This Review examines the influence of foreign legal actors on jurisdictions that are not their own. Rachel Stern, a scholar of China, reflects on this point in her groundbreaking book published in 2013. In her penultimate chapter, Stern discusses how such foreign legal actors wield influence in China because of their presence on the ground. Building off of Stern's research, this Review proceeds to ask whether foreign legal actors can influence a domestic environment when that environment prohibits them from permanently working there. Although the translation of Chinese texts by modernist poets has been acknowledged by critics, the implications of this cultural exchange between China and America has not generated substantial critical study. Using Ludwig Wittgenstein’s theory of language, this thesis examines this cultural dialogue through the work of Ernest Fenollosa, Ezra Pound and Kenneth Rexroth. Restoring Fenollosa’s pioneering role, a chapter of this thesis uncovers his unfinished project of a fusion of East and West, and exposes his imperialist and nationalist attitudes that later result in appropriation. This study examines the autonomy of art as a governing principle in the artistic practice of Filipino poets in English. The Western modernist ideal of art for art’s sake was transplanted to the Philippines via the educational system implemented during the American occupation in the early twentieth century. As appropriated in colonial Philippines, what is historically regarded as a form of artistic resistance to the capitalist and rapidly industrializing society of the West is traditionally read as a withdrawal of participation by colonial and postcolonial literary writers from the political realm. Public Vs. Private Schooling As A Route To Universal Basic Education: A Comparison Of China And India, William C. Smith, Devin K. Joshi

This article examines whether focusing primarily on public schooling can lead to more rapid achievement of universal basic education (UBE) than relying on a mixture of public and private schooling. Through a structured, focused comparison, we find China's greater emphasis on public schooling has contributed to higher enrollment, attendance, graduation rates, gender parity, and proportion of students entering higher education than India, the country with the world's largest private sector in primary and secondary education. This comparison suggests that greater emphasis on public schooling in developing countries may lead to more rapid UBE attainment than encouraging privatization.

In geographically vulnerable and politically unstable regions such as Sri Lanka, I argue that linking natural hazards and climate-induced disasters to existing social issues is more pressing than ever. In the case of the 2004 Boxing Day tsunami, it was impossible to dissociate the two. In the aftermath of World War II, the Liberal Democratic Party of Japan followed Germany’s blueprint in fashioning a universal health coverage system. Comparisons to Germany’s welfare state during this same time period reveal markedly different social and mental health policy practices, as Germany’s Christian Democratic Union and Social Democratic Party cooperated toward progressive policies while the Liberal Democratic Party largely neglected social welfare expansion. The effect of these practices is reflected in budgetary provisions, institutionalization practices, and mental health epidemiology. With Japan losing its overall population due to low fertility rate, rural depopulation has become a prevalent issue across the country. This thesis examines Oonan Town in Shimane Prefecture as a case study, as it is a rural town that has been successful in getting in-migrants back into the community. Through oral, biographical interviews, participants reported factors that played a significant role in the migration decision-making process. Data show that in-migrants in Oonan Town were largely affected by four factors, which are 1) family ties, 2) life course events, 3) lifestyle preferences, and 4) financial factors. Because women encounter unique geographic, social, political, religious, economic, and temporal conditions, applying the particular agendas of traditional western feminism to countries like India can easily become a form of cultural imperialism or lead to Orientalism. Therefore, in this essay I argue that in order to support the agency of Indian women, western feminists must step back; Indian women and men who seek women's uplift must claim post-patriarchal expressions of traditional Indian culture. Since April 2013, the Korean government has implemented a series of plans to stabilize the housing market, which has suffered from falling housing prices and surging rent after the 2008 financial crisis. This study estimates the effectiveness of the government's plans by analyzing the housing satisfaction of 2012 and 2014 Korea Housing Survey (KHS). The data used in this study are collected from the KHS carried out by the Ministry of Land, Infrastructure and Transport (MOLIT)

This article is the first empirical study investigating the corporate reorganisation of Chinese domestically-listed companies. Through examining these cases, it challenges the assertion made by most of these corporate reorganisation plans and by Chinese state-run media reports that creditors and general public shareholders were the major beneficiaries. Through an analysis of the data generated from all forth-three such cases, this articles reveals that: First, unsecured creditors could have, on average, received 61.37% more of their claims if the fundamental value distribution principle, the absolute priority norm, could have been complied with in these reorganisations; Second, if the general-public-shareholder-protection scheme issued …

This thesis examines the function of music within different theories of nationalism and the appropriation of folk music within the genre of min’ge. Min’ge, a term in Chinese which directly translates to “folk songs”, has generally been defined as oral musical traditions. However, due to the increased politicization of popular music since the 1930s, the nature folk music has fundamentally changed, reflecting its new significance within Chinese nationalism. Given that conditional cash transfers (CCTs) can be a very effective social welfare program to reduce poverty and improve education and health outcomes, but may exacerbate conflict, this thesis addresses strategies for conflict-sensitive formulation and implementation of CCTs in Indonesia. This thesis raises the immediate need to address poverty in Indonesia and seeks to learn from the successes and challenges of other CCTs, such as those enacted in Mexico, Brazil, Turkey, and the Philippines. A nationally representative telephone survey (n = 1,006) was conducted to understand how different groups of Singaporeans regard the issue of climate change and their inclination toward action in dealing with it. We measured attitudes, knowledge, and perceptions of the problem of climate change and the role of various stakeholders in addressing it. The data were subjected to a latent class analysis to produce three distinctive segments of the population: the concerned, the disengaged, and the passive.
