Experts bedeviled the legal system long before seventeenth-century Salem, when the town's good citizens relied on youthful accusers and witchcraft experts to identify the devil's servants in their midst. As in Salem, claims of expertise have often been questioned and objections raised about the bases of expert knowledge. Expertise, then and now, did not have to be based on science; but the importance of science and the testimony of scientific experts has since medieval times been woven into the fabric of the English jurisprudence that Americans inherited. In cases as long ago as 1299 we find examples of courts seeking …

The Relative Effects Of Religion, Empathy, Anger, And Apology On Forgiveness, Christine P. Lopez Oct 2018

The Relative Effects Of Religion, Empathy, Anger, And Apology On Forgiveness, Christine P. Lopez

Dissertations

Researchers have begun elucidating the complex relationship between religion and forgiveness. This study examined the effects of religious measures on forgiveness beyond the variance explained by empathy, anger, and apology. Utilizing hierarchical multiple regression, this study investigated the predictive power of religious coping and Catholic religiosity on state forgiveness after controlling for the effects of the strongest known predictor variables: state empathy, state anger, and received apology. A discriminant function analysis allowed this researcher to conceptualize the religious variables further by comparing religious coping with Catholic religiosity. Parishioners from local Catholic churches were invited to participate in an online survey …

Older Adults’ Social Relations: Life Satisfaction To Widowhood, Hyunsook Kang, Bonnie Ahn Oct 2018

Older Adults’ Social Relations: Life Satisfaction To Widowhood, Hyunsook Kang, Bonnie Ahn

Journal of Human Services: Training, Research, and Practice

Abstract

The objective of this study was to examine the breadth and depth of relationships with relatives and friends and the possible implications of those relationships with regards to life satisfaction to widowhood. Data from the National Social Life, Health, and Aging Project (NSHAP) survey were used, which sampled persons 57-85 years of age (N=3005). It was hypothesized that older widowed adults have greater quality of both family and friend relationships than do older married adults. Structural Equational Modeling analysis results supported these hypotheses, revealing that older widowed adults reported higher quality of engagement in family and friend …

Evaluating The Criterion Validity And Classification Accuracy Of Universal Screening Measures In Reading, Asia Thomas Oct 2018

Evaluating The Criterion Validity And Classification Accuracy Of Universal Screening Measures In Reading, Asia Thomas

Theses and Dissertations

Educators use universal screening in the context of Response to Intervention frameworks to identify students who may be at risk for not meeting proficiency on the state assessment. Given the potential high-stakes of state tests, using accurate screening systems is critical for early remediation. Independent research is emerging on comprehensive and expensive reading screeners such as the Measures of Academic Progress (MAP), a computer adaptive test, and the Strategic Teaching Evaluation of Progress (STEP), a developmental reading assessment. The current study evaluated the criterion-related validity of MAP and STEP with a state assessment. Additionally, the utility of each screening measure …

The Effect Of Medicaid Expansion On Heart Attack Mortality, Gabrielle Epelle Oct 2018

The Effect Of Medicaid Expansion On Heart Attack Mortality, Gabrielle Epelle

Theses and Dissertations

The aim of this study is to estimate the effect of Medicaid expansion on the number of deaths from heart attacks using a difference in differences model. We modified the standard difference in differences framework to by including both state and year fixed effects to account for the fact that states expanded Medicaid at different times. Furthermore, we added state specific linear time trends as well as state unemployment rates as controls to test the robustness of the model. We obtained our data from the Center for Disease Control’s Underlying Causes of Death Database. We found that Medicaid expansion had …

Delineating Victims From Perpetrators: Prosecuting Self-Produced Child Pornography In Youth Criminal Justice Systems, Bryce Westlake Oct 2018

Delineating Victims From Perpetrators: Prosecuting Self-Produced Child Pornography In Youth Criminal Justice Systems, Bryce Westlake

Faculty Publications

Video recording technology advancements and accessibility has been paralleled by a growth in self-produced child pornography (SPCP). Although social and judicial attention has been given to instances of teenage sexting, Internet-based forms of SPCP, such as webcam/website sex tourism, have almost been ignored. While some of the proposed legislation reform has referenced video-based SPCP, the majority has focused on SPCP distributed through cellular phones; excluding that which is manifested online or through entrepreneurial efforts. The purpose of this article is to introduce non-sexting SPCP, using the case study of Justin Berry (in the United States), and to propose a broad …

Minimizing And Addressing Implicit Bias In The Workplace: Be Proactive, Part One, Shamika Dalton, Michele Villagran

Faculty Publications

Librarians and information professionals cannot hide from bias: a prejudice for or against something, someone, or a group. As human beings, we all have biases. However, implicit biases are ones that affect us in an unconscious manner. Awareness of our implicit biases, and how they can affect our colleagues and work environment, is critical to promoting an inclusive work environment. Part one of this two-part article series will focus on implicit bias: what is implicit bias, how these biases affect the work environment, and best practices for reducing these biases within recruitment, hiring, and retention in the library workplace.

This report details the methods and results of the economic impact analyses for each of Montana’s travel regions, as well as analyses for counties in which nonresident travelers spent approximately $50 million or more.

Academic Librarians And Labor Unions: Attitudes And Experiences, Ian Mccullough Oct 2018

Academic Librarians And Labor Unions: Attitudes And Experiences, Ian Mccullough

Research, Publications, and Presentations

This research project investigates librarians’ attitudes toward unions and collective bargaining through data collected from a nationwide survey of 359 academic librarians in the United States. We found that academic librarians have a generally positive view of unions and collective bargaining agreements, a notable result in a national political atmosphere that is demonstrably anti-union. Union membership is strongly bound to faculty status. Our research results imply that unionization and collective bargaining provide stronger job protections and higher wages than faculty status alone, and suggest that discussions of faculty status in academic libraries may not have provided best possible way to …

The Theology Of Reconciliation As A Contemporary Political Theology: The Present State Of The Balkan Region And Its Possible Outcomes, Sergej Beuk Oct 2018

The Theology Of Reconciliation As A Contemporary Political Theology: The Present State Of The Balkan Region And Its Possible Outcomes, Sergej Beuk

Occasional Papers on Religion in Eastern Europe

The article aims not only to give an insight into the theological premises of the problem of reconciliation, but it also suggests the practical implementation of this theology within the body of the public policies of the countries of the West Balkans. I have tried to clarify elementary terms inherent in both post-conflict and contemporary theology, especially prominent within the theology of reconciliation which revolves around searching for possible solutions for a lasting and a viable peace. The theology of reconciliation should not remain within the scope of academic speculation, but it should be implemented by religious organizations as a …

Is Article 16(3) Of The Model Law A ‘One-Shot Remedy’ For Non-Participating Respondents In International Arbitrations?, Darius Chan

Research Collection Yong Pung How School Of Law

It is not uncommon for practitioners acting for claimants in an arbitration to encounter a respondent who chooses to boycott the arbitral process. In cases involving such “non-participating” respondents, what are the rights and obligations of each party? Specifically, insofar as Model Law jurisdictions are concerned, if a tribunal decides on jurisdiction as a preliminary issue must the non-participating respondent apply under Article 16(3) of the UNCITRAL Model Law on International Commercial Arbitration (Model Law) to the curial Court to review that decision, or otherwise lose the right to challenge any eventual award thereafter on jurisdictional grounds? Can the non-participating …

Research Collection Lee Kong Chian School Of Business

Social thermoregulation theory posits that modern human relationships are pleisiomorphically organized around body temperature regulation. In two studies (N = 1755) designed to test the principles from this theory, we used supervised machine learning to identify social and non-social factors that relate to core body temperature. This data-driven analysis found that complex social integration (CSI), defined as the number of high-contact roles one engages in, is a critical predictor of core body temperature. We further used a cross-validation approach to show that colder climates relate to higher levels of CSI, which in turn relates to higher CBT (when climates get …

Is Collective Memory Making The Next Balkan War Imminent?, Nikola Knežević

Occasional Papers on Religion in Eastern Europe

Sometimes cultures, religions, and ethnicities that shared the same space for centuries become fierce rivals, forcing their irreconcilable differences to develop to such an extent that they see war as the only option. The Balkans has had its share of conflicts, destruction, and atrocities leaving scars too deep to heal. The question is: have they seen the end of it, or will the frozen conflict lurking beneath the fragile peace unleash its deadly force again?

In December 2017, Sufi Muslim Rashad Abidov, whose home in the northern town of Sheki was raided by police during a religious meeting, managed to overturn the large fine he was handed down for holding a meeting without state permission. Police had brought the case against him rather than the officials of the State Committee for Work with Religious Organizations.

Information Technology System Failure And Value Of Airlines: A Case Study Of Airlines In 2016, Jayendra Gokhale

Publications

Technology is a critical component of a firm’s operations. Technology failures can cause widespread problems in airlines. These failures cause disruptions in flight schedules, cause passengers to be stranded at airports and also increase airline operating costs. The objective of this study is to measure an effect of information technology failures on the firm value of passenger airline companies during the year 2016. In that year, there were cases involving delays and cancellations associated with JetBlue, Southwest, Delta, American, and Virgin America that received significant media coverage. Using the event study methodology, this study finds that the intensity of failures …

Reducing Vulnerabilities Among Female Migrants In The United States And Spain, Rachel Newcomb, Sarajane Renfroe

Faculty Publications

Migrants who establish connections in the host culture, particularly through nonprofit organizations, are more likely to integrate successfully into host societies (Martinez Garcia and Jariego 2002). Yet, anthropologist Maria Olivia Salcido and sociologist Cecilia Menjívar have noted, “gender hierarchies are embedded in the formulation, interpretation, and implementation of immigration laws, as experienced by immigrants” (2013:336). Our research, which compares two field sites in Apopka, Florida and Barcelona, Catalonia, demonstrates that despite the presence of vibrant organizations in both places, legal barriers in the U.S. hamper social integration by preventing women from accessing basic services necessary for survival. The criminalization of …
