ملخص

يتناول هذا البحث مادة (قُدْس) في القرآن الكريم، ودراستها دراسة دلالية سياقية، وذلك بهدف الكشف عن تقاليب هذه المادة، وإبراز الألفاظ المقاربة للفظها، وإدراك الفروقات بينها، وإظهار دلالاتها في سياق الآيات التي وردت فيها، وإثبات اختصاص كل لفظة بسياقها الذي وردت فيه، مما يكشف عن رافد مهم من روافد الإعجاز القرآني.

وقد كشفت الدراسة أن المادة جاءت دلالاتها اللغوية في الاستعمال القرآني بما يناسب السياق، وبما لا يمكن استبداله بلفظة أخرى مهما كانت مقاربة لها في المعنى، وذلك من خلال دراسة استقرائية وتحليلية لهذه المادة.

تهدف هذه الدراسة إلى التعرف على منهجية الشيخ أطفيش في تأليف كتابه شرح كتاب النيل من خلال باب البيوع (أنموذجاً)، وبيان خصائص هذا الكتاب وما أضافه للمدرسة الإباضية في مجال الفقه، وما تميز به عن غيره من الموسوعات الفقهية الإباضية.

تبرز أهمية موضوع البحث في إظهار أهم القواعد الفقهية والأصولية التي استلهمها الفقهاء كوسيلة لحل التنازع في تفسير عبارات الواقفين وشروطهم، وما يترتب عليها، فهو محاولة لإظهار هذا الدور للقواعد الفقهية والأصولية، ويدور موضوع البحث حول مسألتين: تتمثل الأولى منهما في بيان معنى قاعدة شرط الواقف كنص الشارع، أما الثانية فمن خلال معرفة أثر هذه القواعد في تفسير شروط الواقفين، كل ذلك من خلال المنهجين: الوصفي، والتحليلي.

إنّ اختلاف الفقهاء كان موجودًا وقائمًا ابتداءً من عصر النبوّة، ومرورًا بعصر الصّحابة والتابعين إلى أيامنا هذه، ولهذا الاختلاف الفقهيِّ أسبابُهُ الكثيرة والمتنوّعة، منها: الاختلاف في ضبط النصّ الشرعيّ.

وعليه، فتهدفُ هذه الدراسة إلى تجلية هذا الموضوع ودراسته وإبرازه، من خلال ضبط مفهوم النّص الشرعيّ، وبيان أسباب الاختلاف العائدة إلى ضبط ذلك النصّ، وإيراد بعض النماذج منَ المسائل الفقهيّة، التي كان للاختلاف في ضبط نصوصها تأثيرٌ في وقوع الخلاف بين الفقهاء فيها، وصولًا إلى الخاتمة التي كان من أهمّ نتائجها:

بَحَثتْ هذه الدراسةُ مفهومَ ومشروعيةَ الطّعنِ في الأحكامِ القضائيةِ لدى المحكمةِ العليا الشرعيةِ، والتّي تُعتبر أعلى هيئة قضائيةٍ في مِرفقِ القضاءِ الشرعيّ الأردنيّ، وتَختصّ بتَدقيقِ الأحكامِ الاستئنافيّةِ الفاصلةِ والقطعيّة من حيث سلامةِ التَّطبيقِ القانونيِّ فقط، دونَ إعادةِ البحثِ في الوقائعِ أو موضوعِ الدَّعْوى التِّي صَدَرَ الحُكمُ فِيهَا.
