The purpose of this project is to argue that in order for social and emotional learning (SEL) goals to achieve their intended outcomes for students and society, religious pluralism must be reflected in student instruction. SEL involves the use of evidence-based practices to provide opportunities to develop competencies related to self-awareness, self-management, social awareness, relationship skills, and responsible decision making which are intended to enable students to demonstrate morally appropriate actions and ethical decisions, which I am calling "right behavior."

Processes Underlying Syntactic Control: Evaluating Linguistically Diverse Children, Vanessa R. Raschke

The current study focused on the mechanisms involved in syntactic awareness development in monolingual and bilingual (English/Spanish-speaking) nine-year-olds. Inclusion of child language brokers (those who translate and interpret for non-English speaking family members) diversified the definition of "bilingual." Previous research has shown bilingual advantages in areas of metalinguistic awareness and executive function (e.g., Bialystok, 2010; Davidson, Raschke, & Pervez, 2010), however, child language brokers have not been distinguished in these studies. These children, due to early language-switching and translation duties, may have differential development of areas of inhibition, cognitive flexibility, and working memory, areas suspected to aid in metalinguistic awareness …

The purpose of this phenomenological study was to explore how young Arab Muslim women attending college, in the United States and France, negotiate their identity vis-à-vis multiple contexts of citizenship in secular state, gender, religion, culture, and race. Sixteen interviews were conducted, eight in Paris and eight in Chicago. Using the theoretical frameworks of social identity, cultural studies, and critical race feminism, this study approached identity negotiation in terms of integration and differentiation from others; influence of dominant culture and attempt to redefine identity; gender and specificity of the experience of women of color as well as interrelation of multiple …

Committee Jurisdiction, Congressional Behavior And Policy Outcomes, John M. De Figueiredo

The literature on congressional committees has largely overlooked the impact of jurisdictional fights on policy proposals and outcomes. This paper develops a theory of how legislators balance the benefits of expanded committee jurisdiction against preferred policy outcomes. It shows why a) senior members and young members in safe districts are most likely to challenge a committee’s jurisdiction; b) policy proposals may be initiated off the proposer’s ideal point in order to obtain jurisdiction; c) policy outcomes will generally be more moderate with jurisdictional fights than without these turf wars. Federal appellate judges no longer have the time to hear argument and draft opinions in all of their cases. The average annual filing per active judgeship now stands at 330 filed cases per year — more than four times what it was sixty years ago. In response, judges have adopted case management strategies that effectively involve spending significantly less time on certain classes of cases than on others. Various scholars have decried this state of affairs, suggesting that the courts have created a “bifurcated” system of justice with “separate and unequal tracks.” These reformers propose altering the relevant constraints of …

Roe v. Wade grounds constitutional protections for women’s decision whether to end a pregnancy in the Due Process Clauses. But in the four decades since Roe, the U.S. Supreme Court has come to recognize the abortion right as an equality right as well as a liberty right. In this Essay, we describe some distinctive features of equality arguments for abortion rights. We then show how, over time, the Court and individual Justices have begun to employ equality arguments in analyzing the constitutionality of abortion restrictions. The Pigou-Dalton Principle And The Structure Of Distributive Justice, Matthew D. Adler

The Pigou-Dalton (PD) principle recommends a non-leaky, non-rank-switching transfer of goods from someone with more goods to someone with less. This Article defends the PD principle as an aspect of distributive justice --- enabling the comparison of two distributions, neither completely equal, as more or less just. It shows how the PD principle flows from a particular view, adumbrated by Thomas Nagel, about the grounding of distributive justice in individuals' "claims." And it criticizes two competing frameworks for thinking about justice that less clearly support the principle: the veil-of-ignorance framework, and Larry Temkin's proposal that fairer distributions are those concerning …

Unlike many other areas of regulation, financial regulation operates in the context of a complex interdependent system. The interconnections among firms, markets, and legal rules have implications for financial regulatory policy, especially the choice between ex ante regulation aimed at preventing financial failure and ex post regulation aimed at responding to that failure. Regulatory theory has paid relatively little attention to this distinction. Were regulation to consist solely of duty-imposing norms, such neglect might be defensible. In the context of a system, however, regulation can also take the form of interventions aimed at mitigating the potentially systemic consequences of a …

The way economists and other social scientists model how people make interdependent decisions is through the theory of games. Psychologists and behavioral economists, however, have established many deviations from the predictions of game theory. In response to these findings, a broad movement has arisen to salvage the core of game theory. Extant models of interdependent decision-making try to improve their explanatory domain by adding some corrective terms or limits. We will make the argument that this approach is misguided. How transparent is the international investment law regime, and how transparent should it be? Most studies approach these questions from one of two competing premises. One camp maintains that the existing regime is opaque and should be made completely transparent; the other finds the regime sufficiently transparent and worries that any further transparency reforms would undermine the regime’s essential functioning. This paper explores the tenability of these two positions by plumbing the precise contours of transparency as an overarching norm within international investment law. Sovereign debt crises occur regularly and often violently. Yet there is no legally and politically recognized procedure for restructuring the debt of bankrupt sovereigns. Procedures of this type have been periodically debated, but so far been rejected, for two main reasons. First, countries have been reluctant to give up power to supranational rules or institutions, and creditors and debtors have felt that there were sufficient instruments for addressing debt crises at hoc. Second, fears that making debt easier to restructure would raise the costs and reduce the amounts of sovereign borrowing in many countries. This was perceived to be against …

Gaming Direct Democracy: How Voters’ Views Of Job Performance Interact With Elite Endorsements Of Ballot Measures, Craig M. Burnett, Mathew D. Mccubbins

Voters are thought to rely on elite endorsements in helping them make decisions. Their ability to use these endorsements is especially important in direct democracy, since ballot measures are complex policy proposals that lack partisan cues printed on the ballot. Using an exit survey, we look at California Governor Arnold Schwarzenegger’s endorsement of four Indian gaming measures on the ballot during the presidential primary election of 2008. We find that voters who had knowledge of the elite endorsement differed little from those who did not. We show, however, that Schwarzenegger’s endorsement was conditionally related to support for the measures, depending …

The time is long overdue to acknowledge that global climate and resource stresses, encompassed by the concept of environmental security (ES), are an increasingly important part of "homeland" security (HS) study and practice, by even the most restricted definitions of HS. Environmental security issues will affect global economic and political stability, US national interests, and the risk of war and terrorism. Just as homeland security encompasses many complex issues and interconnected subfields, environmental security (ES) is interdisciplinary by nature.
