Spandeck: A Relational View Of The Duty Of Care, Kian Peng Soh

The use of a general framework in the determination of a duty of care has seemingly fallen out of favour following the UK Supreme Court’s decision in Robinson. Relying on the example of the Spandeck framework in Singaporean jurisprudence, this piece presents the argument that such frameworks, being consistent with a relational conception of tort law, can provide a useful means of determining whether a duty of care exists. In so doing, this piece addresses some criticisms of the relational view and re-emphasises the important role the duty of care plays in the tort of negligence.

With at least half of humanity under lockdown to arrest the spread of COVID-19 (Sandford, 2020), adults have been working from home and children engaging in home schooling for months on end. Competing for scarce resources such as digital devices, bandwidth, as well as physical and personal space, families have had to contend with rising tensions around the quality of digital engagement, children’s learning abilities, parent-child relationships and overall familial wellbeing. Just like most universities around the world, the senior management at Singapore Management University decided to move all courses to a virtual, online, synchronous mode, giving instructors a very short notice period—one week—to make this transition. In this paper, we describe the challenges, practical solutions adopted, and the lessons learnt in rapidly transitioning a face-to-face Master’s degree course in Text Analytics and Applications into a virtual, online, course format that could deliver a quality learning experience.

To investigate the values and social norms underpinning celebrity culture, it is crucial to study everyday uses of celebrity culture. Yet, studies in this area have been limited thus far, especially in non-Western contexts. This exploratory study focuses on the ways how young and middle-aged adults in everyday life in urban China discuss and value media celebrities. The results show that respondents have a rather similar way of valuing celebrity: celebrities need to have strong work ethics and showcase social responsibility; only then do they ‘earn’ their right to be considered ‘famous’. My talk, a thought-experimental blend of literary criticism and speculative "design fiction," will introduce you to an Asian American superhero of North Korean origin. In this science-fictional superhero, whom I have tentatively named "구름"/"☁️"/"Ku-reum," Korea's elusive realities coalesce into legible form. More specifically, they become available for narrative experience and relatable to us as an anthropomorphic character, a person with whom we might identify, come face-to-face, sympathize, interact dynamically, and have a conversation. Ku-reum is designed to reflect Korea's complex past and hopes for the future. Existing beyond division systems, Ku-reum uses the non-binary pronouns "one"/"they." Neither "South" nor "North," …

India has the highest number of acid attacks globally every year, and despite the actions taken by the Indian Government and the Supreme Court of India, the crime is on the rise. This increase can be attributed to the patriarchal ideology that is prevalent in India and to India’s inadequate legal system, which does not deliver efficient remedies to the victims. This article will discuss the prevalence of acid attacks in India, motives behind the attacks, consequences on victims, and shortcomings in measures adopted to prevent the crime and provide justice to victims.

In 2017, genocide in Myanmar took place against the stateless minority Rohingya Muslims. Why couldn’t the UN protect the Rohingya’s human rights? The international community's efforts to oppose these violations against the stateless people have been only passive. Then, who upholds your human rights when you are stateless? Using chronology, historical institutionalism, and process tracing analyses, this thesis (1) evaluates the UN’s legal regime’s systemic design and capabilities in protecting human rights; then (2) identifies the design flaws of our international human rights regime; and lastly, (3) develops a recommendation to protect all people, stateless or not. Due to the wealth of natural resources and the strategic geographic location of Kazakhstan and Kyrgyzstan, these two countries have attracted a significant amount of soft power investments, including foreign direct investment, non-government organizations, and infrastructure development. This paper compares the fluctuations in the soft power measurements to the levels of human development in Kazakhstan and Kyrgyzstan. The findings show highly similar changes in the amount soft power investments to the level of human development indicators, suggesting a strong correlation between the two measures. A methodological analysis and further data sets would be necessary to determine the connection though.

The presentation will focalize specifically around the recent live-action remake of the 1998 film "Mulan". The remake, premiered in March 2020, received critical backlash from various audiences (mostly from the BIPOC community), bashing the film for its misrepresentation of Ancient China and Ancient Chinese culture. Purpose: The purpose of this study is to investigate how a country's competitive tax policy influences its inward foreign direct investments (FDI) in the Asia–Pacific region, even when given particular constraints (e.g., population, public governance, skilled labor, and so on) exist. Design/methodology/approach: The paper uses the system GMM estimation approach to test the hypothesis. Data on FDI, corporate income tax, and various confounding factors were drawn from Ernst and Young's worldwide corporate tax guide, the World Bank, and other sources to create a panel of 28 economies over the period 2000–2016.
