All legal “interpretation” involves confrontation with inherently indeterminate language. I have distinguished in my own work between what I call the Constitution of Settlement and the Constitution of Conversation. The former includes those aspects of the Constitution that do indeed seem devoid of interpretive challenge, such as the unfortunate assignment of two senators to each state or the specification of the terms of office of representatives, senators, and presidents. I am quite happy to concede that “two,” “four,” and “six” have determinate meaning, though my concession is not based on a fancy theory of linguistics. It is, rather, a recognition …

A century ago, on May 21, 1919, the US House of Representatives voted difinitively (304 to 89) in support of women’s suffrage. Two weeks later, Wisconsinite Belle La Follette sat in the visitors’ gallery of the US Senate chamber. She “shed a few tears” when it was announced that, by a vote of 56 to 25, the US Senate also approved the Nineteenth Amendment, sending it on to the states for ratification.¹ For Belle La Follette, this thrilling victory was the culmination of a decades-long fight. The passage of the Chinese Exclusion Act is a dark chapter in the immigration history of the United States. In contrast to the overwhelming “Yellow Peril” literature of the time, the outcries of mistreated Chinese were few and far between, as they had little recourse against their accusers. This article attempts to identify the rare voices of Chinese Americans and recognizes the bold vision and noble endeavors of some progressive Americans during the Exclusion Era of the late nineteenth century. During the early twentieth century, the American eugenics movement prospered, spreading its influence within the sociopolitical framework of the United States. The notion of eugenics – the control of human breeding to increase desirable traits, was extensively propagated through the creation of sterilization laws and public programs. Eventually, the public came to view eugenics as a necessity in order to preserve and improve the quality of mankind for the future.

The im(migration) and refugee crisis that are being exacerbated under the Trump administration, is a manifestation of empire-building and the long history of colonization of the Global South. A Marxist-humanist perspective recognizes these as consistent aspects of a clearly racist global capitalism that functions in the interest of multibillion dollar U.S.–based corporations and increasingly transnational corporations. Trade agreements, international economic policy, political intervention, invasion or the threat of these, often secure corporate interests in specific countries and regions. How do denominational affiliation, religious participation, and religious beliefs influence one’s views on social and/or economic policies? I consider the impact of religious belonging, religious behaving, and religious believing—also known as the “3B’s” – on public opinion toward contemporary issues in the United States. Voter disillusionment is commonplace in the United States, with many eligible voters either choosing not to or altogether unable to exercise their right to vote. To the former, in 2016 alone, nearly 40 percent of eligible voters did not vote. Although it is an issue that extends to the health of a democracy, voting itself is not one that is central to campaign platforms, with candidates running on more high-profile issues such as healthcare or the economy. The Divided Labor Of Attack Advertising In Congressional Campaigns, Kenneth M. Miller

This article offers a theory of how party networks divide the labor of attacking opponents. Using an extensive data set of campaign advertising from the 2010 and 2012 congressional elections augmented with Nielsen television ratings data, it is shown that candidates attack opponents less when supporting outside groups attack more. Due to differences in how outside groups and candidates attack opponents, when candidates partially outsource attack advertising to independent expenditure groups, attacks in that campaign become more issue and policy based. Thus, in perhaps an unintended consequence of the divided labor of attack advertising, outside group involvement makes it more …

There is very limited Latino presence in the State Senate, with one Latina State Senator in office; having five Latinos in the Senate would be proportionate to the statewide Latino population. Six Latinos serve in the 160-member House of Representatives; eighteen would be proportionate. There are no Latinos in the state’s congressional delegation.

City councilors and members of school committees account for 83% of all Latinos serving in key elected leadership positions. The top 20 cities and towns with the largest proportions of Latino residents in Massachusetts account for 57% of the Latino population in the state. Among these cities …

This subject is discussed using the California Department of Motor Vehicles as a case study. There is a long-standing and well-understood relationship between legislators and the media. The Cold War in Latin America had marked consequences for the region’s political and economic evolution. From the origins of US fears of Latin American Communism in the early 20th century to the collapse of the Soviet Union in the early 1990s, regional actors played central roles in the drama. Seeking to maximize economic benefit while maintaining independence with regard to foreign policy, Latin Americans employed an eclectic combination of liberal and anti-imperialist discourses, balancing frequent calls for anti-Communist hemispheric unity with periodic diplomatic entreaties to the Soviet bloc and the nonaligned Third World. Charles Tyng has been heralded as an American hero after the posthumous publication of his memoir, Before the Wind: The Memoir of an American Sea Captain, 1808-1833, in 1999. Recent research involving British Treasury report books from the nineteenth century suggest otherwise – that Tyng actively promoted and was engaged in the illicit trade of African captives. A Boston Brahmin, Tyng applied the lessons of his time at sea with Perkins & Company, the opium trading firm, to his occupation as an agent of notorious slave trading firms in Havana. Scholars of American civil religion (ACR) have paid insufficient attention to the micro-level processes through which civil religious ideas have historically influenced beliefs and behavior. We know little about what makes such appeals meaningful to average Americans (assuming they are meaningful); nor do we know much about the mechanisms through which abstract religious themes and imagery come to be associated with specific policy aims, or what Robert Bellah called “national goals.” This article argues that a renewed focus on the relationship between civil religion and organized religion can help fill this gap in the literature. This presentation will elaborate how tribal community leaders originally envisioned utilizing gaming revenues to fund cultural investments such as language retention or elders’ programs, and whether they and their fellow community members assigned cultural investments a greater value than economic investments (e.g., infrastructure such as paved roads). The Kingdom of Hawai’i was annexed by the United States of America in 1898 and was given statehood in 1959. Prior to its annexation, the Kingdom of Hawai’i had a legitimate functioning government with sovereign recognition from many in the international arena, including the United States, as early as 1840. This article analyzes current and past definitions of the state and sovereignty, as well as precedence from international law, to determine if the United States violated the sovereignty of the Kingdom of Hawai’i before and during the annexation process. Louisiana developed an extensive system of levees throughout the Atchafalaya Basin and along its territorial Mississippi River. This system reached its zenith on the eve of the American Civil War. It went into dramatic decline following the conflict due to the confluence of military activity, protracted irregular warfare, and neglect stemming from labor and capital revolution. These shifts intensified with the 1863 Emancipation Proclamation and finally consolidated after the ratification of Louisiana’s Constitution of 1879.
