Public Use In A Post-Kelo World, Richard A. Epstein
Public Use In A Post-Kelo World, Richard A. Epstein
Coase-Sandor Institute for Law & Economics Research Paper Series
The aftermath of Kelo gives rise to urgent land use issues, both theoretical and historical. On the former, I argue that the analysts should be aware of the close and positive connection between restrictive land use policies on the one hand and a willingness to condemn parcels for private development on the other. The inability to overcome local opposition with private development forces developers to get in essence, pre-acquisition approval through public condemnation. One way, therefore, to ease the pressure on public use is to retreat from aggressive land use regulation to a scheme that more closely approximates that of …
The Uneasy Case For Transjurisdictional Adjudication, Jonathan Remy Nash
The Uneasy Case For Transjurisdictional Adjudication, Jonathan Remy Nash
Coase-Sandor Institute for Law & Economics Research Paper Series
Federal courts often decide cases that include matters of state law, while state courts often decide cases that raise matters of federal law. Most of these cases are decided within the court system in which they originate. Recent commentary advocates more transjurisdictional adjudication through the expanded use of existing procedural devices, and development of new devices. The Elder Economic Security Initiative™ Program: The Elder Economic Security Standard™ Index For Illinois, Laura Henze Russell, Ellen A. Bruce
Gerontology Institute Publications
This report will address the question of income adequacy for Illinois’ older adults using the national WOW-GI National Elder Economic Security Standard Index (the Index) methodology. The Index will benchmark basic costs of living for elder households. It will illustrate how costs of living vary geographically and are based on the characteristics of elder households: household size, homeownership or renter, mode of transportation, and health status. The costs are for basic needs of elder households; they are based on market costs and do not assume any subsidies.
