This special issue of the International Journal on Responsibility (IJR) advances scholarship on the various ways responsibility infuses the roles of criminal justice agents. As the inaugural issue of my tenure as Editor-in-Chief, Volume 6 deepens our understanding of responsibility in the context of the criminal justice system, thereby fulfilling IJR’s aim and scope. Specifically, the articles highlight issues of responsibility within each component of the criminal justice system: police, courts, and corrections.

The COVID-19 pandemic has negatively impacted the population as a whole. However, the incarcerated population (which also experiences a variety of health disparities) has been disproportionately affected by the pandemic. Due to overcrowding, poor ventilation, and lack of resources, the incarcerated population already is at a heightened risk for negative health outcomes, made worse by the recent pandemic. To adapt to the rapidly changing conditions during the pandemic in 2020 and into 2022, new safety measures were implemented, but the unintended consequences associated with the implementation of these procedures have yet to be examined empirically. New York City supplements traditional policing with community-based strategies to prevent crime and violence. At the request of the Department of Youth and Community Development, the Research and Evaluation Center at John Jay College reviewed three such programs: the Crisis Management System (CMS), the Mayor’s Action Plan for Neighborhood Safety (MAP), and the Precision Employment Initiative (PEI). While grounded in promising practices, these initiatives have not yet undergone rigorous evaluation. Additional research is needed to assess their effectiveness and guide potential expansion efforts.

Epidemiological approaches have brought important attention to the issues surrounding the over-incarceration of Aboriginal and Torres Strait Islander young people, and the enormous health and socio-economic disparities they face. An implicit discourse often exists within the construction of this “knowledge”, however, that situates Aboriginal and Torres Strait Islander young people in deficit terms.

The issue of the victim-offender overlap was identified more than 60 years ago (Wolfgang, 1958), but it was not until the last decade that research interest in the victim-offender overlap began to flourish. Although the victim-offender overlap is arguably established by a substantial body of research, a closer look at the existing literature will find scant attention paid to the incarcerated population. Recent studies (Daquin & Daigle, 2020; Kuo et al., 2021; Toman, 2017) have begun to discover the victim-offender overlap in adult prisons, but the victim-offender overlap in juvenile facilities remains underexplored. State responses to interpersonal violence in the US have long been focused on punishment and prison. While opposition to punitive responses to interpersonal violence has been marginal, there are small but growing efforts to challenge the primacy of punishment and incarceration. In its place, different non-punitive approaches to justice have been practiced and promoted including restorative justice and transformative justice, which see accountability, not punishment, as a primary goal. Examining Remorse In Attributions Of Focal Concerns During Sentencing: A Study Of Probation Officers, Colleen M. Berryessa

This research, using interviews with probation officers in the United States (n = 151) and a constant comparative method for analysis, draws from the focal concerns framework to qualitatively model a process by which probation officers use a defendant’s remorse to attribute focal concerns in order to guide their sentencing recommendations in pre-sentencing reports. The model suggests that officers use expressions of remorse to make attributions about mitigated criminal intention (blameworthiness and notions of responsibility), reduced dangerousness and a high potential for reform (community protection), and organization-level effects for increasing caseload efficiency and using correctional resources (practical effects of …

Prison data collection is a labyrinthine infrastructure. This article engages with debates around the political potentials and limitations of transparency as a form of “accountability,” specifically as it relates to carceral management and data gathering. We examine the use of OASys, a widely used risk assessment tool in the British prison system, in order to demonstrate how transparency operates as a means of legitimating prison data collection and ensuing penal management. The objective of this study is to examine how offenders are impacted by their social environment upon being released from prison. Using data from the Serious and Violent Offender Reentry Initiative (SVORI), the current study aims to examine the potential role of community support along with factors including employment, housing, peer relationships, and family support. By doing so, this study aims to identify difficulties in the reentry process and offer suggestions for improvements in this process. The results of the study are discussed, along with recommendations for future studies and policy implications.

Policing and moral panics exist in a mutually reinforcing, reciprocal relationship, the harmful outcomes of which are disproportionately directed towards poor communities of colour. This paper will draw on two examples of moral panics: those surrounding Islamic terrorism and Black crime, in order to illustrate the harm that this reinforcing relationship can cause. This harm manifests itself in increasingly restrictive antiterrorism laws, Prevent initiatives, racial profiling, and internal surveillance within the Muslim community; as well as the policies of Joint Enterprise, Knife Crime Prevention Orders (KCPOs), and the strengthening of the school-to-prison pipeline, which disproportionally target Black youth. This dissertation explores the longitudinal relationships between social mobilization, crime, and crime control. The dataset used to explore these relationships combine Uniform Crime Report (UCR) data on crimes known to the police and crime clearances by arrest with decennial census data and data on reported social mobilization events reported in the New York Times between 1964-1995. The data include information from all these sources for over 900 cities in the U.S. Analyses model violent and property crime counts, and well as clearance by arrest rates in the month after the social mobilization events. Unfortunately, the predominant structure for addressing domestic violence - the criminal justice system - is rife with problematic social and structural constructs, like patriarchy, white supremacy, and neoliberalism, which are themselves rooted in issues of power and control (Acheson, 2022). Purpose

While the implementation of risk assessment has expanded, the extent to which there are different trajectories of risk/protective factors among adjudicated youth during supervision in the community remains unanswered. The goal of the current study is to identify the distinct trajectories in dynamic risk and protective factors among youth on probation and assess whether different patterns in risk over time are associated with continued offending.

Purpose: This study explored mental health workers perspectives on alternative approaches in responding to mental health crises.

The study was carried out in Southern California, in collaboration with mental health workers who currently work or previously have worked in mental health crisis. It adopted a post-positivists paradigm and data was gathered through individual interviews with mental health workers who have direct experience with mental health crisis response in the community and with the police. The twenty participants in the study were men and women working in the mental health field, and of various backgrounds, licensures, and ages.

This study explores the silent mass disaster of unidentified deceased persons that is occurring across the United States and identifies the individual and community level characteristics that make a person “at-risk” of becoming an unidentified deceased person within the United States. This study identifies trends-based hotspots by using data reported on the National Missing and Unidentified Persons System (NamUs) and comparing those trends to the gender United States population. It finds that males, and age of death between 20-64 are overrepresented and White persons are underrepresented in the unidentified deceased person sample when compared the general population. One of the most popular genres of online pornography today is hentai, sexualized animation, and cartoons in the style of Japanese anime. Data from Pornhub, the world’s best-known pornography website, as well as a recent report from a British regulatory agency and our research, show that much of hentai appeals to children and depicts child-like characters engaged in sexual violence. In almost every instance, this violence targets female characters. Hentai, we show, encourages adults to see minors, especially girls, as legitimate targets of sexual violence. This article reviews the three previously studied categories of variables that are related to eyewitness identification accuracy: estimator (characteristics of the witnessing conditions), system (characteristics of the identification procedure that are under the control of the criminal legal system), and reflector (variables that reflect the likely accuracy of a witness). Although eyewitness scholars frequently turn to these variables and models of memory to explain why eyewitnesses make mistakes, none of these variables provides a reasonable explanation for the large racial disparities in wrongful convictions based on mistaken identifications, yet problematic policing practices might. วิทยานิพนธ์ มาตรการกำกับควบคุมระบบกล่องสุ่มภายในวิดีโอเกม: กลไกเพื่อความสนุกหรือการพนันแฝง มีวัตถุประสงค์เพื่อศึกษาเพื่อศึกษาการทำงานของระบบกล่องสุ่มภายในวิดีโอเกมว่าเป็นกลไกเพื่อความสนุกหรือการพนันแฝง ผลกระทบที่อาจเกิดต่อผู้เล่นและต่อสังคม และเพื่อมาตรการกำกับควบคุมระบบกล่องสุ่มภายในวิดีโอเกมของประเทศไทยและต่างประเทศ เพื่อเสนอแนวทางที่เหมาะสมในการกำกับควบคุมการใช้ระบบกล่องสุ่มภายในวิดีโอเกมสำหรับประเทศไทย โดยศึกษาเชิงคุณภาพด้วยการวิจัยเชิงเอกสารและการสัมภาษณ์เชิงลึกจากผู้ให้ข้อมูลสำคัญในหน่วยงานภาครัฐ และภาคเอกชน จำนวน 17 คน ผลการศึกษาพบว่า การทำงานของระบบกล่องสุ่มภายในวิดีโอเกม เป็นทั้งระบบที่เป็นส่วนหนึ่งของวิดีโอเกมและระบบที่มีลักษณะและการส่งผลทางจิตเหมือนกับการพนัน เสมือนการพนันแฝงภายในวิดีโอเกม แต่ระบบกล่องสุ่มภายในวิดีโอเกมไม่มีสถานะเป็นการพนันตามพระราชบัญญัติการพนัน พ.ศ. 2478 ระบบกล่องสุ่มภายในวิดีโอเกมส่งผลกระทบทั้งในด้านความไม่เป็นธรรมต่อผู้เล่น ด้านสุขภาพ และด้านเศรฐกิจและสังคม ซึ่งอาจส่งผลให้เกิดปัญหาอาชญากรรมอื่นตามมา ในปัจจุบันประเทศไทยยังไม่มีกฎหมายหรือหน่วยงานใดที่กำกับควบคุมระบบกล่องสุ่มภายในวิดีโอเกมโดยตรง และไม่มีมาตรการของภาคเอกชนไทยในการกำกับควบคุมระบบกล่องสุ่มภายในวิดีโอเกม ในส่วนของมาตรการกำกับควบคุมระบบกล่องสุ่มภายในวิดีโอเกมของต่างประเทศ ในส่วนของภาครัฐมีการใช้มาตรการทางกฎหมายการพนัน กฎหมายคุ้มครองผู้บริโภค และกฎหมายกล่องสุ่มภายในวิดีโอเกมโดยตรง ภาคเอกชนมีการทำข้อตกลงในภาคอุตสาหกรรมเกม มีมาตรการของร้านค้าออนไลน์ และมาตรการจัดเรทวิดีโอเกม แนวทางของมาตรการกำกับควบคุมระบบกล่องสุ่มภายในวิดีโอเกมที่เหมาะสมสำหรับประเทศไทย คือ 1) มีการนิยามการพนันไว้ในกฎหมายอย่างชัดเจน 2) ให้มีกฎหมายเกี่ยวกับระบบกล่องสุ่มภายในวิดีโอเกมโดยตรง 3) ให้มีการจัดเรทวิดีโอเกมโดยพิจารณาจากระบบการเล่น 4) ให้มีมาตรการสำหรับผู้ให้บริการเกมจากต่างประเทศ นอกจากนี้ควรมีการประชาสัมพันธ์ให้ความรู้เพิ่มเติม และส่งเสริมการทำงานของทุกภาคส่วนที่เกี่ยวข้อง

การศึกษาเชิงพรรณนานี้มุ่งศึกษาลักษณะ ปัจจัยที่สัมพันธ์ต่อความขัดแย้ง รูปแบบการจัดการที่มิได้เข้ากระบวนการศาลจากโรงพยาบาลตติยภูมิในกรุงเทพมหานครและปริมณฑลในช่วงแพร่ระบาดของโรคโควิด-19 รวมถึงผลกระทบจากสถานการณ์ ตลอดจนโอกาสพัฒนาแนวคิดยุติธรรมเชิงสมานฉันท์ โดยศึกษาข้อมูลเบื้องต้นจากหน่วยงานบริหารความขัดแย้งผ่านแบบสอบถาม และสัมภาษณ์เชิงลึกในผู้ที่เคยได้รับความเสียหายในบริการทางการแพทย์ ผู้บริหารระบบและไกล่เกลี่ยความขัดแย้ง ผลการศึกษาจากการสำรวจจากโรงพยาบาล 19 แห่ง พบว่าการให้ข้อมูลที่ไม่เหมาะสม และปัญหาการสื่อสาร เป็นเหตุสำคัญสูงสุด (ร้อยละ 71.5) ผู้ไกล่เกลี่ยที่เคยอบรมหลักสูตรการเจรจาไกล่เกลี่ย หรือการบริหารความขัดแย้งมีเพียงส่วนน้อย (ร้อยละ 12.2) และไม่มีผู้รู้จักแนวคิดยุติธรรมสมานฉันท์ ผลสัมภาษณ์เชิงลึกพบว่าความขัดแย้งนั้นเกี่ยวเนื่องกับผู้ป่วยเชื่อว่าความเสียหายนั้นเกิดจากการบริการ ความบกพร่องของสื่อสารหรือท่าทีของผู้ให้บริการ ส่วนอุปสรรคต่อความสำเร็จการยุติความขัดแย้งที่สำคัญ คือ ผู้บริหารความขัดแย้งขาดอำนาจตัดสินใจ แสดงออกไม่จริงใจและไม่เป็นกลาง ผู้ให้บริการทางการแพทย์ที่ไม่แสดงความเห็นใจ และรูปแบบการเยียวยาที่ไม่ตรงความต้องการกับผู้เสียหาย สอดคล้องกับกรณียุติความขัดแย้งสำเร็จพบว่าคณะผู้เสียหายได้รับเยียวยาเพียงพอ ได้รับการสื่อสารที่เข้าใจและเข้าหาสม่ำเสมอ ดังนั้นผู้บริหารควรร่วมบริหารความขัดแย้ง ให้ความสำคัญกับภาระงานและส่งเสริมพัฒนาทักษะผู้ปฏิบัติ รวมทั้งนำหลักยุติธรรมสมานฉันท์มาประยุกต์ใช้ ที่มุ่งเน้นเยียวยาให้อภัยและนำไปสู่ยุติความขัดแย้งได้

การศึกษาวิจัยนี้มีวัตถุประสงค์และข้อถกเถียงเพื่อศึกษาวิเคราะห์การก่อตัวของการเกิดสนามวาทกรรม “ความผิดเพศ” ภายใต้บริบท “สังคมนิยมชาย” ในสังคมไทย โดยมุ่งศึกษาภาคปฏิบัติการของสนามวาทกรรม “ความผิดเพศ” ในศตวรรษที่ 21 ที่เป็นการปะทะกันระหว่างชุดวาทกรรมรักต่างเพศและชุดวาทกรรมรักเพศเดียวกันแบบคู่ตรงข้าม เพื่อวิเคราะห์ความสัมพันธ์และการเกิดความเกลียดชังทางเพศวิถีที่มีต่อกลุ่มเกย์เพศชายกลุ่มต่างๆ ในสังคมไทย ผ่านการวิเคราะห์สื่อทางสังคมในรูปแบบต่าง ๆ และสื่อวัฒนธรรมป๊อป อาทิ ละครชุด ภาพยนตร์ บทเพลง หรือหนังสือ ตลอดจนการแสดงออกเชิงสัญลักษณ์อย่างเทศกาลไพรด์ รวมไปถึงการวิเคราะห์ชุดวาทกรรมทางการอย่าง “กฎหมาย” ได้แก่ ร่างพระราชบัญญัติแก้ไขประมวลกฎหมายแพ่งและพาณิชย์เพื่อการสมรสเท่าเทียม และร่างพระราชบัญญัติคู่ชีวิต ที่สังคมไทยยังคงมีปัญหาด้านตัวบทกฎหมายการเข้าถึงกระบวนการยุติธรรมและการได้รับความคุ้มครองทางสิทธิและเสรีภาพของกลุ่มเกย์ที่มีข้อจำกัด สะท้อนให้เห็นการแย่งชิงพื้นที่ทางวาทกรรมในสนามวาทกรรมความผิดเพศที่นำไปสู่การเกิดความเกลียดชังทางเพศวิถีที่มีต่อกลุ่มเกย์ ซึ่งผลการศึกษาพบว่า กลุ่มเกย์เพศชายในสังคมไทย ยังคงได้รับผลกระทบจากสนามวาทกรรม “ความผิดเพศ” โดยเฉพาะเรื่องการได้รับความคุ้มครองด้านสิทธิเสรีภาพและการเข้าถึงสิทธิตามกฎหมาย และขาดกฎหมายที่รองรับการแสดงออกและการเข้าถึงสิทธิของกลุ่มผู้มีความหลากหลายทางเพศที่นำไปสู่การเกิดความเกลียดชังทางเพศวิถีที่มีต่อเกย์เพศชายกลุ่มต่าง ๆ โดยงานวิจัยชิ้นนี้ได้สร้างคุณูปการทางวิชาการด้านการศึกษาวาทกรรมและการวิเคราะห์วาทกรรม และสร้างองค์ความรู้เกี่ยวกับความหลากหลายทางเพศ ตลอดจนสร้างความรู้ความเข้าใจด้านอาชญาวิทยาเกี่ยวกับความเกลียดชังทางเพศวิถีที่มีต่อกลุ่มเกย์ให้เกิดความชัดเจนมากยิ่งขึ้น
