The 2012 amendments to the Evidence Act “significantly broadened the admissibility criteria for expert evidence”; at the same time, the judicial discretion to deny admissibility of relevant expert opinion evidence was also introduced. This article considers the key developments pre- and post-amendments, and in doing so provides an updated framework for prosecutors and defence counsel alike to admit and challenge expert opinion evidence in criminal proceedings. By a judgment of Lord Sumption with which a majority of the court agreed, the Supreme Court in MWB Business Exchange Centres Ltd. v Rock Advertising Ltd. [2018] UKSC 24, [2019] A.C. 119 ruled that a contractual term which prescribed that the contract was not amendable save in writing signed by or on behalf of the parties (a No Oral Modification or “NOM” clause) was effective to invalidate subsequent oral variations to the contract. Trade secret protection law has been an important complement to patent law and has gained increasing importance over the last three decades, not least in Asia. Major Asian countries are now at a crossroads, as some (Japan, Korea, Thailand, Taiwan, and China) are following the US approach to criminalizing trade secret infringement and imposing harsher penalties on economic espionage (Japan, Korea, Taiwan, and China). This paper identifies many of the problems associated with trade secret protection, provides indicators of the overprotection of trade secrets, and warns against its many side effects. This chapter explores the contrasting role of proportionality discourse in the USA and in Latin America. Although the USA provided an important constitutional model for Latin American countries, the latter does not share the former’s disinterest in the proportionality framework, which is considered foreign to the legal tradition of the country despite the fact it is arguably harmonic with the approach to law creation in the common law tradition. Bhutanese migrants in Perth have increased manifold in the last decade with numbers estimated at around 12000 in 2022. Almost ninety-nine per cent of these Bhutanese migrants come on student visas. Research has indicated that migration move is typically driven by hope and a search for better futures. Consequently, there is an increase in the community activities and complexities experienced by the Bhutanese migrants in Perth as they seek to build a new home in a new country. Mental health disparities for Black people of diverse ethnicities compared to people of other racial identities has been well-documented (Alegría et al., 2008; Maura & Weisman de Mamani, 2017). Research addressing this pervasive systemic and interpersonal problem often focuses on client-related factors that create or intensify barriers to care. However clinician-related factors (i.e., racial identity, multicultural training, implicit biases, behavior, etc.) also have a significant impact on barriers to care, retention in therapy, and clinical outcomes for people of African descent (Larrison & Schoppelrey, 2011; Owen, Imel, Adelson, & Rodolfa, 2012). This study discusses how International Financial Institutions (IFIs), primarily the International Monetary Fund (IMF), have incorporated the social dimension when designing their reform programs in the Middle East. This research explores three case studies of IMF programs in Tunisia, Jordan and Egypt, and examines how the process of designing and implementing social protection programs has changed after the Arab Spring. The Egyptian case study provides an in- depth analysis of the design of Takaful and Karama in particular and its implementation. Moreover, it provides a future outlook on the protection programs in Egypt with implications for the wider MENA region. …

Abstract: Since the pioneering work of John H. Dunning on the role of foreign direct investment (FDI) in the economic growth of the United Kingdom, many experts have debated the growth effect of FDI in an economy. This study investigated the impact of FDI on Colombia’s economic growth from 1990 to 2019. Moreover, it explored whether the Colombian economy has benefited from positive spillover from FDIs. Additionally, the paper examined how the stock level of human capital conditioned the effect of FDI on GDP per capita growth. North Korea's Policy Toward The United States: Rappochement To Confrontational Diplomacy In The 1970s And The 1990s, Seongryeol Kim

This research project challenges the common belief that North Korea's pursuit of nuclear weapons and their related delivery systems in the 1990s was a fundamental shift in its foreign policy objectives toward the United States. It argues instead that North Korea has continued to pursue the rapprochement policy announced by Kim Il Sung in the early 1970s. Its findings demonstrate that the shift from rapprochement in the 1970s to provocation in the 1990s was a tactical rather than a strategic change in North Korea's foreign policy.
