Part I of this article discusses the principle that mistake or ignorance of the law is no excuse. It is settled law that no one can defend against a criminal charge on the grounds that he did not intend to flout the law and, at worst, made only a reasonable, honest mistake as to what he was free to do. Part II examines several areas in which the law does precisely the opposite by repeatedly manifesting a willingness to forgive reasonable mistakes by one or more actors in the criminal justice system. For Want Of A Credible Voter Registry: Do Problems In Voter Registration Increase The Likelihood Of Electoral Violence?, Michael R. Snyder

In the wake of deadly 2007-2008 elections in Kenya, the topic of electoral violence is attracting increasing international attention. One study theorizes that norms of electoral integrity play a critical role in determining outbreaks of violence during the election cycle. Using statistical analysis of data based on international election observer reports, this paper acquires a greater understanding of which violations of electoral integrity, such as vote fraud or restrictions on media, are associated with increases in electoral violence. The preliminary findings indicate that the hypothesized variables of voter intimidation and vote fraud are associated with electoral violence, but more surprising …

Infinite Money And Infrastructural Power: Analyzing The Fiscal Determinants Of English State Building, 1689–1789, John Louis

Geographically limited with a small population and few resources, how did England achieve great power status by the close of the 18th century? Scholars have debated whether debt or taxes were the primary determinants of English state building. Using data from the European State Finance database this paper provides a systematic statistical study designed to disentangle the causal relationship between war, debt and taxes as determinants of English state building. The paper finds that debt not taxes best predicts English military expenditures. After demonstrating that war exhibits a strong positive correlation to increases in public debt the paper shows that …

This paper draws on the recently published reports by The Constitution Project’s Task Force on Detainee Treatment and the Open Society Justice Initiative to explore the issue of human rights violations committed by the United States and its partners via the extraordinary rendition program. It focuses on two specific human rights violations, torture and refoulement, and the legal obligations these violations trigger. It examines the obligation to compensate victims specifically and reviews how former detainees have exercised their rights to reparation. Tag, You’Re It: Enhancing Access To Graphic Novels, Wendy L. West

Current users of academic libraries are avid readers of graphic novels. These thought-provoking materials are used for leisure reading, in instruction, and for research purposes. Libraries need to take care in providing access to these resources. This study analyzed the cataloging practices and social tagging of a specific list of graphic novel titles in the academic libraries of the Association of Research Libraries (ARL). Results found that of the 668 graphic novel records 68 (10.17 percent) used the genre heading “graphic novel” and 99 (14.8 percent) were tagged. The International Confederation of Free Trade Unions (ICFTU) emerged from the World Federation of Trade Unions (WFTU) in 1949 after Western trade union affiliates in the latter organization expressed major policy differences over the Marshall Plan. For its first 20 years, the ICFTU refused all forms of collaboration with the WFTU, contending that the Federation advocated a politically monolithic Communism with its primary function being the promotion of Soviet policy. The ICF-TU's position was disingenuous, given the WFTU's polycentric nature encompassing variants of Communist theory and practice dating back at least to October 1965. An Exploration Of The Impact That Postmodernism Has On Competition In Sport, Shara Crow

The purpose of this study is to explore the impact that postmodernism has on competition in sport. Previous studies compartmentalized social thought and competition in sport. This study appreciates that the two are connected, and it is through this connectedness that the impact emerges. By describing, finding, and analyzing relationships through text as well as notating text iteratively, it was found through a postmodernist critical awareness to meta-narratives that sport is expressed in two main themes: (a) identity (b) and hierarchy/authority. We analyze forecasts concerning China’s growth slow-down and future prospects concerning its economic performance. Extending the discussion on China’s possibility of going through a slow-down in future, we focus on the avoidance of such a possibility by drawing forth the role of gross capital formation, trade openness, higher education enrollment ratio, higher education expenditure, R&D expenditure, population growth and number of inventions in determining per capita income. Purpose—This study examined how race-ethnicity, nativity, and education interact to influence disparities in cardiovascular (CV) health, a new concept defined by the American Heart Association (AHA). We assessed whether race-ethnicity and nativity disparities in CV health vary by education, and whether the foreign-born differ in CV health from their US-born race-ethnic counterparts with comparable education.

Methods—We used data from the 2009 California Health Interview Survey to determine the prevalence of optimal CV health metrics (based on selected AHA guidelines) among adults ages 25 and over (n = 42,014). We examined the interaction between education and ethnicity-nativity, comparing predicted …

The integration of the Utah State University Press and USU Libraries enhanced access to scholarly materials in a variety of ways. The press utilizes USU’s institutional repository, the Digital Commons, to facilitate the open access distribution of its works subsequent to a 12-month embargo. Additionally, the collaborative environment created by shared space within the library fosters innovation. The library benefits from the extensive knowledge of the press and applies it to its nascent library-based publishing efforts. Studies have identified perceived racism as one type of social stress that is believed to contribute to hypertension, though no studies to date have examined the relationship between perceived racism and blood pressure among foreign-born Mexicans living in the United States (U.S.). Walidah Imarisha led this Oregon Humanities sponsored Conversation Project program entitled, “Why Aren't There More Black People in Oregon? After a 2010 Association of Collegiate Schools of Planning (ACSP) conference bus erupted into chatter from a tour guide’s passing comment about a new ordinance allowing chickens into Minneapolis backyards, I wondered about the magnitude of the urban chicken movement. Legalizing urban chickens is, in fact, occurring more often. A Lexus-Nexus Power Search of the term ‘chicken ordinance’ does not even register a hit in 2000. Yet in 2010, 141 articles discussed potential changes to urban chicken ordinances. Such an explosion of national news coverage suggests urban chicken keeping reaches beyond Portland’s borders.

As Ireland and Spain transformed into immigration countries in the early 2000s, they attracted comparatively large immigrant populations, especially to their largest cities. Nonetheless, the immigrant communities in Dublin and Madrid differ significantly in their composition, the reaction they have elicited from the host society, and their ability to incorporate in their new environment. This paper explores the factors that influence immigrant reception and integration in new immigration spaces like Dublin and Madrid.
