From Judge To Justice: Social Background Theory And The Supreme Court, Tracey E. George
Vanderbilt Law School Faculty Publications
The Roberts Court Justices already have revealed many differences from one another, but they also share a (possibly) significant commonality: Presidents promoted all of them to the U.S. Supreme Court from the U.S. Courts of Appeals. This means, of course, that they initially learned how to be judges while serving on a circuit court. How might the Justices' common route to the Court affect their actions on it? Social background theory hypothesizes that prior experience influences subsequent behavior such as voting, opinion writing, and coalition formation. This Article empirically analyzes promotion to the Supreme Court and examines the implications of …
Exile: Why The Human Rights Council Will Not Work, Daniel J. Graeber
Exile: Why The Human Rights Council Will Not Work, Daniel J. Graeber
Human Rights & Human Welfare
The Economist writes in an April 24th edition that the U.N.’s Human Rights Council, the predecessor to the sixty-year-old U.N. Commission on Human Rights, is a “one-sided Israeli-bashing” organization. The Economist argues that the inclusion of second- and third-tier countries from the Organization of Islamic Conference (OIC) and the Non-Aligned Movement (NAM) makes it a forum for targeting offenses committed by the Israeli government against the Palestinian people.

A Case Analysis Of Explaining The Main Factors That Contribute To Rok's Decision Making In Procurement Of Defense Articles, Se Young Kim
Theses and Dissertations
The purpose of this research was to explore the various factors that contribute to ROK’s decision making in procurement of foreign countries defense articles. South Korea is one of the largest weapon purchasers from the U.S. and needs a more self-reliant defense force that can maintain its security with its own authority under the current cease-fire situation. Thus, this study focused on identifying the main factors to consider in deciding whether to purchase a major defense weapon system from other countries. Through the interview of experts who participated in specific weapon programs, thirteen specific factors were evaluated including Interoperability, Offset …

The Espionage Act And National Security Whistleblowing After Garcetti, Stephen I. Vladeck
American University Law Review
Should government employees ever have a right to disseminate classified national security information to the public? As a general matter, of course, the answer is "no." It is necessarily tautological that the central purpose of classifying information is to keep that information secret. But what if the information pertains to what we might describe as "unlawful secrets," and the individual in question has exhausted all possible non-public remedies - and to no avail? Are there any circumstances in which the law enables the government employee to come forward? Should there be? As this Essay suggests, because of the broad language …
