Vampires Anonymous And Critical Race Practice, Robert A. Williams Jr. Feb 1997

Vampires Anonymous And Critical Race Practice, Robert A. Williams Jr.

Michigan Law Review

I can only explain what Vampires Anonymous has done for me by telling my story. I know, stories, particularly autobiographical stories, are currently being dissed by some law professors. Raised in an overly obsessive, objectively neutralized cultural style, they are plain and simple Storyhaters. Their middle to upper class parents had money, a home in the burbs, and nice kids who were going to go on from their fancy grade schools and college preparatory gigs to Harvard/Stanford/Yale - all those types of pricey places where law professors usually come from. These kids were raised to be objective, neutral, neutered, fair, …

Nothing So Destructive As Habit, K.K. Duvivier

Sturm College of Law: Faculty Scholarship

As with physical exercise, inertia may prevent you from beginning. You complete your briefs, your clients pay the bills, and you win some of your cases. Doesn't this mean your writing is adequate? You already spend a lot of your time writing--why dedicate additional time to improve?

Many public libraries provide patrons with free public-access Internet terminals, largely for accessing information available on the World Wide Web. However, public concern exists over the ability of children who browse the Web without adult supervision to view sexually explicit materials and other inappropriate items. This concern has led to the development of various Internet filtering software programs. Some filtering programs operate by blocking access to documents containing certain words or phrases or combinations thereof. However, more common programs permit access only to documents or sites that appear in a pre-selected, "safe" database or that block access to documents that …

Of Painters, Sculptors, Quill Pens And Microscopes: Teaching Legal Writers In The Electronic Age, Lucia A. Silecchia Jan 1997

Of Painters, Sculptors, Quill Pens And Microscopes: Teaching Legal Writers In The Electronic Age, Lucia A. Silecchia

Scholarly Articles

No longer do lawyers write most of their work “by hand.” Instead, most legal writing is now done on word processors. This has the potential to change the way lawyers write in a fundamental way. Because word processors make it easier to write more than was possible “by hand” modern legal writers are more akin to sculptors than painters. Such writers must create finely-tuned written products from the large quantities of material that can now be inputted into a document and then edited and whittled away to create a finished product.

This Article examines how the arrival of the electronic …

Going To Trial: A Rare Throw Of The Die, Samuel R. Gross, Kent D. Syverud Jan 1997

Going To Trial: A Rare Throw Of The Die, Samuel R. Gross, Kent D. Syverud

Law Quadrangle (formerly Law Quad Notes)

Few of the suits that are filed continue to trial, but some plaintiffs and defendants find their interests served best by going to trial.

This essay is adapted from "Don’t Try: Civil Jury Verdicts in a System Geared to Settlement," appearing in 44 UCLA Law Review 1 (1996). Publication is by permission. A complete, fully cited version is available from the editor of Law Quadrangle Notes.

If it is true, as we often hear, that we are one of the most litigious societies on earth, it is because of our propensity to sue, not our affinity for trials. …

Eye On The World, Jose E. Alvarez, Virginia A. Gordan

Law Quadrangle (formerly Law Quad Notes)

In a special section coinciding with the International Reunion of Law School graduates, Law School graduates who are deeply involved in the globalization of legal practice respond to the question, "If you could leap ahead 10 years, how do you think what you are doing now will change?" And in a thought-provoking prologue, Professor of Law Jose Alvarez and Assistant Dean for International Programs Virginia A. Gordan consider the historical - and historic - impact of Law School graduates from overseas on the legal profession.

A New Nuremberg?, Jose E. Alvarez Jan 1997

A New Nuremberg?, Jose E. Alvarez

Law Quadrangle (formerly Law Quad Notes)

The following essay is based on presentations given recently at the University of Michigan, Harvard Law School and the Fletcher School of Law and Diplomacy. While most citations have been removed for publication here, the author gratefully acknowledges the work of Mark Osiel, whose article, "Ever Again: Legal Remembrance of Administrative Massacre," 144 University of Pennsylvania Law Review 463 (1995), inspired much of the analysis here

On May 25, 1993, acting under the same powers it had used to authorize the Gulf War, the United Nations Security Council established the first international war crimes tribunal since post World War II …

History Of The Court Reporter In The Appellate Courts Of Pennsylvania, Joel Fishman Jan 1997

History Of The Court Reporter In The Appellate Courts Of Pennsylvania, Joel Fishman

Law Faculty Publications

States have traditionally published the decisions of their intermediate and highest courts.1 Legal historians, in recent years, have written extensively on the history of court reporting and court reports.2 These historical accounts have revealed that many famous judges and lawyers throughout the country gained prominent reputations stemming from the publishing of their decisions.3 In the "nineteenth century, the development of court reports received attention from the legal community through reviews in many of the leading periodicals of the day."4 By 1900, however, the periodical literature contained only a small number of reviews of individual state reports. …

Catholic Faith And Legal Scholarship, Gerard V. Bradley Jan 1997

Catholic Faith And Legal Scholarship, Gerard V. Bradley

Journal Articles

The most obvious and the most personally important way in which scholarship reflects faith knows no distinction between Protestants and Catholics. For all of us who are Christians, the life of the scholar is our vocation, our contribution to the building of the Kingdom, our share in the church's mission. We did not just stumble upon this life of scholarship, or choose it because it is interesting, exciting, or fun (though sometimes it is). Rather, we discerned through prayerful reflection upon our gifts, our opportunities, and the needs of our communities that God called us to serve others by striving …
