This dissertation explores whether and how the re-election prospects faced by trial court judges in many American states influence criminal justice policy, specifically, state levels of incarceration, as well as the disparity in rates of incarceration for Whites and Blacks. Do states where trial court judges must worry about facing reelection tend to encourage judicial behavior that results in higher incarceration rates? And are levels of incarceration and racial disparities in the states influenced by the proportion of the state publics who want more punitive policies? Previous research has shown that police presence, which involves visibility of law enforcement personnel, is often related to perceptions of individual safety and individual behavior. The purpose of this study was to explore perceptions of college students and campus law enforcement regarding visibility of and citizen/police interaction on Eastern Kentucky University’s campus. The first phase of this project was designed to measure student awareness and visibility of “ghosted” police vehicles, which are black with matte black markings on the doors and have few easily visible indicators of law enforcement vehicles, versus other police types of police vehicles on campus. Recent scholarship has underlined the importance of criminal misdemeanor law enforcement, including the impact of public-order policing on communities of color, the collateral consequences of misdemeanor arrest or conviction, and the use of misdemeanor prosecution to raise municipal revenue. But despite the fact that misdemeanors represent more than three-quarters of all criminal cases filed annually in the United States, our knowledge of misdemeanor case processing is based mostly on anecdote and extremely localized research. Men and boys commit more crime, are more violent, and are more likely to be involved in the criminal justice system than women and girls (Cohen & Harvey, 2006; Carson, 2018; Zimmerman & Messner, 2010). Within the past two decades, criminal studies have begun to consider masculinity as a social construct to explain the gender gap in crime rates. However, more research is needed to understand its relationship to reentry and recidivism. Compared to the general population, transgender individuals face higher rates of victimization, violence, substance use, physical health issues, and mental health problems. Transgender people are more likely to face barriers in finding and maintaining employment and housing due to discrimination. As a result, they are more likely to participate in illegal economies such as sex work and drug distribution. These factors contribute to the overrepresentation of transgender people in jails and prisons in the United States. Specifically, 16% of transgender adults have been incarcerated, compared to 2.7% of the general population. While under custody, transgender individuals are at risk of …

In a five-to-four decision announced in February of 2020, the United States Supreme Court ruled that the parents of an unarmed fifteen-year-old Mexican national killed by a U.S. Border Patrol agent in a cross-border shooting, cannot sue for damages in U.S. civil court. Here, we critique the majority and dissenting opinions and attempt to reconcile the strikingly different approach each used to resolve the case. Using a publicly available data set, we examine the homicide in Hernández v. There is a considerable and established literature on the topic of violence against women. Yet, there remains understudied areas of foci with lesser attention paid to its occurrence within online and digital contexts. Of particular interest is the networked misogyny and sexism of the online group that self-identifies as “involuntary celibates”, or “incels”. Drawing on data collected from online forums and chat rooms, the language and discourse of this particular group are analyzed through an integrated conceptual framework encompassing hegemonic masculinity, aggrieved entitlement, and patriarchy to better understand the prevalence and types of violence promoted by “incels”. Tracing Biometric Assemblages in India’s Surveillance State seeks to understand the historical conditions that rendered the nation-state of India as having the world’s largest biometric surveillance system: Aadhaar. Surveillance practices used by the British Raj mirrors the current social order of the ruling Bharatiya Janata Party (BJP), as they use surveillance to similar ends in today’s political economy, through the intersecting forces of neoliberalism and ethnonationalism. Foster care case managers are responsible for the wellbeing of foster youth in the foster care system. Teens (ages 13-17) in foster care are most vulnerable to serious risks, such as sex trafficking. Researchers used state-level data on youth justice policies and practices to explore the association between state policy environments and recent changes in the use of residential placements for adjudicated youth (i.e., confinement). The study assigned a score to each of the 50 states based on the extent to which their youth justice policy environments could be considered "progressive" as opposed to punitive or regressive. Using data from the National Center for Juvenile Justice's compendium of justice system characteristics, "Juvenile Justice, Geography, Policy, Practice & Statistics" (JJGPS), the research team created an index that accounts for 16 policies that are more …

In the first change to the Model Penal Code since its promulgation in 1962, the American Law Institute in 2017 set blameworthiness proportionality as the dominant distributive principle for criminal punishment. Empirical studies suggest that this is in fact the principle that ordinary people use in assessing proper punishment. Its adoption as the governing distributive principle makes good sense because it promotes not only the classic desert retributivism of moral philosophers but also crime-control utilitarianism, by enhancing the criminal law’s moral credibility with the community and thereby promoting deference, compliance, acquiescence, and internalization of its norms, rather than suffering the …

This thesis explores Fort Assinniboine’s role as an extension of the federal government’s military arm in the Northern Plains. It argues that the military occupation of northern Montana served to incorporate the northern borderland region and peoples into the American mainstream as a part of the national reconstruction processes following the Civil War into the twentieth century. In a period of half a century, north-central Montana transformed from a Native American common hunting ground lacking any major white settlement to a rapidly developing agricultural region. In late 2016 a feminist movement against problems of commercial sexual exploitation, and especially issues of coerced pornography filming, arose in Japan. This article describes the history of this movement as it mobilized to combat human rights violations perpetrated by the country’s pornographers. The movement’s success came not spontaneously or haphazardly; in fact, it was orchestrated earlier over a full decade-and-a-half by activists who persevered in researching and highlighting pornography’s harms in a civil environment of hostility, isolation and social derision, even among progressive groups and individuals. This article reviews the literature of how individual differences (specifically trait conscientiousness) may contribute to ex-offender responsivity to reentry programming. By studying if individual differences (e.g. personality traits) contribute to specific responsivity, programming can be determined to be ineffective for the general population and redesigned in a manner that is beneficial for the largest number of clients. This report details a three year evaluation of the MENTOR (Mentors Empowering to Overcome Recidivism) Program in the Philadelphia court system. MENTOR program participants who are serving county probation sentences are matched with a volunteer mentor from the community, receive case management from MENTOR staff, and attend a monthly status hearing with one of the MENTOR judges. Juvenile misuse of prescription drugs in the United States has continuously increased over the last few decades, especially within rural regions of the country. Despite continuous increase in rates of misuse, limited research exists on elements of socialization that may function to prevent drug use. Introduction: Behaviors like truancy, running away, curfew violation, and alcohol possession fall under the status offense category and can have serious consequences for adolescents. The Juvenile Justice and Delinquency and Prevention Act prohibited detaining status offenders. We explored the degree to which African American adolescent girls were being detained for status offenses and the connections to their behavioral health risks and re-confinement. Methods: 188 African American girls (aged 13–17), recruited from detention facilities, were surveyed at baseline and 3-month follow-ups. Logistic regression models estimated the likelihood of longitudinal re-confinement, controlling for sexual and behavioral health risk factors. Results: One third …
