The Debate Inside China, William A. CALLAHAN 2013 Singapore Management University

The Debate Inside China, William A. Callahan

Research Collection School of Social Sciences

In his recent work Gilbert Rozman explains the growing tensions between the People’s Republic of China (PRC) and United States in terms of the symbolic politics of a widening “identity gap.” This identity gap is important, he argues, because it pushes both countries towards more fundamentalist views of themselves and each other, which in turn fosters ideas of an “inevitable” zero-sum geopolitical conflict.

Gender Disparities In Self-Employment In Urban China's Market Transition: Income Inequality, Occupational Segregation And Mobility Processes, Qian Forrest ZHANG 2013 Singapore Management University

Gender Disparities In Self-Employment In Urban China's Market Transition: Income Inequality, Occupational Segregation And Mobility Processes, Qian Forrest Zhang

Research Collection School of Social Sciences

This paper presents the first quantitative analysis of gender disparities in selfemployment in urban China. It documents the extent of gender income inequality in selfemployment. By disaggregating self-employment into three occupational classes, it shows the gender segregation within self-employment—women were concentrated in the financially least rewarding segment—and identifies it as a main source of the gender income inequality. It examines a range of determinants of participation in self employment—family structure, family background, and career history—and how their gender-specific effects contributed to gender segregation. Although using data from a 1996 national survey, this study captures two key processes that shaped the …

Asean: Integration, Internal Dynamics And External Relations, Clara PORTELA 2013 Singapore Management University

Asean: Integration, Internal Dynamics And External Relations, Clara Portela

Research Collection School of Social Sciences

Throughout its evolution, ASEAN has consistently maintained its attachment to the full respect of national sovereignty and the principle of non-interference in internal affairs, which translates into consensual decision-making, political rather than legally-binding agreements and the lack of sanctions for non-compliance. A major breakthrough in terms of institutionalisation came about with the signing of the ASEAN Charter of 2007, which has enhanced ASEAN’s standing as a rule-based organisation and approximated it somewhat to structures typical of the EU. Unfortunately, the persistence of consensual decision-making and non-confrontational habits has slowed down some of ASEAN’s integration projects and hindered the development of …

A Survey Of Executive Compensation Contracts In China’S Listed Companies, Yubo LI, Fang LOU, Jiwei WANG, Hongqi YUAN 2013 Shanghai University

A Survey Of Executive Compensation Contracts In China’S Listed Companies, Yubo Li, Fang Lou, Jiwei Wang, Hongqi Yuan

Research Collection School Of Accountancy

We analyze 228 executive compensation contracts voluntarily disclosed by Chinese listed firms and find that central-government-controlled companies disclose more information in executive compensation contracts than local-government-controlled and non-government-controlled companies. Cash-based payments are the main form of executive compensation, whereas equity-based payments are seldom used by Chinese listed companies. On average, there are no significant differences in the value of basic salaries and performance-based compensation in executive compensation contracts. But, compared with their counterparts in non-government-controlled companies, executives in government-controlled companies are given more incentive compensation. Accounting earnings are typically used in executive compensation contracts, with few firms using stock returns …

Discovering The Right To Criminal Disclosure: Lessons From Civil Procedure, Denise Huiwen WONG 2013 Singapore Management University

Discovering The Right To Criminal Disclosure: Lessons From Civil Procedure, Denise Huiwen Wong

Research Collection Yong Pung How School Of Law

The amendments to the Criminal Procedure Code (Cap 68, 1985 Rev Ed) and subsequent case law developments have created a patchwork of rules governing the disclosure obligations of parties in criminal cases. This article argues that parties have thereby been endowed with a right that is exercisable in the courts to access the material to which the law says they are entitled. However, there are currently no proper procedural mechanisms in place for parties to make interlocutory applications to obtain such material. This article examines the competing values and ideals of a criminal discovery regime, and suggests that concepts such …

Age-Independent Increases In Male Salivary Testosterone During Horticultural Activity Among Tsimane Forager-Farmers, Benjamin C. Trumble, Daniel K. Cummings, Kathleen A. O'Connor, Darryl J. Holman, Eric A. Smith, Hillard Kaplan, Michael D. Gurven

ESI Publications

Testosterone plays an important role in mediating male reproductive trade-offs in many vertebrate species, augmenting muscle and influencing behavior necessary for male-male competition and mating-effort. Among humans, testosterone may also play a key role in facilitating male provisioning of offspring as muscular and neuromuscular performance are deeply influenced by acute changes in testosterone. This study examines acute changes in salivary testosterone among 63 Tsimane men ranging in age from 16–80 (mean 38.2) years during one-hour bouts of treechopping while clearing horticultural plots. The Tsimane forager-horticulturalists living in the Bolivian Amazon experience high energy expenditure associated with food production, have high …

The Right To Appeal Against A Decision Made On An Interlocutory Application: The Immediate Aftermath Of The 2010 Amendments, Eunice CHUA, Siyuan CHEN 2013 Singapore Management University

The Right To Appeal Against A Decision Made On An Interlocutory Application: The Immediate Aftermath Of The 2010 Amendments, Eunice Chua, Siyuan Chen

Research Collection Yong Pung How School Of Law

One of the main reasons for amending the Supreme Court of Judicature Act (Cap 322, 2007 Rev Ed) in 2010 was to introduce a calibrated approach towards interlocutory appeals to the Court of Appeal. The amended s 34 and the newly introduced Fourth and Fifth Scheds were interpreted for the first time in two recent Court of Appeal decisions, providing much needed guidance on the general approach towards statutory interpretation, as well as specific direction in terms of interpreting the term “order” in para (i) of the Fourth Sched and para (e) of the Fifth Sched, and the term “interlocutory …

The Future Of The Similar Fact Rule In An Indian Evidence Act Jurisdiction: Singapore, Siyuan CHEN 2013 Singapore Management University

The Future Of The Similar Fact Rule In An Indian Evidence Act Jurisdiction: Singapore, Siyuan Chen

Research Collection Yong Pung How School Of Law

In yet another attempt to bridge the gap between the rules of an antiquated statute and the modern realities of practice, Singapore’s Evidence Act was amended in 2012. Certain relevancy provisions were amended to allow greater admissibility of evidence. While new provisions were introduced to act as a check against abuse, oddly some similar fact provisions were left intact. This paper explains why the 2012 amendments have rendered the future of these enactments very uncertain. This paper also suggests a number of tentative recommendations as regards future legislative change or judicial interpretation. To the extent that Singapore’s Evidence Act was …

Asean's Liberalization Of Legal Services: The Singapore Case, Pasha Li-Tian Hsieh 2013 Singapore Management University

Asean's Liberalization Of Legal Services: The Singapore Case, Pasha Li-Tian Hsieh

Research Collection Yong Pung How School Of Law

This article examines the liberalization of legal services in the Association of Southeast Asian Nations (“ASEAN”) within the framework of the ASEAN Economic Community and ASEAN’s free trade agreements. Although trade in legal services is important to ASEAN’s goal as a “single market and production base,” the article challenges the weaknesses of ASEAN’s legal services liberalization. It then explores Singapore’s experiment on the regulations of foreign law firms and foreign lawyers, which have become substantially liberalized in the past decade. The article argues that while Singapore may serve as a positive example, ASEAN countries should be cautious of the gap …

Contractual Interpretation In Indian Evidence Act Jurisdictions: Compatibility With Modern Contextual Approach, Yihan GOH 2013 Singapore Management University

Contractual Interpretation In Indian Evidence Act Jurisdictions: Compatibility With Modern Contextual Approach, Yihan Goh

Research Collection Yong Pung How School Of Law

This paper examines the approaches towards contractual interpretation taken by Commonwealth jurisdictions governed by the Indian Evidence Act. While some of these jurisdictions import the modern contextual approach into their domestic approaches, it will be argued that it is largely compatible with the Indian Evidence Act. In particular, it will be shown that a limited adoption of the modern contextual approach is permissible, namely one involving the limited admissibility of extrinsic evidence to interpret contracts, subject to the requirement of ambiguity. An integrated approach may represent the best way of following the modern contextual approach, while remaining faithful to the …

Go Beyond ‘Nudges’ In Tackling Discrimination, Tan K. B. EUGENE 2013 Singapore Management University

Go Beyond ‘Nudges’ In Tackling Discrimination, Tan K. B. Eugene

Research Collection Yong Pung How School Of Law

In this commentary, SMU Associate Professor of Law and NMP Eugene Tan shared his thoughts on the Fair Consideration Framework (FCF), which was describe by Acting Manpower Minister Tan Chuan-Jin as a “nudge” to employers to give Singaporean professionals, managers and executives (PMEs) – who constitute about a third of the workforce – a “fair chance” at job and development opportunities.

Sleepwalking To Disharmony, Tan K. B. EUGENE 2013 Singapore Management University

Sleepwalking To Disharmony, Tan K. B. Eugene

Research Collection Yong Pung How School Of Law

In a commentary on racial relations in Singapore, SMU Associate Professor of Law and NMP Eugene Tan pointed out that the findings of the Indicators of Racial and Religious Harmony survey jointly conducted by the Institute of Policy Studies and OnePeople.sg demonstrated that we did well where it involved a strong public sphere/space element. However, we did not do as well in indicators that had a closer nexus to the private sphere and how we viewed Singaporeans of other races. Associate Prof Tan opined that the four indicators where we did not fare as well (but were still positive overall) …

The Use Of Experts In Legal Proceedings In Singapore Involving Intellectual Property Rights, David LLEWELYN 2013 Singapore Management University

The Use Of Experts In Legal Proceedings In Singapore Involving Intellectual Property Rights, David Llewelyn

Research Collection Yong Pung How School Of Law

In intellectual property (IP) cases decided in recent years in Singapore, the use of expert evidence is commonplace. Weaknesses in that expert evidence are commonplace too; sometimes the weaknesses are such that the evidence should be excluded, on other occasions they render the evidence of little value. However, in all cases the reliance on expert evidence will have increased the cost of the litigation for both sides (and rarely does the costs award make that increase good for the successful party). Aside from the more general policy concerns regarding expert evidence, this is an important reason why the courts must …

Affordable Fares, Sustainable Public Transport: The Fare Review Mechanism Committee Report, Sock Yong PHANG 2013 Singapore Management University

Affordable Fares, Sustainable Public Transport: The Fare Review Mechanism Committee Report, Sock Yong Phang

Research Collection School Of Economics

The public transport system in Singapore is the main mode of transport for the majority of the population. It is important that public transport remains generally affordable and accessible, with measures to help various commuter groups through fare assistance schemes. Household surveys show that public transport has become more affordable as a proportion of monthly household income over the years. Public transport fares have increased, but at a much lower rate than increases in income. At the same time, increasing fuel costs and other changes in the public transport landscape since 2005 mean that the public transport industry faces declining …

Geographic Decomposition Of Inequality In Health And Wealth: Evidence From Cambodia, Tomoki FUJII 2013 Singapore Management University

Geographic Decomposition Of Inequality In Health And Wealth: Evidence From Cambodia, Tomoki Fujii

Research Collection School Of Economics

Applying the small-area estimation methods to Cambodia data, we decompose the total inequality in wealth (consumption) and health (child undernutrition) indicators into within-location and between-location components. Because the knowledge of the pattern of spatial disparity in poverty and undernutrition is important for the geographic targeting of resources, we conduct a geographic decomposition of the variance of the Foster-Greere-Thorbecke index in addition to the standard decomposition exercise based on the generalized entropy measures. We find that a sizable proportion of wealth inequality is due to between-location inequality, whereas health inequality is mainly due to within-location inequality.

On Vernacular Scottishness And Its Limits: Devolution And The Spectacle Of "Voice", Scott Hames 2013 University of Stirling

On Vernacular Scottishness And Its Limits: Devolution And The Spectacle Of "Voice", Scott Hames

Studies in Scottish Literature

This essay asks why vernacular cultural expression has been so central to discussion of Scottish national autonomy, traces the literary and political contours of vernacular discourse in the period of Scottish devolution, and concludes with a provisional sketch of three "vernacularities" (democratic, romantic and identitarian) and with reflections on how literary criticism might move beyond the "representative” paradigms of vernacular voice to engage with voice as a principle of agency and action.
