This paper argues that deductive arguments are "powerful" when the goal is to stimulate reflection on one's own reasoning. Powerful arguments are defined as arguments that leave only one choice for a potential opponent: either to accept the conclusion or to defeat one of its premises. In the first part, the paper presents an argument for the thesis that so defined powerful arguments are possible when we do not only provide reasons as premises of an argument, but also what is called an "enabler." An "enabler" is that premise in an argument that guarantees that the reason provided in this …

External representations play a crucial role in learning. At the same time, cognitive load theory suggests that the possibility of learning depends on limited resources of the working memory and on cognitive load imposed by instructional design and representation tools. Both these observations motivate a critical look at Computer-Supported Argument Visualization (CSAV) tools that are supposed to facilitate learning. This paper uses cognitive load theory to compare the cognitive efficacy of RationaleTM 2 and AGORA.

The primary goal of this chapter is to present a new method—called Logical Argument Mapping (LAM)—for the analysis of framing processes as they occur in any communication, but especially in conflicts. I start with a distinction between boundary setting, meaning construction, and sensemaking as three forms or aspects of framing, and argue that crucial for the resolution of frame-based controversies is our ability to deal with those “webs” of mutually supporting beliefs that determine sensemaking processes. I argue that law is not best considered an essentially contested concept. After first explaining the notion of essential contestability and disaggregating the concept of law into several related concepts, I show that the most basic and general concept of law does not fit within the criteria generally offered for essential contestation. I then buttress this claim with the additional explanation that essential contestation is itself a framework for understanding complex concepts and therefore should only be applied when it is useful to gain a greater understanding of uses of the concept to which it is applied (adducing criteria for …

Basic income advocates typically praise the administrative efficiency of universal income maintenance. This article exposes several misconceptions, unwarranted generalisations or careless assumptions that permeate discussion of the administrative properties of basic income. Each of these obscures a significant constraint on the possibility of administrative savings, or else inflates the likely size of such efficiencies where they do exist. Our analysis also reveals a number of important political choices faced by policy makers and advocates intent on implementing an administratively efficient basic income policy. The absence of systematic administrative analysis in the basic income literature has obscured these hard choices.

The spread of smart applications touches the foundations of the criminal law, notably causality, wrongfulness, and legal personhood. First, distributed multi-agent systems form hybrid networks that exhibit emergent behaviours that cannot be attributed to either one of the agents or explained in terms of an aggregation of actions. This makes it hard to determine which action actually caused the harm or the damage that would normally be addressed by the criminal law. Second, it is hard to imagine a smart environment or infrastructure itself becoming the culprit of a criminal charge, but at some point we may have to concede …

To cope with an increasingly proactive technological infrastructure a so-called vision of Ambient Law has been developed. It entails the articulation of legal protection into the ICT architecture, to safeguard our rights and freedoms within the various cyberspaces we inhabit. I will argue that the Internet of Things and Ambient Intelligence generate novel challenges to the rights to privacy, due process and non-discrimination, warranting effective remedies beyond the written law. The vision of Ambient Law builds on similar notions within the domain of ethics of technology (e.g. privacy by design, privacy by default, value-sensitive design).
