Spam Works: Evidence From Stock Touts And Corresponding Market Activit, Jonathan Zittrain Dec 2005

Spam Works: Evidence From Stock Touts And Corresponding Market Activit, Jonathan Zittrain

Jonathan Zittrain

We assess the impact of spam that touts stocks upon the trading activity of those stocks and sketch how profitable such spamming might be for spammers and how harmful it is to those who heed advice in stock-touting e-mails. We find convincing evidence that stock prices are being manipulated through spam. We suggest that the effectiveness of spammed stock touting calls into question prevailing models of securities regulation that rely principally on the proper labeling of information and disclosure of conflicts of interest as means of protecting consumers, and we propose several regulatory and industry interventions. Based on a large …

Consent To Medical Treatment By Minors In Massachusetts: A Guide For Practitioners, Francine Sherman Dec 2005

Consent To Medical Treatment By Minors In Massachusetts: A Guide For Practitioners, Francine Sherman

Francine T. Sherman

This guide is designed for healthcare providers, social service agency employees, and other practitioners who connect young people with the medical care they need. While the age of consent for all medical treatment in Massachusetts is generally 18, those younger than 18 may consent to a wide range of services—even without parental authorization—depending on the circumstances. This guide also highlights the special consent issues that may arise for youth who are involved with the Department of Social Services and / or the Department of Youth Services. While these issues may seem complicated at first glance, the governing laws and regulations …

Integrating Indigenous Cultural Traditions In The Management Of Protected Marine Resources – The Fiordland Example, James Mize Dec 2005

Integrating Indigenous Cultural Traditions In The Management Of Protected Marine Resources – The Fiordland Example, James Mize

James Mize

Indigenous communities that rely upon natural resources for their cultural practices and livelihood depend on the health of the ecosystem for traditional practices to continue. Yet government efforts to protect ecosystem integrity by “locking up” resources in spatially-explicit management regimes that prohibit resource use risks the disruption of indigenous cultural traditions compatible with sustainability. This tension can be seen in the Te Wāhipounamu / South West New Zealand (Fiordland) area, a designated UNESCO World Heritage Site, subject to increasing pressure from visitors and other non-traditional use. New Zealand statutes governing the management of adjacent marine resources recognize and incorporate Māori …

Terrorism And Asylum Seekers: Why The Real Id Act Is A False Promise, Marisa Cianciarulo Dec 2005

Terrorism And Asylum Seekers: Why The Real Id Act Is A False Promise, Marisa Cianciarulo

Marisa S. Cianciarulo

The Real ID Act, passed on May 11, 2005, is the first post-September 11 antiterrorism legislation specifically to target a group of vulnerable individuals to whom the United States has historically granted protection: asylum seekers. The passage of the Real ID Act led asylum advocates to wring their hands in despair and immigration restrictionists to clap their hands in glee. This Article argues that both sides of the debate may have been justified in their reactions, but not because of the immediate chilling impact on asylum that they seem to expect. With regard to requirements for establishing asylum eligibility, the …
