This assessment report of Norwegian People's Aid (NPA) Technical Assistance to the Cambodian Mine Action Centre (CMAC)covers the period from 1996 to 2003. The objective of the assessment is to make recommendations to Technical Advisors on management issues. Facing traffic congestion in the Central Business District and enormous demands on scarce land resources by the growing number of motor vehicles, Singapore, a small island city-state the size of Seattle, embarked on a bold decision to reduce road congestion by implementing the famous Area Licensing Scheme in 1975. This was a manual system of tolls for multiple entries into the Restricted Zone. While achieving the intended effect of cutting down on the volume of vehicular traffic in the Restricted Zone, the authors (and others) found that the problem of congestion had merely shifted in time and place. The forces at play in reconstruction operations are a complex system of time phased interlocking cause and effect relationships that are not thoroughly understood. A model capable of capturing the general dynamics involved in post-conflict reconstruction would provide insight to decision makers regarding potential policy alternatives. This research effort demonstrates the viability of using systems dynamics modeling techniques to simulate the establishment of public order and safety in a post-conflict reconstruction operation (Phase IV operations). Two of the dichotomies or tensions at the heart of this profession are especially important for the themes of this special issue on restorative justice and responsive regulation. These are the relation between formal and informal helping and between care and control, or empowerment and coercion. In this article, we make a case for the importance of Braithwaite's work, especially his (2002) book, Restorative Justice and Responsive Regulation, for conceptualizing the nature of social work in relation to these dualities. The increasing reliance in the United States on state-community partner- ships to address social problems represents both new opportunities and new dangers. This article presents examples of both possibilities through a consideration of contemporary collaborations between state and nonstate actors in the development of a public response to domestic violence. This discussion provides the basis for an elaboration of a conceptual approach to public/private relationships that replaces the traditional dichotomy with a triangular relationship, of state, family and community. Family Group Conferencing In Child Welfare: Responsive And Regulatory Interfaces, Joan Pennell

A regulatory approach compels the child welfare worker to make decisions according to set procedures and prevents responding flexibly to families. Differential response is a way that child welfare is departing from legal formalism. One means is convening a family group conference (FGC) to develop a plan. John Braithwaite's regulatory pyramid assists in concep- tualizing differential response. This article reports a factor analysis of data on achievement of FGC objectives to elaborate three interfaces for fostering responsive regulation. Each interface keeps the family group at the center of planning while firmly maintaining their connections with community and government programs.

Restorative and responsive justice can be a strategy of social work practice that builds democracy bottom-up by seeing families as building blocks of democracy and fonts of democratic sentiment. At the same time, because families are sites of the worst kinds of tyranny and the worst kinds of neglect, a rule of law is needed that imposes public human rights obligations on families. The republican ideal is that this rule of law that constrains people in families should come from the people. Restorative justice has been a central tradition of justice in most, perhaps all societies prior to the emergence of the modern, central state power with its bureaucratic-professional systems and its emphasis on retribution, deterrence, and, sometimes, re- habilitation. Its revival as a new social movement in modern states offers a new paradigm for addressing the key questions in social work and social welfare of the relation of formal to informal systems of care and control, and of empowerment to coercion. Managing Social Conflict - The Evolution Of A Practical Theory, David B. Moore

The Journal of Sociology & Social Welfare

This article describes the co-evolution of a process and a theory. Through the 1990s, the process known as "conferencing" moved beyond child welfare and youth justice, to applications in schools, neighbourhoods, and workplaces. In each of these applications, conferencing has assisted participants to acknowledge and transform interpersonal conflict, as a prelude to negotiating a plan of action. Much analysis of conferencing has been linked with social theorist John Braithwaite, whose work has influenced the development of a multidisciplinary theory of these process dynamics, and the development of guiding principles. Key links between theory and practice are described in chronological sequence.

The purpose of this article is to examine the challenges inherent in trans- forming child welfare services. We apply Braithwaite's model of responsive regulation to the restorative practice of family group conferencing in child welfare. Shifting the role of the state away from controller of families in the child protective services system to one of regulatory partner with them is extraordinarily difficult. The paper looks at the complexities of reorienting child welfare services through the use of family group conferences on a large scale.

As formal systems for the protection of children have evolved in this country, certain barriers to achieving justice within the child protection system have emerged concomitantly. Specifically, these barriers involve ambiguous definitions of abuse and the appearance of social inequality and bias within the child protection system. One means of surmounting these barriers to justice is family group conferencing (FGC). Support for this assertion comes from the integration of the restorative justice model and procedural justice theory. The use of family group conferencing and related family involvement interventions in child protection is rapidly increasing in the United States and many other countries. There is some concern that the child welfare field will travel down the same road as it did with intensive family preservation services; that is, tremendous enthusiasm later derailed by rigidly designed evaluations that showed unimpressive effects. The work of John Braithwaite suggests an alternative path for finding justifiable excitement about these interventions. Based on a small, open-economy IS-LM prototype model, this paper examines the sources of macroeconomic instabilities in Hong Kong and Singapore operating under two similar cu訂ency board arrangements (CBAs). The empirical findings suggest that in general both extemal and intemal factors contribute to the macroeconomic volatilities observed in the two economies. Interestingly, whilst in Hong Kong interest rate is the single most important factor accounting for the variation in real GDP, price level and money supply, in most cases in Singapore the volatilities of these three macro variables cannot be attributed to a significant single facto r. The paper examines the sources of macroeconomic instability in Hong Kong under the linked exchange rate regime. A prototype IS-LM model is estimated, with adaptation to the restrictions posed by the US dollar peg that has been in place in Hong Kong since 1983. Among all external and internal factors of instability examined, local Hong Kong interest rate is found to have a dominant effect on real GDP, price and money supply. Over the long run, however, the US interest rate is the driving force behind the Hong Kong interest rate. Foreign inflation also affects Hong Kong's domestic demand and …

The Case For Change : A Review Of Contemporary Research On Indigenous Education Outcomes, Suzanne Mellor, Matthew Corrigan

AER 47 examines the research evidence underpinning current government policy developed over the last two decades in an attempt to improve the educational outcomes of indigenous students. It reviews and analyses existing educational research into the precursors and concomitant factors that contribute to educational achievement for students generally and for indigenous students in particular. It argues that current policy is insufficiently underpinned by substantive research, and that changes should be made, both to research methodology and to policy content.

This Policy Brief reviews judicial decisions construing state laws that permit insurers to include intoxication exclusionary clauses in their insurance policies. The cases and state laws examined in this analysis span health, life, disability, accidental death and dismemberment (AD&D), workers compensation, and unemployment insurance. Some variant of the intoxication exclusionary clause appears across all of these products, depending on the state. The widespread nature of such laws has its roots in the 1947 Uniform Accident and Sickness Policy Provision Law (UPPL), a model statute whose broader public policy purpose was to avoid the use of insurance to protect against the …

The Effects Of Ballot Position On Election Outcomes, Jonathan G.S. Koppell, Jennifer A. Steen

Publications from President Jonathan G.S. Koppell

This article presents evidence of name-order effects in balloting from a study of the 1998 Democratic primary in New York City, in which the order of candidates' names was rotated by precinct. In 71 of 79 individual nominating contests, candidates received a greater proportion of the vote when listed first than when listed in any other position. In seven of those 71 contests, the advantage to first position exceeded the winner's margin of victory, suggesting that ballot position would have determined the election outcomes if one candidate had held the top spot in all precincts.

Recent advances in plant biotechnology have led to significant changes in crop varieties and cropping systems in the United States, in particular the rapidly expanding cultivation of transgenic or genetically modified (GM) crops (Liu, 1999). Such crops, which contain artificially inserted genes, have been hailed as a major advance in agricultural technology and simultaneously condemned as a grave threat to the environment and to human health. In Europe, which represents a significant market for U.S. agricultural producers, widespread and vehement public opposition has effectively shut down importation and domestic production of GM crops, while in the U.S. public uncertainty is …
