Jarkesy invalidated the SEC’s mechanism for adjudicating fraud claims seeking civil penalties on the ground that the adjudications violated the Seventh Amendment. Background
Nothing causes more anguish and frustration than downward social mobility such as that experienced by less-educated workers and especially by displaced workers. Those who lose economic status lose more than income because they become so socially isolated that they are further frustrated through loneliness (Case and Deaton 2020). Hanna Arendt points out that lonely men are susceptible to authoritarian influence (1973, p. 475).

The Challenges Of Decoding Russian Coercion, Cynthia A. Roberts

This review essay critically examines cultural explanations of deterrence and coercion, focusing on Dmitry Adamsky’s The Russian Way of Deterrence as the most important recent effort to explain Russian strategic behavior through the lens of strategic culture. While recognizing the book’s considerable strengths in describing Russian concepts, terminology, and practices of deterrence and coercion, the essay questions how much explanatory leverage culture actually provides. It argues that cultural approaches risk over-complexifying the Russian case while under-specifying causal relationships, and asks why distinctive strategic cultures do not produce greater variation in coercive behavior and outcomes. The Indian River Lagoon (IRL) is an important estuary along Florida’s east coast. It is known for its ongoing water quality issues attributed to human activity in the watershed, which has resulted in extensive restoration and conservation efforts. This study researches the relationship between public perception and sentiment toward sustainable development initiatives and how they influence conservation and restoration in the Indian River Lagoon watershed. Twelve semi-structured interviews were conducted with IRL experts who work in the government, academia, nonprofit, or nongovernmental sectors to discuss public sentiment and engagement practices within the watershed. งานวิจัยชิ้นนี้ต้องการศึกษาพลวัตการใช้สิทธิการป้องกันตนเองร่วมของญี่ปุ่นในสมัยนายกรัฐมนตรีชินโซ อาเบะ โดยศึกษาผ่านมุมมองการกระจายความเสี่ยง (Hedging) ตามทัศนะของ Kuik (2008) เพื่อตอบคำถามที่ว่า ญี่ปุ่นใช้สิทธิการป้องกันตนเองร่วมในยุทธศาสตร์อินโด-แปซิฟิกอย่างไร โดยเสนอว่า สิทธิการป้องกันตนเองร่วมดำเนินพลวัตเป็นตัวสนับสนุนอยู่เบื้องหลังการเป็นผู้สร้างสันติภาพเชิงรุกในเวทีโลก เราจึงได้เห็นญี่ปุ่นรุกเข้าเสริมสร้างระบบพันธมิตรเดิมอย่างสหรัฐอเมริกา ขณะเดียวกันยังขยับขยายไปสู่พันธมิตรใหม่ ๆ เพื่อสร้างเป็นเครือข่ายทางความมั่นคงซึ่งจะประโยชน์ต่อการป้องกันประเทศญี่ปุ่นในอนาคต จากการศึกษาพบว่านายกรัฐมนตรีชินโซ อาเบะให้เหตุผลการยอมรับสิทธิการป้องกันตนเองร่วม (collective self-defense: CSD) ว่า ภัยคุกคามต่อญี่ปุ่นกำลังทวีความรุนแรงรอบด้าน ทั้งการสั่งสมขีปนาวุธจากเกาหลีเหนือ ข้อพิพาททางดินแดน รวมไปถึงการขยายอิทธิพลของจีนที่อาจเข้าแทนที่สหรัฐอเมริกาในภูมิภาค หากสถานะเดิม (status quo) เปลี่ยนไป ญี่ปุ่นภายใต้รัฐธรรมนูญสันติภาพจะไม่อาจต่อสู้ได้เพียงลำพัง งานวิจัยชิ้นนี้ยังชี้ให้เห็นว่า พลวัตนี้ไม่ได้หยุดนิ่ง หากแต่มีความเปลี่ยนแปลงในแนวทางและจุดมุ่งหมายของการเข้าหาพันธมิตรนับตั้งแต่การยอมรับให้ใช้สิทธิดังกล่าวได้ในปี 2014 ไปจนถึงการลงจากอำนาจของชินโซ อาเบะ ในปี 2020

หลังนางไช่อิงเหวินชนะการเลือกตั้งประธานาธิบดีไต้หวันในปี ค.ศ.2016 จีนกลับมาเพ่งเล็งการดำเนินนโยบายของไต้หวัน และใช้ท่าทีที่แข็งกร้าวต่าง ๆ ต่อไต้หวันส่งผลให้ความสัมพันธ์ข้ามช่องแคบระหว่างไต้หวันและจีนกลับมาตึงเครียดอีกครั้ง ไต้หวันต้องดำเนินนโยบายต่าง ๆ เพื่อรับมือกับท่าทีอันแข็งกร้าวของจีนมาตลอดห้วงเวลา 8 ปีในตำแหน่งของเธอ แต่ยังสามารถรักษาสถานะเดิม (status quo) เอาไว้ได้ สารนิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาเกี่ยวกับมาตรการของไต้หวันในการรับมือความแข็งกร้าวของจีน ในช่วงระหว่าง ปี ค.ศ.2016 – 2024 มีแนวทางการดำเนินนโยบายอย่างไรในการ “รับมือ” ท่าทีแข็งกร้าวของจีน จนสามารถสามารถรักษาสถานะเดิมเอาไว้ได้ตามความมุ่งหมายซึ่งผลการศึกษาพบว่าไต้หวันรับมือความแข็งกร้าวของจีนโดยการการถ่วงดุลอำนาจจากภายนอกด้วยการแสวงหาขีดความสามารถเพิ่มจาก“ชาติที่มีอุดมการณ์เดียวกัน” (like-minded nations) เพื่อให้จีนเกิดความยับยั้งชั่งใจหรือต้องคิดคำนวนความคุ้มค่าในการใช้กำลังต่อไต้หวันเพิ่มขึ้นอันเป็นไปตามแนวคิดการป้องปรามโดยการปฏิเสธ

อินเดียเผชิญกับความท้าทายเกี่ยวกับปัญหาการก่อการร้ายข้ามพรมแดนจากปากีสถาน ความท้าทายดังกล่าวสั่นคลอนความมั่นคงแห่งชาติของอินเดีย และเสถียรภาพภายในภูมิภาค เอเชียใต้ ประวัติศาสตร์ของความท้าทายนี้เกิดขึ้นตั้งแต่ปี ค.ศ. 1947 เมื่ออนุทวีปอินเดีย แบ่งแยกออกเป็นสองประเทศ คือ อินเดียกับปากีสถาน ภาวะตึงเครียดระหว่างทั้งสองทำให้มี กลุ่มก่อการร้ายข้ามพรมแดนเข้ามาโจมตีอินเดีย การกระทำของกลุ่มก่อการร้ายดังกล่าวรวมถึง การโจมตีรัฐสภาอินเดียในปี ค.ศ. 2001 และการโจมตีนครมุมไบในปี ค.ศ. 2008 การโจมตีจาก กลุ่มก่อการร้ายเหล่านี้ทำให้อินเดียต้องปรับวิถีด้านความมั่นคง โดยเฉพาะการเสริมสร้าง ขีดความสามารถการจัดการปัญหาการก่อการร้าย การพัฒนาขีดความสามารถด้านข่าวกรอง การพัฒนาความสามารถทางการทหาร การพัฒนาการรักษาความมั่นคงชายแดน และการเปิดปฏิบัติการโจมตีฐานที่มั่นของกลุ่มก่อการร้ายสำคัญ นอกจากนี้ ยังปรากฏอย่างชัดเจนด้วยว่า อินเดียใช้เวทีระหว่างประเทศในการจัดการเครือข่ายกลุ่มก่อการร้ายดังกล่าว โดยพยายาม สร้างพันธมิตรกับประเทศต่าง ๆ เช่น สหรัฐอเมริกา และใช้กรอบความร่วมมือระหว่างประเทศ ทั้งระดับทวิภาคีและพหุภาคี ตัวอย่างที่ชัดเจนอันเป็นผลมาจากความร่วมมือระหว่างประเทศ เพื่อจัดการการก่อการร้ายข้ามพรมแดนข้างต้น คือ การแบ่งปันข้อมูลข่าวกรอง การฝึกร่วม ทางการทหาร และการต่อต้านการสนับสนุนทางการเงินแก่การก่อการร้าย ความพยายามทั้งหมด ที่กล่าวมา สะท้อนให้เห็นว่า นอกจากการก่อการร้ายลักษณะดังกล่าวจะมีความซับซ้อนแล้ว ยังจำเป็นต้องพึ่งพาความร่วมมือกับนานาประเทศ เพื่อให้อินเดียตอบโต้กลุ่มก่อการร้าย ข้ามพรมแดนจากปากีสถานได้อย่างมีประสิทธิผล

สารนิพนธ์นี้มุ่งศึกษาถึงบทบาทของกรมความร่วมมือระหว่างประเทศในการส่งเสริมการดำเนินงานด้านการทูตเพื่อการพัฒนา ซึ่งสะท้อนให้เห็นถึงความเปลี่ยนแปลงทางยุทธศาสตร์ด้านการต่างประเทศในยุคโลภาภิวัตน์ ผ่านเครื่องมือสำคัญอย่าง การทูตเพื่อการพัฒนา (Development Diplomacy) ที่จะนำมาใช้ในการดำเนินความสัมพันธ์ทางการทูตผ่านรูปแบบการทูตสาธารณะ (Public Diplomacy) เพื่อเสริมสร้างความร่วมมือระหว่างภาครัฐ ภาคเอกชน และภาคประชาชน ซึ่งจะช่วยสร้างภาพลักษณ์และส่งเสริมความสัมพันธ์ระหว่างประเทศของไทย และสนับสนุนการบรรลุเป้าหมายการพัฒนาที่ยั่งยืน (Sustainable Development Goals : SDGs) ขององค์การสหประชาชาติ สารนิพนธ์ฉบับนี้จะอธิบายถึงความสำคัญเพื่อสร้างความเข้าใจของหลักการดำเนินงานด้านการทูตเพื่อการพัฒนาของกรมความร่วมมือระหว่างประเทศ ที่เริ่มต้นจากการเป็นประเทศรับความช่วยเหลือ (Recipient Country)ผ่านหน่วยงานอย่างกรมวิเทศสหการ จนสามารถปรับเปลี่ยนบริบทตนเองมาสู่การเป็นประเทศผู้ให้ความช่วยเหลือ (Donor Country) และยกระดับตนเองผ่านการนำประสบการณ์และความเชี่ยวชาญที่มีของประเทศไทยส่งเสริมให้มีบทบาทในเวทีนานาชาติโดยการให้ความช่วยเหลือแก่ประเทศต่างๆ ผ่านรูปแบบความร่วมมือแบบ ใต้-ใต้ (South – South Cooperation) โดยมุ่งเน้นที่กลุ่มประเทศเพื่อนบ้านอย่าง CLMV และขยายขอบเขตความร่วมมือออกไปยังประเทศอื่นๆในภูมิภาค ตลอดจนการนำองค์ความรู้ที่เป็น Home Growth Approach ของไทยอย่างการนำหลักปรัชญาของเศรษฐกิจพอเพียงในการส่งเสริมการบรรลุเป้าหมายการพัฒนาที่ยั่งยืนขององค์การสหประชาชาติ (SEP for SDGs)

สารนิพนธ์ฉบับนี้มีวัตถุประสงค์เพื่อศึกษาการจัดการผู้หนีภัยการสู้รบชาวเมียนมาของกองทัพบกในห้วงระหว่างปี ค.ศ.1998 ถึง 2019 ในการศึกษาครั้งนี้ มุ่งศึกษาและวิเคราะห์นโยบายของผู้หนีภัยการสู้รบภายใต้ความตึงเครียดระหว่างการให้ความคุ้มครองผู้หนีภัยการสู้รบชาวเมียนมาตามหลักสิทธิมนุษยชนกับการรักษาความมั่นคงและผลประโยชน์แห่งชาติ โดยพิจารณาในมุมมองของกองทัพบกไทยซึ่งทำหน้าที่ควบคุมดูแล จัดระเบียบ รักษาความปลอดภัย ให้ความช่วยเหลือขั้นพื้นฐาน ตลอดจนประสานความร่วมมือทุกภาคส่วนที่เกี่ยวข้องกับการดำเนินการต่อผู้หนีภัยการสู้รบชาวเมียนมา เพื่อทำความเข้าใจถึงการเปลี่ยนแปลงในนโยบายและแนวทางการบริหารจัดการในห้วงระหว่างปี ค.ศ.1998 ถึง 2019 โดยวิเคราะห์ข้อมูลจากปัจจัยต่าง ๆ ที่ส่งผลต่อความสามารถในการจัดการผู้หนีภัยการสู้รบชาวเมียนมาของกองทัพบก ตลอดจนวิเคราะห์ผลกระทบ และข้อเสนอแนะเชิงนโยบายเพื่อแก้ปัญหาอย่างยั่งยืน

Occasional Papers on Religion in Eastern Europe
This article explores the use of religious symbolism in the populist rhetoric of Poland's Law and Justice (PiS) party and Hungary's Fidesz party. Both parties leverage historical and cultural narratives emphasizing Christianity's role in their national identities to legitimize their political agendas and mobilize support. The study examines how these populist leaders incorporate religious imagery and language to create a moral dichotomy between the “righteous people” and the “corrupt elite,” thereby deepening societal divisions and undermining democratic governance. The study sought to ascertain whether introducing democracy has adversely impacted Indigenous cultural practices in Ghana or whether the path to democracy has enhanced, shaped, or strengthened aspects of the country’s Indigenous culture. The study sheds some light on the realistic, symbolic, and pervasive threat(s) that transitional or Indigenous societies like Ghana undergoing the process of democratization face and must deal with. Institutionalising parliamentary opposition ensures political pluralism, and an opposition needs constitutional protections to enable it to demand accountability and seek scrutiny over the executive. How did the Constituent Assembly of India envision the idea of parliamentary opposition? Did it take the issue seriously? Or, overshadowed by the burgeoning dominance of the Congress Party, was it apprehensive about providing constitutional space for the opposition? Some members of the assembly did demand that an institutional space be created to guarantee an effective opposition. But these demands were not given serious attention in the assembly. A response to recent cultural trends of radicalization, extremism, and violence in American society, this dissertation, a novel rendered in ephemeral fragments of oral histories, interrogates the romanticist postures that compel a community of musical artists, the so-called “Folk Revival Revival,” toward infamy and tragedy. Where more traditional sociological approaches to cultic formations stress the importance of centralized charismatic authority, and more traditional psychological approaches rely upon a conspiratorial Cold War ethos of cognitive bias and coercive control (i.e. “brainwashing”), this project meets such assumptions with incredulity, asserting instead that cultic and conspiratorial entrancement awakens first from within, and may …

This thesis examines the linguistic accessibility of voting from multiple perspectives through the analysis of federal and state level electoral legislation in conjunction with language access services available in Iowa and Michigan. Does the partisan composition of three-judge panels affect how earlier opinions are treated and thus how the law develops? Using a novel data set of Shepard's treatments for all cases decided in the U.S. courts of appeals from 1974 to 2017, we investigate three different versions of this question. First, are panels composed of three Democratic (Republican) appointees more likely to follow opinions decided by panels of three Democratic (Republican) appointees than are panels composed of three Republican (Democratic) appointees? My dissertation is a collection of three essays that assess the nature of government attention in young democracies. Theories of the policy process focus on policy dynamics in Western democracies with little application to non-Western democracies. This dissertation bridges this gap by studying policy dynamics in the neopatrimonial democracies of Ghana and South Africa. The dissertation sheds light on how the unique features of young democracies (centralization, clientelism, and powerful executives) shape government attention, responsiveness to public opinion, and the importance of elections in policy change. This study discusses the origins and development of the South China Sea dispute. It briefly analyzes the overlapping maritime claims, their justifications and legal aspects, and key clashes between the actors across the second half of the 20th century. It uses a historical perspective to assess the present-day conflict. The study discusses the impact of international agreements, national policies, claimants' domestic factors, and external influences connected to the geopolitical situation of the period to determine how they influenced the dispute. This dissertation explores the foreign policy implications of the post-2010 resurgence of nationalism in the U.S., Europe, and other parts of the world. It explores the reorientation of foreign policy away from globalization and the post-Cold War expectations that include a rules-based order, the spread of democracy and human rights, and the free movement of capital, products, people, and information. Instead, the emerging nationalist foreign policies emphasize independence and national sovereignty, economic self-sufficiency and protectionism, and anti-democracy and universal values. This short essay provides an introduction to the Lewis & Clark Law Review's "Law vs. Antisemitism" symposium, which grew out of the conference by the same name hosted at Lewis & Clark in the spring of 2023. In addition to overviewing the contributions to the symposium, the introduction provides some background on the relative paucity of legal scholarship that has addressed antisemitism, and the importance of including antisemitism in the otherwise robust legal academic conversation occurring around other forms of oppression and social discrimination.

This thesis explores the interconnected issues of violence against women, patriarchy, and criminalization to understand the 1994 Violence Against Women Act and the factors that shaped it. Using Johns Kingond’s multiple streams framework, this paper investigates how the Act was constructed by the battered women’s movement and the United States’ shift towards tough-on-crime policies. Ultimately, this paper seeks to understand how the issue of domestic violence became rooted in criminalization and if that framework has helped deter violence against women in the United States or if it caused more problems than it solved.

Hollywood has painted a picture of the criminal woman as a sexy, sneaky, and often psychotic female fatale. This is because men run Hollywood. Much like movies, research on why women offend had historically focused on men as their stellar. However, towards the turn of the century and with the disproportionate rise in female incarceration, literature caught up to the fact that women and men do not experience the same socialization, standards, or reality and, therefore, have different reasons for and ways of offending. This thesis examines the economic reforms undertaken by Poland and the Czech Republic during the 1990s transition period. It seeks to ultimately differentiate reform quality between the Czech Republic and Poland in terms of well-being. The basis of reform success is determined using a quality of life scale that spans economic, health, and environmental indicators. Reform quality is then assessed based on improvements in well-being, instead of high-level economic metrics that often evaluate in a manner that fails to capture individual citizen sentiment. This thesis situates state constitutionalism in the modern context of federal constitutional paralysis. By tracing patterns of state constitutional development, we find that states were always the fundamental setting of democracy, and there has always been critical action happening at state legislatures, in state courts, and through state constitutional change. State constitutions provide an active means to achieve progress and protect rights not federally enshrined (and thus, endangered by the political process). This thesis explores the feasibility of implementing a Drone as First Responder (DFR) program within the Los Angeles Police Department (LAPD), analyzing the operational, social, and financial implications compared to traditional police helicopter usage. The thesis investigates helicopter flight patterns, demographic correlations, and the potential for drones to provide a less invasive and more cost-effective aerial support system. During the Covid-19 pandemic, Germany and the U.S. operated with different levels of public trust and people placed their trust in different public institutions. My thesis examines how political tactics such as fear, use of science, and expert pronouncements impacted public trust and the COVID-19 response in both countries.
