The greatly expanded use of signing statements by President George W. Bush has been very controversial, as many view this as practice as an inappropriate encroachment by the president on the legislative function of Congress. A majority of the arguments made for or against the application of signing statements have focused on legal principles. The problem is that traditional legal, constitutional analysis does not fully address the concerns raised by signing statements. Not only is it unlikely that presidential signing statements violate the Constitution, but legal analysis fails to recognize or appropriately evaluate the policy implications of signing statements. Several questions about the minimum wage have not been answered adequately by scholars. The wage’s origins, its reasons for federal passage, the roots of its decline, and its future prospects are all up for debate in the current literature. The system of the Electoral College for presidential elections should remain intact and not be replaced by national popular election. Looking back at the discourse during the ratification of the Constitution, the Framers of the Constitution chose to devise the Electoral College to ensure the president would be truly a statesman, not a politician. Additionally, the Framers recognized that the “one person, one vote” system of popular election would not be sufficient to elect the president. Furthermore, since the President is an officer of the states, the Framers created a federal electoral system whereby small states have disproportionate representation in …

The United States currently faces a nuclear waste crisis. According to a 2002 report by former Secretary of Energy Spencer Abraham, “We have a staggering amount of radioactive waste in this country.”1 The Department of Energy (DOE) estimates that by 2035 the U.S. will have approximately 115,000 metric tons of high-level nuclear waste, which exceeds the capacity of the proposed federal storage site at Yucca Mountain.2 Deciding where and how to store nuclear waste is a significant nuclear, environmental, and health policy issue. This report, dated April 2008, from the United States (US) Army Corps of Engineers (Omaha District, Nebraska) explains the potential transfer of unused lands from the Garrison Dam Project to the Three Affiliated Tribes of Fort Berthold Reservation. The land transfer proposed to return a portion of land out of the 153,000 acres taken by the US Government for the construction of the Garrison Dam. The authority of this transfer is granted by the Fort Berthold Mineral Restoration Act of 1984 (Public Law 98-602). Deference Of Defiance? Principal-Agent Theory And The Us Courts Of Appeals During The Rehnquist And Burger Courts, Nathaniel R. Vanden Brook

Masters Theses

By examining cases from the Courts of Appeals in several issue areas between 1969 and 2002 (e.g., the Burger and Rehnquist Courts), this research examines both the fear of reversal from the high court (judicial impact theory) and whether this results in differences in response from these courts to Supreme Court precedent (principal-agent theory). The study finds that when the Supreme Court grants review to a decreasing number of lower court cases and thus gives a longer leash to these courts that instead of deferring to their principal, the appellate courts often defy the high court and seek to advance …

Articles

This paper sets out to develop an improved framework for examining critical junctures. This a priori framework is a significant improvement over existing critical juncture frameworks that lack any predictive element. It is an advance for historical institutionalism in particular, and political science in general. After the new framework is set out in detail here, it is tested. The framework is used to examine a number of potential critical junctures in macroeconomic policy, drawn from Ireland, Sweden, Britain, and America in the latter half of the twentieth century

Finding aid only for Manuscripts Small Collection 1560. Copies of three letters written by Andrew Jackson. The first, 31 May 1817, concerns provisions of a treaty with the Chickasaw Indians. The second, 3 May 1829, relates to the appointment of a surgeon at a federal penitentiary. The third, 3 November 1832, requests consideration for his nephew, Samuel Donelson, who was visiting Philadelphia. Also, copy of first photograph of Abraham Lincoln as President.
