Not long ago, there was a consensus in the legal academy that the Japanese were irrational litigants. As the theory went, Japanese people would forgo litigating for financial gain because of a cultural obsession with maintaining social harmony. Based on this theory, it made perfect (but economically irrational) sense that Japanese shareholders let their U.S.-transplanted derivative action lay moribund for almost four post-war decades, while at the same time the derivative action was a staple of shareholder litigation in the United States.The 1980s brought a wave of law and economics to the scholarship of Japanese law, which largely discredited the …

This Article uses the derivative action in Asia as a lens for re-evaluating the foundational theories of Asian and comparative corporate law. It begins by demonstrating that the cultural theory of “Asian non-litigiousness” provides scant explanatory or predictive value for either the evolution or function of the derivative action in Asia’s leading economies. As such, this Article suggests that the theory of Asian non-litigiousness should be relegated to the dustbin of academic history. Napoleon called China a ‘sleeping dragon’, but recent economic developments as China enters the twenty-first century show that the dragon is awakening. China has maintained strong economic growth since 1979 and sustained a GDP increase of more than 9 percent over the years. The total volume of economic output increased from 2.8 percent in 1970 to 7.23 percent in 2008, ranking China as the third largest economy in the world (United Nation Statistics Division Statistical Databases). This paper explores how the Confucian cultural background of students influences their perceptions of and reaction to the dominant public relations curriculum from the ‘West’. Using focus groups of Asian students, three heuristics that affect the students’ affinity to learn public relations are identified. Instructors working with students from a Confucian cultural background are advised to incorporate these heuristics when planning their curriculum.

This article explores the attainments of China and India on measures of basic human development as ingredients of a long-term economic development strategy. It proposes that major differences in ideology and state capacity explain in part why India has fallen behind China. The analysis suggests that these relatively hidden political factors play an important role in transforming and advancing human development not only within India and China but also in other developing and emerging economies. This paper focuses on the pivotal role played by the state in refashioning the Chinatown landscape as part of both nation-building and heritage tourism projects, and the ensuing cultural politics. After a brief history of the creation of Singapore’s Chinatown, the paper discusses, first, Chinatown’s place in Singapore’s post-independence nation-building project and, second, the reconfiguration of the Chinatown landscape as a tourism asset. The final section reflects on the changing politics of place as Chinatown gains legitimacy in state discourses on heritage, tourism and multiculturalism, as well as in the popular imagination as an ethnic precinct par excellence.

This study focuses on the uses of Twitter during the elections, examining whether the messages posted online are reflective of the climate of public opinion. Using Twitter data obtained during the official campaign period of the 2011 Singapore General Election, we test the predictive power of tweets in forecasting the election results. In line with some previous studies, we find that during the elections the Twitter sphere represents a rich source of data for gauging public opinion and that the frequency of tweets mentioning names of political parties, political candidates and contested constituencies could be used to make predictions about …

My thesis examines the extension of microfinance to a refugee community; the objective focuses on economic assistance and a bridge to provide the required basic needs, as reported by the refugee population. With the global growth of refugees, the repositioning of refugees from either being cast aside as a potentially productive society or completely overlooked, is critical. Through my research in Ecuador, my thesis takes the viewpoint that refugees do, in fact, matter, and can become productive contributors to a society. I propose that in order to approach corrective recommendations for family planning initiatives an examination of initiative fitness is necessary. Using a Foucauldian approach, this analysis identifies the discursive formations (ideologies) at work in centralized family planning in order to elucidate the female normative model for whom initiative programs are constructed. This norm is contrasted with the lived experiences of Malian women in order to determine if the ideology dictating family planning structures is suitable for the local population.
