Language, Legitimacy, And The Law: The Social Roots Of Legal Obligation, Joshua Keton 2024 CUNY Graduate Center

Language, Legitimacy, And The Law: The Social Roots Of Legal Obligation, Joshua Keton

Dissertations, Theses, and Capstone Projects

In a recent turn, both legal scholarship and judicial practice in the United States have converged on the idea that the content of the law is grounded on moral facts—especially facts about democracy. Leveraging insights from the philosophy of language, especially the underdetermination of meaning by syntax and semantics, I argue that textualism can only be reconstructed as a small part of a complete theory of legal interpretation. I then consider a more serious claim to the necessity of moral facts in metaphysically grounding the content of the law. As Mark Greenberg’s anti-positivist theory would have it, the content of …

Searching For The Hyperobject: Crystals As Transscalar Vehicles, Jay Costello

Masters Theses

When I touch the street outside my house, I'm touching Los Angeles—a contiguous vector of material bisecting a continent. A slab, a stone, dust and oil, a googolplex of tightly packed anisotropic particles... At nightfall, I sneak to the edge of the highway and break off a piece. 'What does it mean for a worm to be aware of the scale of the planet?' Bruno Latour's evocative questioning of scalar jumps prompts an existentialism that places me somewhere between the hyperlocal and the massively distributed. Like a cosmic traveler floating through the universe, I feel adrift. I look around, grasping …

Timeless Teachings & Unbridled Possibilities, Ruijie TAI 2024 Rhode Island School of Design

Timeless Teachings & Unbridled Possibilities, Ruijie Tai

Masters Theses

I am looking at is process of TRANSLATING AND BRIDGING.

Qi, traditionally understood as the vital force that flows through and animates living beings and the environment, lies at the edge of our perceptual capabilities.

The notion that what we cannot "see" holds significant influence over our world suggests that there are aspects of reality and forces at play beyond our direct sensory experience. AI, with its capacity for analyzing vast amounts of data and recognizing patterns beyond human capability, offers a unique tool for exploring these unseen forces.

The potential of AI to perceive and understand Qi could open …

In the conventional division of disciplines, film/video/moving images and stationary sculpture are categorized as formal and conceptual opposites. In my work and in this thesis, I am arguing that moving images constitute a form of sculpture in the style of assemblage by the manipulation of time around them. Yes, the image is flat and stationary on its own: but the cut of time which it represents exists multi-dimensionally (spatially and temporally) to be combined in a collage-like manner. In my practice, moving images constitute a form of assemblage that manipulates time and space in ways normally attributed to sculpture.

Wuwei Praxis, Zachary L. Gelnaw-Rubin 2024 CUNY Graduate Center

Wuwei Praxis, Zachary L. Gelnaw-Rubin

Dissertations, Theses, and Capstone Projects

The question of how to change the world is answered in the concept of praxis. For structural change to occur a “revolution in motivation or feeling,” - a paradigm shift - is needed. I argue that this requires the adoption of feminist liberation praxis, which involves a negativistic political stance, nonideal theorizing, and an openness to self-transformation. This entails a transformation of the concept of praxis itself within the Leftist idiom, a transformation which could be the linchpin of the needed paradigm shift in the larger culture.

The three parts of this thesis elaborate upon the different aspects of this …

Masters Theses

This thesis is an exercise in, perhaps a futile, attempt to trace just some of the ideas, stories, and musings I might meander through in my process. It’s not quite a map, nor is it a neat catalogue; it is a haphazard collection of tickets and receipts from a travel abroad, carelessly tossed in a carry-on, only to be stashed upon returning home. These ideas are derived from much greater thinkers and authors than myself; I am a mere collector or a translator, if that, and not a very good one, for much is lost. I do not claim comprehensive …

Winter Solstice, Jingwen Cao 2024 Rhode Island School of Design

Winter Solstice, Jingwen Cao

Masters Theses

For a long time, I have been thinking about what contemporary photography is, what its position is, and what the relationship is between artists and audiences. At the same time, I was developing my concepts and photographic directions and trying to make my work and my perspective on photography relevant. Winter Solstice includes a series of essays that locate my thinking and my work. Its title references the longest night of the year.

The position of photography has changed significantly over the past few decades. The way people read photos is also changing. Perhaps because of reverence for art and …

I Am Becoming., Dai Asano 2024 Rhode Island School of Design

I Am Becoming., Dai Asano

Masters Theses

This is a collection of essays documenting my grappling with the idea that time is always in motion. When you say now, it is not now anymore, but we are still in now, a new now. How can I stay in the now without being swept away by the current of time? Describing a film by Ozu Yasujiro, Deleuze writes, “The vase in Late Spring is interposed between the daughter’s half smile and the beginning of her tears. There is becoming, change, passage. But the form of what changes does not itself change does not pass on. This is time, …

Embodied Abstractions: Identity And Representation In The Digital Era, Srikar Hari 2024 Rhode Island School of Design

Embodied Abstractions: Identity And Representation In The Digital Era, Srikar Hari

Masters Theses

The digital image is a copy in motion. As it accelerates, it deteriorates.

It is a ghost of an image, a preview, a thumbnail, squeezed through

digital connections, resized, uploaded, downloaded, reformatted

and re-edited.

- Adapted from “In defense of the Poor Image” by Hito Steryel

With today’s digital technology, the image is no longer a stable

representation of the world, but a programmable database that

is updated in real time. It is not only part of a program, but it

contains its own operating code: the image is a program in itself.

Consequently, the image’s rhetoric has taken on …

The Universal And Its Others: Dialectics And Conflict In Comprehensive Pluralism, Julie Saada 2024 Sciences Po Law School, Paris, France

The Universal And Its Others: Dialectics And Conflict In Comprehensive Pluralism, Julie Saada

Cardozo Law Review

Since the release of Rawls’s A Theory of Justice in 1971, discussions on the role of groups, redistribution, and symbolic recognition have gained unprecedented attention in North America and Europe. How can we ensure equal recognition among groups and foster equitable access to goods in a way that provides fair distribution not only among groups (plurality) but also within groups (the singular) so that all are politically and socially included on a common shared basis (the universal)? While the approach to this question differs between America and Europe—think of French republican universalism and the historical evolution of the concept of …

Populists In Power And Constitutional Counternarratives, Giuseppe Martinico 2024 Scuola Superiore Sant'Anna, Pisa

Populists In Power And Constitutional Counternarratives, Giuseppe Martinico

Cardozo Law Review

In this essay I shall comment on A Pluralist Theory of Constitutional Justice by Professor Michel Rosenfeld, by developing three points that have to do with the legacy of Carl Schmitt’s constitutional theory. The first is about the progressive weaponization of constitutional law that characterizes what I call the populist constitutional counternarrative. In particular, I will explore how populists in power use constitutional law. The second point has to do with the notion of constituent power in a context of comprehensive pluralism. The third point is about the relationship between constitutionalism and political theology. The intuition behind this is that …

Studies Of Identity In Modernity: Literary, Phenomenological, And Psychoanalytic Approaches, Roarke K. Mcdonald, Angelo Castagnino

DU Undergraduate Research Journal Archive

This paper analyzes challenges to conventional notions of identity in Pirandello’s novel One, No One, and One Hundred Thousand, towards understanding new conceptions of meaning and identity in the early 20th century. The aim is to provide a multi-plural study in the Italian modernist tradition (1890-1945),with the goal of understanding how technological, industrial, and socio-geographical changes of the period were felt across a range of fields, and centered on new ideas of the self in society. A study of how Pirandello’s literary style addresses the complex socio-geographical climate of Italy and Europe in the early 20th century is put …

Beyond The Human: Crossovers For An Onto-Epistemological Bifurcation, Ester Toribio-Roura 2024 Technological University Dublin

Beyond The Human: Crossovers For An Onto-Epistemological Bifurcation, Ester Toribio-Roura

Articles

Building upon recent studies in new materialisms and feminist critical posthumanism with a focus on human and more-than-human relationships, this paper examines how the posthuman paradigm, by postulating the queering of identit(ies) via entanglement with the more-than-human (including technology), and by offering a critical examination of diverse modes of existence within a broader ecological context, can foster more inclusive and ethically sound ways of being in the world. Although posthumanism encompasses a wide range of perspectives and theories, including transhumanism, at its core, it challenges traditional notions of humanism, blurring the boundaries between what is human and what is more-than-human, …

Pronomian Paradigm: A Pro-Torah, Christocentric Method Of Theology And Apologetics, Gregory Scott McKenzie 2024 Liberty University

Pronomian Paradigm: A Pro-Torah, Christocentric Method Of Theology And Apologetics, Gregory Scott Mckenzie

Doctoral Dissertations and Projects

This dissertation sets out to demonstrate the continued validity of the Torah for all believers today. As such, this dissertation attempts to show that discontinuity of the Mosaic Covenant is scripturally, theologically, and philosophically untenable. The thesis of this dissertation is that Pronomianism is the paradigm that most cohesively melds theology and apologetics, through its interpretation of Paul’s words and deeds at the second Jerusalem council, which unveils the Torah’s centrality in New Testament theology, and that Pronomian moral apologetics reveal the Law of God as the only foundation for objective, biblical morality, and the guide to righteous living. This …

Stimming As A Form Of Autistic Aesthetic Experience, Neuroqueering Landscape, Sam Metz 2024 N/A

Stimming As A Form Of Autistic Aesthetic Experience, Neuroqueering Landscape, Sam Metz

Ought: The Journal of Autistic Culture

Sam Metz is an artist based in Hull who creates work that engages with the concept of ‘neuroqueering’. They create sculptural installations that incorporate both film and animation while exploring body-based responses to ecology. As a neurodivergent artist and curator with sensory processing differences, Sam creates work in non-verbal ways that begin and end in movement and embodied interactions without recourse to traditionally privileged verbal and written forms of communication. Recently they created a series of work called ‘Porosity’ which looked at embodied sensory relationships to the Humber Estuary, with a focus on stimming and ecological perception.

Sam, through their …

Sculpting Aesthetic Experiences Through Autistic Indigenous Knowledge, Manuel A. Sánchez Peña 2024 Autonomous

Sculpting Aesthetic Experiences Through Autistic Indigenous Knowledge, Manuel A. Sánchez Peña

Ought: The Journal of Autistic Culture

The intersection between the autistic mind and the experience of aesthetic elements sculpts a distinct lens through which individuals could explain and appreciate the human experience. Differences between neurotypicals and autistics in terms of sensory experience, cognition and communication, combined with knowledge produced by the Philosophy, Psychology, and Anthropology fields in Aesthetics permit the application of the Neurodiversity Paradigm as a source to explain the perception of aesthetics in the collective. The complexity of these experiences in autistic people not only expands deeper comprehension on aesthetic experiences and all its relativisms, but also illustrates neurodiversity as a form of cultural …

Audre Lorde, Feminism, And Love, Emee Port 2024 Georgia College and State University

Audre Lorde, Feminism, And Love, Emee Port

The Corinthian

This paper attempts to connect the topics of feminism and intersectionality in Audre Lorde’s Sister Outsider to love. Feminists should look at race and class as well as gender in order to create a more accepting and inclusive movement. Lorde reasons that many women of color are wary of feminist movements because it pushes racial differences to the side only to focus on gendered oppression. It is important for feminists to recognize racial and class differences on top of gender so that more people feel welcomed to get involved. Love for one another is a driving force for inclusivity and …

An Existentialist Love, Garrett T. Harrison 2024 Georgia College & State University

An Existentialist Love, Garrett T. Harrison

The Corinthian

This paper seeks to establish an existentialist concept of virtuous Love by discussing the works of famous modern Existentialist thinkers such as Jean-Paul Sartre, Simone de Beauvoir, and Albert Camus within the realm of Love as discussed by Bell Hooks and Skye Cleary. It also seeks to express the significance of this Love within modern society. Our notion of Existentialist Love is built upon Sartre’s concept of authenticity, and branches into the inter-personal through Beauvoir’s notion of reciprocal, virtuous love. It is then expounded into the greater collective through a discussion of fear as the breeder of inauthenticity and is …
