Between Evangelism And Multiculturalism: The Dynamics Of Christianity In Indonesia, Chang Yau HOON 2013 Singapore Management University

Between Evangelism And Multiculturalism: The Dynamics Of Christianity In Indonesia, Chang Yau Hoon

Research Collection School of Social Sciences

Christianity has experienced rapid growth in Indonesia, particularly the Evangelical and Pentecostal/Charismatic movements, which find fertile ground among the urban middle class. This phenomenon has given rise to fears of Christianisation among the Muslim majority, who perceive the Christian growth as a moral threat. Tensions between Christians and Muslims have been part and parcel of religious developments in Indonesia. The author addresses the ways in which Protestant churches in Indonesia negotiate between evangelism (to fulfil the ‘Great Commission’) on the one hand, and multiculturalism (peaceful coexistence with difference) on the other. The article will examine how Christians in Indonesia navigate …

Recruiting The All-Female Rani Of Jhansi Regiment: Subhas Chandra Bose And Dr Lakshmi Swaminadhan, Tobias Frederik Rettig

Research Collection School of Social Sciences

The recruitment of the all-female Rani of Jhansi Regiment of the Indian National Army in Japanese-controlled Singapore and Malaya, with a particular focus on the period between the first female guard of honour on 12 July 1943 through to the opening of the regiment's main camp in Singapore on 22 October 1943, has to date been insufficiently studied. Starting with the conception of the Regiment in an Axis submarine by the Indian nationalist leader Subhas CHANdra Bose (1897–1945), this paper examines the ideas and figures that inspired the regiment and the role of Bose and Dr Lakshmi Swaminadhan (1914–2012) in …

Refugee Reflections: A Focus On The Lived Experiences Of African Refugees Resettling In Michigan, Diane Roushangar 2013 Western Michigan University

Refugee Reflections: A Focus On The Lived Experiences Of African Refugees Resettling In Michigan, Diane Roushangar

Masters Theses

Refugee resettlement is often observed by focusing on external indicators of integration such as employment and English proficiency. What is often ignored is the multi-faceted process refugees experience in regard to the emotions that occur during these transitions of resettlement. Emotional stressors include financial concerns, work-related issues, a lack of adequate counseling services and ESL support that can all lead to increased anxiety. This paper examines the process of resettlement that northeast African and sub-Saharan African refugees have experienced including issues of unsafe working conditions, changing gender roles, and a lack of adequate time for adjusting to the culture.

The Fiduciary Doctrine As A New Pathway: An Alternative Approach To Analysing Native Customary Rights In Sarawak, Hang Wu TANG 2013 Singapore Management University

The Fiduciary Doctrine As A New Pathway: An Alternative Approach To Analysing Native Customary Rights In Sarawak, Hang Wu Tang

Research Collection Yong Pung How School Of Law

This paper explores the use of the fiduciary doctrine whereby the state is conceived as a fiduciary vis-à-vis her native peoples and attendant equitable remedies are made available for the native customary rights over land in Sarawak. Thus far, most challenges to extinguishment of native customary rights in Sarawak have proceeded on constitutional grounds, with little success. This article draws on the jurisprudence of fiduciary law in other parts of the Commonwealth and argues that this is a viable alternative cause of action against the state.

Little India Riot: The Dog That Did Not Bark, Tan K. B. EUGENE 2013 Singapore Management University

Little India Riot: The Dog That Did Not Bark, Tan K. B. Eugene

Research Collection Yong Pung How School Of Law

In a commentary, SMU Associate Professor of Law and NMP Eugene Tan said that in the aftermath of the Little India riots, the focus and dominant narrative had been on law and order issues, with the Government emphasising that it was a spontaneous "one-off" event. He said that there was a need to consider if Singapore was prepared to shoulder more of the costs of having a large foreign labour force. However, he also noted that an immediate cutback of the workforce size would be simplistic and is not the solution, as reducing reliance on foreign workers could not be …

Financial Reporting Quality Of Chinese Reverse Merger Firms: The Reverse Merger Effect Or The China Effect?, Kun-Chih Chen, Qiang Cheng, Ying Chou Lin, Yu-Chen Lin, Xing Xiao

Research Collection School Of Accountancy

In this paper, we examine why Chinese reverse merger (RM) firms have lower financial reporting quality. We find that while U.S. RM firms have similar financial reporting quality as matched U.S. IPO firms, Chinese RM firms exhibit lower financial reporting quality than Chinese ADR firms. We further find that Chinese RM firms exhibit lower financial reporting quality than U.S. RM firms. These results indicate that the use of RM process is associated with poor financial reporting quality only in firms from China, where the legal enforcement is weaker than U.S. In addition, we find that compared to Chinese ADR firms, …

Case Comment: A New Framework For The Implication Of Terms In Fact, Yihan GOH 2013 Singapore Management University

Case Comment: A New Framework For The Implication Of Terms In Fact, Yihan Goh

Research Collection Yong Pung How School Of Law

In Sembcorp Marine Ltd v PPL Holdings Pte Ltd the Singapore Court of Appeal once again reaffirmed the Singapore courts’ rejection of the approach adopted by Lord Hoffmann in Attorney General of Belize v Belize Telecom Ltd which characterised the implication of a term in fact as a process of contractual interpretation. What may be of interest to practitioners and academics of common law jurisdictions wrestling with the implications of the Belize approach is the Court of Appeal’s prescription of ‘a three-step process’ for the implication of terms in fact, which is accompanied by an in-depth discussion of various conceptual …

On the interpretation of Art 144(1), therewas no prima facie case of reasonable suspicion that such incompatibility existed. Moreover, the applicant did not have sufficient interest in the matter.

Comparative Direct Democracy: A Study Of Institutions And Individuals, Donald D. Mirjanian 2013 University of Nevada, Las Vegas

Comparative Direct Democracy: A Study Of Institutions And Individuals, Donald D. Mirjanian

UNLV Theses, Dissertations, Professional Papers, and Capstones

Do institutions matter? This dissertation examines the role of institutions in the context of comparative direct democracy. Through an institutionalist framework, this study considers how the context in which the mechanism of direct democracy is first introduced has an impact on later usage, and how individuals operate when constrained by those very institutions. In particular, I examine the cases of Italy, France, Uruguay, and Venezuela and find that the inclusion of direct democracy mechanisms (most commonly, the referendum device) is more likely to occur when previously excluded "out-groups" participate in constitutional formation. In addition, I find that institutional design is …

South-South Relations And The English School Of International Relations: Chinese And Brazilian Ideas And Involvement In Sub-Saharan Africa, Joseph Marques, Anthony Spanakos

Department of Political Science and Law Faculty Scholarship and Creative Works

The rise of large developing countries has led to considerable discussions of re-balancing global relations and giving greater priority to understanding South-South relations. This paper, in exploring the central ideas of Chinese and Brazilian foreign policy and the behavior of these two rising Southern countries toward Sub-Saharan Africa, argues that the English School of International Relations is well suited to understanding the intentions and actions that characterize South-South relations.

Down At The Cross, Elena Perez-Zetune 2013 Gettysburg College

Down At The Cross, Elena Perez-Zetune

SURGE

For the first thirteen years of my familial life, I walked a block to devoutly pray to statues with open arms, promising open gates- my radiant mother walking with once thin father, hand in hand like a teenage couple. My sister, with her thick night-black curly hair, skipped and fell every other step, not due to young age but simply an unfortunate quarrel with gravity. Always trailing close behind was my brother clutching his precious cards shouting, “I choose you Pikachu” along the way.

From kindergarten through eighth grade, I walked through the hallways of my Catholic primary school. The …

Protecting Shareholders From Themselves: How The United Kingdom’S 2011 Takeover Code Amendments Hit Their Mark, Matthew Peetz 2013 Dickinson School of Law, Penn State University

Protecting Shareholders From Themselves: How The United Kingdom’S 2011 Takeover Code Amendments Hit Their Mark, Matthew Peetz

Penn State Journal of Law & International Affairs (2012 - Present)

Kraft’s takeover of Cadbury in 2011 caused considerable uproar in the United Kingdom. The political outcry caused significant amendments to the United Kingdom’s regulatory framework over mergers and acquisitions, the so-called, Takeover Code. These changes to the Takeover Code were made to help relieve pressure on target companies during takeover situations, and to correct the imbalance of power in favor of bidding companies that the political community had perceived during the Kraft-Cadbury takeover. After the changes were made, but before they were implemented, the business community expressed concern that these added regulations would be detrimental to the M&A market as …

The Case Of Christmas Island: How International Law Affects The Australian-Malaysian Refugee Deal, Ria Pereira 2013 Penn State Dickinson Law

The Case Of Christmas Island: How International Law Affects The Australian-Malaysian Refugee Deal, Ria Pereira

Penn State Journal of Law & International Affairs (2012 - Present)

In July 2011, Australia and Malaysia entered into an arrangement in which Australian asylum seekers would be removed to neighboring Malaysia to have their asylum claims processed. Following widespread criticism in the media, Australia’s High Court ruled that such a deal violated Australia’s refuges protection laws. While this ruling should have put an end to the deal, Australia’s Immigration Minister indicated that the agreement might nevertheless be feasible. Policy makers proposed amending Australian domestic immigration laws to allow the deal to go forward unencumbered. A bill to amend Australia’s Migration Act was subsequently introduced. As it currently stands, Australian law …

The Cost Of Fear: An Analysis Of Sex Offender Registration, Community Notification, And Civil Commitment Laws In The United States And The United Kingdom, Kate Hynes

Penn State Journal of Law & International Affairs (2012 - Present)

Sex offenders are often seen as a notorious group in both the United States and the United Kingdom. The public opinion of the masses has often found its way into the laws which restrict the privacy and freedoms of many sex offenders. This comment will examine the often divergent trends in lawmaking and judicial authority in both countries in regard to sex offender registration, community notification, and civil commitment. Further, the comment will study the lasting effects on the sex offender population and potential civil rights implications.

How Precipitous A Decline? U.S.-Iranian Relations And The Transition From American Primacy, Hillary Mann Leverett 2013 School of International Service, American University

How Precipitous A Decline? U.S.-Iranian Relations And The Transition From American Primacy, Hillary Mann Leverett

Penn State Journal of Law & International Affairs (2012 - Present)

This essay is grounded in two basic propositions. The first is that the greatest strategic challenge facing the United States is extricating its foreign policy from a well-worn but deeply counterproductive quest for hegemonic dominance in critical areas of the world, especially the Middle East. The second is that Washington’s handling of its relations with the Islamic Republic of Iran constitutes a crucial test of America’s capacity to put its foreign policy on a more productive and realistic trajectory. Since the Islamic Republic’s founding in 1979, Washington has refused to understand and accept the basic model underlying its political order—the …
