Are Student Affairs Professionals “Educators?:” Student Affairs And The Scope Of The Educational Exemption Of Copyright Law, Dallas Long

Copyright is a critical, emerging issue in American higher education. Copyright restricts how educators use copyrighted materials in teaching activities. Although the fair use doctrine and the educational exemption in U.S. copyright law provide exceptions for educators, student affairs professionals might not meet the standards of the educational exemption. This paper serves as a primer on U.S. copyright law, the fair use doctrine, and the educational exemption. Analyses of case law suggest student affairs professionals should rely on the fair use doctrine rather than the educational exemption when using copyrighted materials for educational purposes.

In her exemplary book The Ethical Archivist, Elena S. Danielson devotes a chapter to professional ethics codes and points out that “[m]any informed observers do not feel that complying with the law has any place in a statement on ethics since laws enforce existing power relationships, which may be unfair.” (p.45) I will argue that including civil disobedience principles in ethics codes may be preferable to rejecting legal compliance as a consideration.

The purpose of this mixed method, pragmatic, research study was to determine, from successful African American college age students, what influences have contributed to their academic success. Quantitative data were collected using two survey instruments, the Religious Commitment Inventory (RCI-10) and a researcher created demographic instrument for data collection. Qualitative data were collected through five researcherconducted focus group discussions with 10 African American students enrolled in a four year university located in the southeast region of the United States. This narrative reflection presented vacillates between an exploration of the historical journey of the Black women and a modern day Black women who is “persisting in the journey toward self-definition…” (Collins, 2000, p. 121). This history eludes to the underrepresentation of Black women that originates in colleges and universities, which results in the underrepresentation in higher education administration. This narrative and interpretative review considers race and highlights factors and barriers that perpetuate the glass ceiling in higher education for Black women.

This article uses numeric and qualitative data to interrogate the impact of affirmative action policies on shattering glass ceilings and resolving impasse in the academic lives of African Americans. This work takes its trajectory from previous research on glass ceilings (Marina and Fonteneau, 2012). Two brief case studies from both PWIs and HBCUs are mentioned to ponder complex attitudes toward race, gender and power. In extracting meaning from the policies, practices, and cases, it became clear that attitudes toward power and authority are influenced by context, but even more, by an individual’s sense of right and wrong. While it is clear that gender inequity still exists, this situation is compounded by race, ethnicity and sexism. The daily experiences of women confirm that racism and sexism is alive and well. This article presents and examines the experiences of Latino, Black, Arab, and Asian professional women and the consequences of their career decisions. Synthesized with literature, conceptual patterns of significance are noted for young girls and women of color aspiring and pursuing professional careers in education. Based on data from a larger, longitudinal study of 22 women faculty on the tenure track, this qualitative study examines the socialization experiences of four women faculty of color (WFOC) who earned tenure at two public, research extensive, predominantly White institutions (PWIs) in the U.S. This study gives voice to WFOC who broke through the glass ceiling of tenure and were promoted to associate professor. Although these women earned tenure, their adjustment as newcomers to the academy was fraught with marginalization for being both women and persons of color. This study explored the complexities of African American women scholar-activists' lived experiences in predominately white institutions of higher education. Existing scholarship on African American women's experiences in the academy locates these academicians in predominately white research universities and liberal arts colleges (PWI's) as well as historically Black colleges and universities (HBCU's) and focuses on the tenure process, recruitment and retention, evaluation, student relationships, career satisfaction, mentoring, survival strategies, and administrative leadership. The following theoretical dissertation used an object relational approach to consider integrating the self and professional psychology training. Professional psychology training once valued the emerging and diverse experiences of the trainee's self. However, the recent shift to competency based education models in professional psychology has emphasized self-competency rather than the processes that foster the integration of trainees' emerging identities. Historically Black Colleges and Universities (HBCUs) have a list of outstanding accomplishments that span over a century; however, this segment of higher education continues to be underfunded and remains in a position of justifying its existence in a postracial America. The issues facing HBCUs are significant. Race-based legislation has created a dual system of American higher education that adversely affects these minority serving institutions, impacting the quality of education they dispense and producing potentially negative effects on vulnerable and under-served collegians. This dissertation study explores Tribal College and University (TCU) faculty collegiality utilizing qualitative and indigenous research methodology approaches. Since collegiality is a multidimensional construct, a Rolling Survey process was developed to provide a vehicle for discussion. Within focus group settings, TCU faculty participants created a composite about their relationships, communications, and professional development. Dialogue affirmed important professional relationships and explored issues that contribute or detract from TCU faculty work experiences. The results of this study further suggest wider applications for leadership and businesses in general, affirming the importance of and the need to support professional working relationships. The dissertation explores leadership and change by examining normlessness in the workplace through a multi-layered study of anomie theory, anomie research in the workplace, and organizational and business management theory. The research validates a quantitative survey designed to measure the level of normlessness experienced by workgroups within an organizational context. The survey reflects a set of six normative aspects that when disrupted produce organizational anomie—a state of normlessness that leads to an increase in worker resistance and a reduction in worker consent. Family Policies And Institutional Satisfaction: An Intersectional Analysis Of Tenure-Track Faculty, Heather Lee Schneller

Gender and faculty career advancement have been examined with a focus on academic work environment, including faculty workloads, mentoring relationships, access to research networks, and work-life balance. Previous studies concerned with gender, employment, and care work only have considered child care. Additionally, the exploration of faculty and care work focused specifically on gender instead of examining the interaction of race and gender. To date, no study on academic work-life policies includes faculty perceptions of their importance and effectiveness nor has the faculty assessment of eldercare policy been examined in relation to career success.

This presentation will illuminate the process of weaving together study skills, a common reading book and life on a college campus to design a cohesive first year seminar that facilitates student success.
