The Dark Side Of The Band Of Brothers: Explaining Unit Participation In War Crimes, Christi L. Siver

On July 25, 1950, an American infantry unit killed a large number of refugees near the South Korean village of No Gun Ri. On December 12, 1948, a British patrol killed twenty-five civilians near the Malayan village of Batang Kali. On March 16, 1993, members of the Canadian Airborne Regiment beat a Somali teenager to death. While each of these events is horrific, they also represent only one side of the story; many units in these conflicts, facing similar threats, did not kill civilians. Transcribing Refugees: The Entextualization Of Asylum Seekers' Hearings In A Transidiomatic Environment, Marco Jacquemet

This article explores the link between asylum seekers’ verbal performances and their transidiomatic entextualization by documenting the procedure through which asylum seekers’ claims are examined by judicial authorities and translated into a public record. Every year thousands of displaced people seek the protection of various European states by filing political asylum claims which are examined by national commissions. In their depositions, asylum seekers are interviewed by immigration o‰cials for approximately an hour. After this interview they are presented with a judgment: a short text that summarizes their story and spells out the commission’s decision on the case. The claim of …

The Link Between The Marital Bond And Future Triadic Family Interactions, Eve-Anne M. Doohan, Sybil Carrère, Chelsea Siler, Cheryl Beardslee

This study examined how the marital bond, as indexed through the Oral History Interview (OHI), is related to future triadic family interactions. Families (N = 108), with a 7 – 9 year old child, participated in a longitudinal study (the Family Health Project) examining children’s emotional development throughout the transition to adolescence. Parental cohesion and family cohesion, warmth, structure, and problem solving were assessed via behavioral observation during family problem solving discussions and parent-child teaching interactions 18 – 24 months after the OHI. Results indicated that the marital bond was predictive of parental cohesion, family cohesion, warmth, and structure during …

Many scholars claim that the current generation of college students tend toward disengagement from political activism. While the explanations focus on macro-level processes, they can be used to make predictions about variations in individual level political engagement. To test these explanations I surveyed by email a simple random sample of four hundred students enrolled at a small Midwestern College in the fall of 2009. My objective was to answer the question: what distinguishes students that become engaged in political advocacy from the counterpart who do not? Analyzing my results through logistic regression generated three significant empirical findings. Students who are …

Reconciling Findings Of Emotion-Induced Memory Enhancement And Impairment Of Preceding Items, Marisa Knight, M Mather

A large body of work reveals that people remember emotionally arousing information better than neutral information. However, previous research reveals contradictory effects of emotional events on memory for neutral events that precede or follow them: in some studies emotionally arousing items impair memory for immediately preceding or following items and in others arousing items enhance memory for preceding items. By demonstrating both emotion-induced enhancement and impairment, Experiments 1 and 2 clarified the conditions under which these effects are likely to occur. Background—Earlier studies have established that a substantial percentage of variance in obesity-related phenotypes is explained by genetic components. However, only one study has used both virtual twins (VTs) and biological twins and was able to simultaneously estimate additive genetic, non-additive genetic, shared environmental and unshared environmental components in body mass index (BMI). Our current goal was to re-estimate four components of variance in BMI, applying a more rigorous model to biological and virtual multiples with additional data. Virtual multiples share the same family environment, offering unique opportunities to estimate common environmental influence on phenotypes that cannot be separated from …

This research analyzes the 11 national action plans that were adopted between June 2005 and October 2008 as a response to the United Nations Security Council's Resolution 1325. Resolution 1325, one of the most important UN resolutions within the field of peace and security, was adopted unanimously on 31 October 2000. The resolution highlights the consequences of violent conflict on women and girls and the important role of women in peacebuilding and post-conflict processes. A Decade Of Change In Sixth Amendment Confrontation Doctrine, Roger Kirst

The United States Supreme Court brought new prominence to Sixth Amendment confrontation doctrine in 2004 when it announced its testimonial interpretation in Crawford v. Washington. This essay describes how confrontation doctrine was changed in the last decade by Crawford and the Court’s subsequent decisions in Davis v. Washington and Giles v. California. It examines what the disagreements among the five opinions in Giles suggest about whether the Court will continue to rely so strongly on historical hearsay doctrine to interpret the Confrontation Clause. It discusses other confrontation issues the Supreme Court will face in future cases.

This essay traces the emergence of environmental considerations in U.S. water law, beginning with colonial America and proceeding through the Gilded Age of industrialization, the Progressive Era of wise use, the New Deal and the rise of the federal administrative state, and the modern environmental era. Early on, environmental challenges were addressed haphazardly. The federal government influenced water policy through navigational enhancements, reclamation works, and flood control, while state and local law governed water rights and public health issues. The 1970s brought uniform federal effluent limitations and protections for endangered species. The dawn of the twenty-first century increasingly sees collaborative …

Empirical Research On Consumer Arbitration: What The Data Reveals, Sarah R. Cole, Kristen M. Blankley

In 2007, Public Citizen, a “national, non-profit public interest organization,” issued a report entitled “The Arbitration Trap: How Credit Card Companies Ensnare Consumers,” concluding that the arbitration process routinely exploits consumers. Public Citizen drew this sweeping conclusion after analyzing approximately 34,000 points of data the National Arbitration Foundation (“NAF”) collected about its California arbitrations.

Unfortunately, Public Citizen’s analysis of the NAF data does not support its conclusions primarily because its conclusions cannot be extended beyond the set of cases the data contains, i.e., collection cases filed by creditors, including credit card companies, against consumers with outstanding balances on their accounts. …

A Longitudinal Investigation Of The Relationships Amongst Antibody Response To Influenza Vaccination, Affect, And Stress In The Elderly, Joanne Hash-Converse

We examined the cross-sectional and longitudinal relationships amongst affect, stress exposure, and antibody (Ab) response to influenza inoculation in a healthy, elderly sample. We explored both efferent (CNS on immune activity) and afferent (immune activity on CNS function) pathways. Negative (NA) and positive (PA) affective states were examined in relation to Ab response, positing that high baseline NA (State, SNA, but not Trait, TNA) would predict reduced Ab response and that PA would predict enhanced response, and that the reduced Ab response in individuals displaying high baseline SNA would associate with decreases in NA. When the House tried to pass the $700 billion bank bailout, the first version of the bill failed while a week later the second version passed with 58 members of the House switching their votes in favor of the second version. This paper explains how Congressional leadership ensured the second bill's passage. With the Hixon- Marshall model on using side issues to manipulate the dimensions of legislative choice, I find that by amending the first bill with a variety of tax extenders, mental health parity, disaster relief and the alternative minimum tax patch, leaders in the House could attract enough …

Most studies examining predictors of treatment outcomes among problem drinkers have used a traditional statistical approach that examines group outcomes (e.g. analysis of variance, multiple regression analysis). Contrary to traditional methods, a person-centered approach identifies commonalities among clusters of individuals and provides the opportunity to examine the relationship between multiple individual differences and outcomes in a longitudinal manner. Specifically, the person-centered approach makes it possible to cluster individuals into subgroups based on their change patterns, and to examine the relationship between those subgroups and other variables of interest (e.g., drinking problem severity). This report is the second volume in a two volume set (see Jackson et al. 2004) detailing the archeological work conducted at site 41NU2 over several years. This volume focuses on the results of construction monitoring associated with road improvements to Spur 3, in Corpus Christi. The work was conducted under Texas Antiquities Committee Permit Number 2445, originally issued to Dr. Robert Hard, who served as the Principal Investigator during the early phases of the project. In 2001, the permit was transferred to Dr. Raymond P. Mauldin, who served as the Principal Investigator the remainder of the project.

This report concerns the documentation of unassociated Native American Graves Protection and Repatriation Act (NAGPRA) funerary objects from prehistoric sites at several man-made reservoirs operated by the U.S. Army Corps of Engineers, Fort Worth District (COE) in northeastern Texas: Lake Wright Patman, Lake O’ the Pines, and Lake Sam Rayburn in the Sulphur River, Big Cypress Creek, and Angelina River basins, respectively. These NAGPRA materials are presently held at the Texas Archeological Research Laboratory at The University of Texas at Austin (TARL).

The National Forests and Grasslands (U.S.D.A. Forest Service) in Texas (NFGT) conducted Passports in Time (PIT) projects in 2006 and 2007 on Hickory Creek in the Davy Crockett National Forest, Houston County, Texas. The work—varying in extent—took place at four prehistoric archeological sites: 41HO13, HC-1, Hickory Creek #2 (HC-2), and HC-3, with the majority of the work occurring at HC-2.
