเทศว่าด้วยการลงทุนต้องเป็นกรณีที่การกระทำของศาลมีความบกพร่องอย่างร้ายแรงซึ่งพิจารณาจากมาตรฐานระหว่างประเทศ อนุสัญญาว่าด้วยการยอมรับนับถือและการบังคับตามคำชี้ขาดอนุญาโตตุลาการต่างประเทศ ค.ศ. 1958 มีบทบาทสำคัญในการพิจารณาความรับผิดของรัฐตามความตกลงระหว่างประเทศว่าด้วยการลงทุน

Brought forth by common rhetoric, Appalachia is often viewed as the closest space to that of an empyrean domain. Separated from the sleepless city, its allure rests in its created identity of a quiet, green escape from the city, which offers serenity on all fronts. Although Appalachia can fulfill this profile, such an ascension ignores the burning yellow grass below. The purpose of this paper is to examine the history of the destruction of Appalachia through the lens of extractive industries and the region’s designation as a sacrifice zone. Child abuse and neglect are prevalent problems, affecting an estimated one million children worldwide each year. The purpose of this paper is to evaluate and analyze three potential solutions to reduce the rates of child abuse and neglect. The three programs that were suggested were: improving overall access to healthcare, therapy and counseling, and other support services for children and families who need them, implementing more Nurse-Family Partnerships across the United States for first time mothers with visits from a registered nurse, and increasing parent’s access to economic resources and improving families overall financial security. The Controlled Substances Act (CSA) is the primary regulatory and criminal legislation surrounding drugs in the United States. Passed in the 1970s, the CSA established the drug classification scheduling system we use today. Despite being over 50 years old today, the CSA has not achieved its goal of eliminating or even significantly reducing drug use and offenses. This paper conducts an analysis of the CSA's legislative intent versus its actual results through reviews of measures such as incarceration rates, inconsistent regulation, and disproportionate racial effects to argue that the Controlled Substances Act has failed in its mission while causing significant …

The purpose of this paper is to examine the continued concern about substance abuse/misuse and limited access to treatment in rural areas. Rural areas lack the adequate treatment needed to combat substance use disorder (SUD), mainly due to the lack of sufficient providers trained to identify, treat, and support those dealing with SUD.
