Why I So Enjoyed Learning With And From Calvin Massey, Vikram David Amar Feb 2017

Why I So Enjoyed Learning With And From Calvin Massey, Vikram David Amar

The University of New Hampshire Law Review

[Excerpt] “I am pleased and proud to participate in this tribute to Calvin Massey, with whom I had the pleasure to work and play for about two decades. When I think of Calvin—and I think of him often—I think of a generous friend, a gregarious colleague and a genuinely good man. He possessed many admirable traits, but today I want to focus on three: (1) his breadth; (2) his independent mind; and (3) his thoughtfulness.”

Calvin Massey: Gentleman And Scholar, Ashutosh Bhagwat Feb 2017

Calvin Massey: Gentleman And Scholar, Ashutosh Bhagwat

The University of New Hampshire Law Review

I first met Calvin Massey in person in 1994, when I joined the U.C. Hastings faculty. However, I knew of and admired Calvin’s scholarship long before that. Six years earlier, I was a law student at the University of Chicago, and a student editor at the law review. In that role, I helped cite-check and edit a major article authored by Calvin, as well as a series of short responses by Calvin and other scholars, debating the meaning and scope of the Eleventh Amendment to the U.S. Constitution. I was struck then, and continue to be amazed, by the clarity, …

Southern Border Recession Predictability In The United States: 1990-2015, Thomas M. Fullerton Jr., Elías D. Saenz-Rojo, Adam G. Walke Feb 2017

Southern Border Recession Predictability In The United States: 1990-2015, Thomas M. Fullerton Jr., Elías D. Saenz-Rojo, Adam G. Walke

Border Region Modeling Project

Prior research establishes that the spread between long- and short-term bond yields often provides valuable information for predicting business cycle downturns. This study examines the predictive capacity of the yield spread for United States metropolitan economies situated along the border with Mexico. Because of the location of these urban economies and various economic ties linking them with twin cities across the border, the Mexico yield spread, and the real dollar/peso exchange rate are also employed as potential recession predictors. Results suggest that a flattening of the yield curve for either country tends to increase the probability of recessions in border …

Educating Incarcerated Youth In Illinois: A Blended Learning Model, John Sonnenberg Feb 2017

Educating Incarcerated Youth In Illinois: A Blended Learning Model, John Sonnenberg

Dissertations

The purpose of this case study was to better understand the reasons behind the apparent continued success of a blended learning educational model in place since 2012 in the Illinois Department of Juvenile Justice (IDJJ). Using a mixed methods approach, data were gathered and analyzed from a variety of records, reports, and other documentation that included: diplomas awarded, courses taken, course completion, enrollment trends, student mobility rates, GED testing information, and special education student enrollment and performance. Data were also gathered through classroom observations and individual and group interviews with the IDJJ district superintendent, principals, and teachers at six different …

The Fear Factor: Exploring The Impact Of The Vulnerability To Deportation On Immigrants' Lives, Shirley P. Leyro Feb 2017

The Fear Factor: Exploring The Impact Of The Vulnerability To Deportation On Immigrants' Lives, Shirley P. Leyro

Dissertations, Theses, and Capstone Projects

This qualitative study explores the impact that the fear of deportation has on the lives of noncitizen immigrants. More broadly, it explores the role that immigration enforcement, specifically deportation, plays in disrupting the process of integration, and the possible implications of this interruption for immigrants and their communities. The study aims to answer: (1) how vulnerability to deportation specifically impacts an immigrant’s life, and (2) how the vulnerability to deportation, and the fear associated with it, impacts an immigrant’s degree of integration. Data were gathered through a combination of six open-ended focus group interviews of 10 persons each, and 33 …

The Relationship Between Non-Traditional Instructional Strategies And The Multicultural Competence Of School Psychologists, Jacqueline Kluger Feb 2017

The Relationship Between Non-Traditional Instructional Strategies And The Multicultural Competence Of School Psychologists, Jacqueline Kluger

Dissertations, Theses, and Capstone Projects

School psychology training programs have taken on the great responsibility of preparing practitioners who are culturally competent and able to provide effective services to a diverse range of students, families, schools, and communities. Literature in the related fields of counseling psychology and teacher training show evidence of the effectiveness of multicultural training on trainees’ and practitioners’ cultural competence, with some evidence that the instructional methods used in courses and workshops play a role in outcome. There is to date a dearth of research available in the school psychology literature to provide guidance to trainers and program administrators as to the …

Joseph Beuys And Social Sculpture In The United States, Cara M. Jordan Feb 2017

Joseph Beuys And Social Sculpture In The United States, Cara M. Jordan

Dissertations, Theses, and Capstone Projects

Alongside the rise of the activist movements in the late 1960s, the German artist Joseph Beuys (1921–1986) proposed his concept of “social sculpture” — a method of fostering creativity, aimed at transforming society through interdisciplinary dialogue — as an alternative to the chaotic political, economic, and social life of postwar West Germany. He sought to heal society through a work of art with holistic and spiritual intentions, centered on the belief that art can include the entire process of living and therefore can be created by a wide range of people beyond artists. Although his ideas are understood and even …

Warmth And Competence Traits: Perceptions Of Female And Male Nurse Stereotypes, Randolph E. Gross Feb 2017

Warmth And Competence Traits: Perceptions Of Female And Male Nurse Stereotypes, Randolph E. Gross

Dissertations, Theses, and Capstone Projects

A nursing shortage looms ahead; 1.03 million new nurses will be needed by 2022 to meet society's healthcare needs. A major barrier to recruitment of women and men are nurse stereotypes. The literature suggests four female and four male stereotypes exist; however, no quantitative research exists that explores perceptions of non-nursing undergraduate students. Approximately, 90% of college students do not consider nursing as a career option, and 72% have misconceptions of what nurses do in reality.

According to social cognitive theory's Stereotype Content Model (SCM), perceptions are viewed through a combination of two dimensions: warmth and competence. The author devised …

Decidedly Uncertain, Sophia I. Varosy Feb 2017

Decidedly Uncertain, Sophia I. Varosy

Dissertations, Theses, and Capstone Projects

My capstone project is meant to reflect the ideas I’ve been exposed to and the ways in which they have, as a consequence, influenced my life; the ways, I suppose, I can apply them. Over the course, or courses (literally), of my time spent at The CUNY Graduate Center, I felt (mostly) enthusiastic about the ideas and philosophies I was growing to at-least-marginally understand. However, as time passed I became increasingly more unsettled about my position as an “academic.” In other words, I found that I was moved and motivated to increase my understanding of things, but never did I …

The Legitimacy Of Global Legal Governance: Institutional Power And Human Rights Bias In International Criminal Justice, Martin J. Burke Feb 2017

The Legitimacy Of Global Legal Governance: Institutional Power And Human Rights Bias In International Criminal Justice, Martin J. Burke

Dissertations, Theses, and Capstone Projects

As global legal governance institutions exercise increasing coercive power, including through the prosecution and incarceration of individuals, such institutions require greater legitimacy. An essential but often overlooked source is the right of the accused in mass-atrocity trials to effective legal protection, which constitutes a “legal legitimacy” based on liberal norms of criminal justice. The two most important sources of legal legitimacy are: “legality,” that is, the non-retroactive enforcement of crimes and punishment; and “defense parity,” institutional and procedural guarantees of substantive equality between the defense and prosecution before and during trial. The dissertation argues that the implementation of defendant rights …

Who Am I To You? Using Function Words As A Measure Of Transference, Jon William P. Lentz Feb 2017

Who Am I To You? Using Function Words As A Measure Of Transference, Jon William P. Lentz

Dissertations, Theses, and Capstone Projects

There is a gap in our understanding of transference resolution as an aspect of therapeutic process and its relation to observable changes in language. My hypotheses can contribute to this area by identifying whether there are detectible changes in pronoun use in a psychoanalysis that are related to the resolution of transference. Data: The de-identified transcripts of a young agoraphobic housewife in a four time a week then two time a week psychoanalysis from the 1970s. Method: The Linguistic Inquiry and Word Count software will be used to measure structural changes in language that may reflect intrapsychic changes in the …

Housing Market Liquidity And The Effect On Unemployment In The United States: An Application To The U.S. Housing Market, Isolating Regional Housing Market Liquidity And The Associated Effect On Unemployment, Lindsey M. Piegza Feb 2017

Housing Market Liquidity And The Effect On Unemployment In The United States: An Application To The U.S. Housing Market, Isolating Regional Housing Market Liquidity And The Associated Effect On Unemployment, Lindsey M. Piegza

Dissertations, Theses, and Capstone Projects

This study proposes a measure of price spread between the bid (or the offer price from the buyer) and the ask (or the list price of the seller) in order to isolate the effect of housing market liquidity on unemployment. Housing market liquidity is defined as its impact on labor market equilibrium and unemployment at the state and regional levels. This proxy for housing market liquidity offers a more thorough measure of housing liquidity or market clearing ability compared with the current literature, which has relied on price or price changes alone as the primary measure of activity in the …

American Civil Associations And The Growth Of American Government: An Appraisal Of Alexis De Tocqueville’S Democracy In America (1835-1840) Applied To Franklin D. Roosevelt's New Deal And The Post-World War Ii Welfare State, John P. Varacalli Feb 2017

American Civil Associations And The Growth Of American Government: An Appraisal Of Alexis De Tocqueville’S Democracy In America (1835-1840) Applied To Franklin D. Roosevelt's New Deal And The Post-World War Ii Welfare State, John P. Varacalli

Dissertations, Theses, and Capstone Projects

In Democracy in America, Alexis de Tocqueville (1805-1859), a French aristocrat, intellectual, and commentator on American society during the 1830’s, described the United States as a society marked by a general “equality of condition,” that is, by a lack of noticeable social and economic distinctions among the citizenry. For Tocqueville, this characteristic of democracy encouraged the formation of an informal political bloc he termed “the majority” - a group who would often elect demagogues to political offices, since the latter were best able to give voice to majority opinion. Furthermore, de Tocqueville believed that this group was not only …

Essays On The Law Of One Price In Financial Markets And The Recent Financial Crisis, Igor Sorkin Feb 2017

Essays On The Law Of One Price In Financial Markets And The Recent Financial Crisis, Igor Sorkin

Dissertations, Theses, and Capstone Projects

Essay 1: The theory of the Law of One Price (LOOP) is one of the most important theories in International Economics. I use financial markets to revisit the validity of the LOOP in the short run, and then extend the analysis into the long-run to examine whether events such as the Financial Crisis of 2007-2009 can lead to the failure of the LOOP or worsen deviations from it. Using the data on Canadian companies cross-listed on the New York Stock Exchange, I find strong support that the LOOP holds in a cross-sectional framework despite the fact that the sample includes …

Imagining Basic Income As An International And Domestic Remedy To Wealth Inequality, Christian A. Davis Feb 2017

Imagining Basic Income As An International And Domestic Remedy To Wealth Inequality, Christian A. Davis

Dissertations, Theses, and Capstone Projects

Has the success of corporate capitalism undermined the neoliberal ideas it presupposes, leading to the inevitable growth of socialism? While labor unions may lament the export of jobs, the real issue in today’s increasingly administered and mechanized economy is the global loss of jobs. James Ferguson has provided a strong argument that despite the triumphalist narratives of neoliberalism, capitalist development strategies particularly in South Africa have resulted in concentrated wealth, large unemployment, and the growth of transfer payments. More importantly, he shows how traditional critics of capitalism fall short in addressing the issues of a jobless future. For example, Marxists …

The Dream Deferred: The School-To-Prison Pipeline And The Destruction And Potential Resurrection Of The Black Male, Alexandria L. Timoll Feb 2017

The Dream Deferred: The School-To-Prison Pipeline And The Destruction And Potential Resurrection Of The Black Male, Alexandria L. Timoll

Dissertations, Theses, and Capstone Projects

In American society, Black boys are both “at-risk” for academic failure and for having their dreams deferred. The label at-risk is a larger consequence of the commonly portrayed image of the Black male as a criminal within American society. Unfortunately, what is thought of as the great equalizer, education and schooling, also plays a significant role in the criminalization of Black males. In schools, their intersectionality on measures of socioeconomic and special education status, race, and gender renders them susceptible to the thwarting effects of the school-to-prison pipeline. Through this paper I argue that (1) the education- related causes of …

Why Do Negative Employment Outcomes For Workers With Disabilities Persist?: Investigating The Effects Of Human Capital, Social Capital, And Discrimination, Martine Maculaitis Feb 2017

Why Do Negative Employment Outcomes For Workers With Disabilities Persist?: Investigating The Effects Of Human Capital, Social Capital, And Discrimination, Martine Maculaitis

Dissertations, Theses, and Capstone Projects

Little is known about why poor job outcomes for workers with disabilities (WD) persist. Hence, the aim of this study was to combine and extend human capital, social capital, and multiple jeopardy advantage theories to develop and test a comprehensive model of the processes explaining job outcomes for WD. Data from the 2010 US National Health Interview Survey (N=3,887) and O*Net were analyzed to investigate the extent to which disability status (i.e., WD with work limitations, WD with no work limitations, or non-disabled workers [NDW]) relates to four types of work outcomes (i.e., annual compensation, employment status, job …

Land Change History Of Oil Palm Plantations In Northern Bengkulu Province, Sumatra Island, Reconstructed From Landsat Satellite Archives, Atsushi Tomita Feb 2017

Land Change History Of Oil Palm Plantations In Northern Bengkulu Province, Sumatra Island, Reconstructed From Landsat Satellite Archives, Atsushi Tomita

Dissertations, Theses, and Capstone Projects

The aim of this study is to reconstruct the history of land conversion to oil palm plantation in tropical Asia using multi-temporal satellite data. A new method was constructed with a newly developed computer model, Land Change Detection and Land Definition Model (LC/LD Model) to map out spatio-temporal distribution of land changes. A comprehensive, cloud-free Landsat dataset was created from all the available Landsat data from 1988 to 2015. The pixel-based dataset was converted into a polygon-based dataset by applying the multi-temporal image segmentation method. The representation of the spectral information was also reduced to a single index of IB45, …

The Fantastic Manifesto: Monstrosity Of Memory And Epiphany Of Selfhood In The Spirit Of The Beehive (1973), Layla Blodgett Carrillo Feb 2017

The Fantastic Manifesto: Monstrosity Of Memory And Epiphany Of Selfhood In The Spirit Of The Beehive (1973), Layla Blodgett Carrillo

Dissertations, Theses, and Capstone Projects

The Spanish culture of storytelling suffered under the nearly forty-year dictatorship of Francisco Franco. The government-regulated cinema welcomed propaganda and melodrama, and denied the fantastic, the legendary, and the magical. These carefully manipulated histories, which served to romanticize the ideologies of the regime, also served to eulogize the delinquent and the depraved. In the early 1970s, at the heels of the collapse of Franco’s reign, the people of Spain bore witness to a new national cinema. The Spirit of the Beehive (1973), the feature debut from Victor Erice, exists at the threshold between a storied history of Spanish dictatorship and …

Three Essays On Fiscal Policy, Sinem Buber Singh Feb 2017

Three Essays On Fiscal Policy, Sinem Buber Singh

Dissertations, Theses, and Capstone Projects

This dissertation examines the domestic and international effects of fiscal policy shocks on country risk, stock markets returns and trading partners. There are three essays in this study.

First essay examines the relative impacts of macroeconomic, financial and political variables on country risk for five advanced economies; the US, the UK, Canada and Singapore for 1984:M1-2014:M12 and Germany for 1990:M9-2014:M12 time periods. To do so, I follow a two stage estimation procedure. In the first stage, a CAPM is used to estimate time-variant country betas which are used as a proxy for country risk by using a DCC-GARCH model. Then, …

Retelling An Old Wife’S Tale: Postpartum Care Of Taiwanese And Chinese Immigrant Women, Kuan-Yi Chen Feb 2017

Retelling An Old Wife’S Tale: Postpartum Care Of Taiwanese And Chinese Immigrant Women, Kuan-Yi Chen

Dissertations, Theses, and Capstone Projects

The focus of this dissertation is the Chinese postpartum tradition zuoyuezi, often translated into English as doing-the-month. Having its roots in ancient China, this set of practices has maintained its salience today in Taiwan, China, and among first generation immigrant women in the U.S. Women not only continue to perform zuoyuezi at home, many also rely on emerging forms of commodified care. While immigrant women’s postpartum wellbeing and care has been the focus of scholarly research in health related fields, studies in the social sciences addressing immigrant women’s postpartum practices and the care relations engendered remain scant.

In this …

The Impact Of Social Dominance Orientation On Experienced Threat And Consequent Interviewer Discriminatory Behavior: A Psychophysiological Approach, John F. Capman Feb 2017

The Impact Of Social Dominance Orientation On Experienced Threat And Consequent Interviewer Discriminatory Behavior: A Psychophysiological Approach, John F. Capman

Dissertations, Theses, and Capstone Projects

Though the representation of Black males within lower echelons of organizations has increased since the inception of Title VII (CRA 1964), Black males continue to be highly underrepresented in management-level roles (EEOC, 2015). The current study was developed to examine how social dominance orientation (SDO) among White males (Sidanius & Pratto, 1994) might disadvantage Black males attempting to advance into management jobs. Additionally, I evaluated the role of threat in contributing to discrimination against Black males by directly assessing threat responses among Organizational Decision Makers (ODM) using psychophysiological measures (i.e., cardiovascular responses). Male and female participants were recruited to participate …

Sex Differences In The Anxiety Effects Of Cannabinoids, Helen T. French Feb 2017

Sex Differences In The Anxiety Effects Of Cannabinoids, Helen T. French

Dissertations, Theses, and Capstone Projects

Aim: Anxiety disorders are twice as common among women, and those with anxiety disorders are 2-3 times more likely to have a substance abuse disorder than the general populace. However, little data exists on the sexually dimorphic effects of cannabinoids. In male humans and rodents, low acute doses of cannabinoids are anxiolytic while high and/or chronic doses are anxiogenic. In the dose response curve (DRC), we examined whether the biphasic effects of cannabinoids observed in males are also present in females. In the CB1R antagonism study, CP55,940-induced CB1R activation was antagonized via the CB1R-selective antagonist rimonabant to test the hypothesis …

Estradiol, Substance P, And The Pi3k-Akt-Mtor Pathway In The Dorsal Horn Of The Spinal Cord During Inflammatory Pain, Zane Ferguson Feb 2017

Estradiol, Substance P, And The Pi3k-Akt-Mtor Pathway In The Dorsal Horn Of The Spinal Cord During Inflammatory Pain, Zane Ferguson

Dissertations, Theses, and Capstone Projects

Pain is a critical survival mechanism that signals potential or actual damage, but it can become pathological when it persists beyond the injury. Chronic pain is a major health issue that affects 10-20% of the adult population and is found disproportionately in women. There are numerous, interacting mechanisms underlying this phenomenon. This study used female rats to investigate the impact of estrogens on sensory signaling by substance P, a neuropeptide that contributes to the development of chronic pain, and the PI3K-Akt-mTOR pathway, an intracellular mechanism of nervous system plasticity.

Capitalism And Unfreedom: Louis D. Brandeis And A Liberty Of The Left, Eric L. Apar Feb 2017

Capitalism And Unfreedom: Louis D. Brandeis And A Liberty Of The Left, Eric L. Apar

Dissertations, Theses, and Capstone Projects

The American Right features a well-developed—and well-heeled—infrastructure for promoting a conception of freedom as inextricable from capitalism. The American Left, by contrast, has seemed content to cede the territory, abandoning the ground of freedom for the terrain of “equality,” “justice,” “fairness,” and “prosperity.” This paper is an effort to address this asymmetry in the public discourse over the meaning of freedom. Its principal objective is to capture the vision of freedom embodied in the political and economic thought of Louis D. Brandeis, one of the American Left’s ablest expositors of freedom.

In addition, the paper has three subsidiary objectives. The …

Stress As A Cultural Tool In Higher Education, Nadia Ramjit Feb 2017

Stress As A Cultural Tool In Higher Education, Nadia Ramjit

Dissertations, Theses, and Capstone Projects

This study focuses on how two groups of college freshmen, the traditional age and nontraditional age students use the word stress as a cultural tool in their college adjustment process. This topic is explored through Vygotsky’s concept of language understood as a cultural tool, enacting meaning as developed through socio-cultural relations (1978). Three research questions explore how students articulate stress in diverse ways: How do traditional and nontraditional college freshmen use the word stress as a cultural tool to mediate their experiences in the college environment: academically, socially, personally, regarding goal commitments, etc.? What are the factors that traditional and …

The Failure Of Post-War Reconstruction In Jaffna, Sri Lanka: Indebtedness, Caste Exclusion And The Search For Alternatives, Ahilan Kadirgamar Feb 2017

The Failure Of Post-War Reconstruction In Jaffna, Sri Lanka: Indebtedness, Caste Exclusion And The Search For Alternatives, Ahilan Kadirgamar

Dissertations, Theses, and Capstone Projects

Reconstruction of contemporary war-torn societies can lead to further dispossession and social exclusion, particularly through neoliberal development policies and financialized indebtedness. This dissertation analyses post-war reconstruction of the Jaffna District in the Northern Province of Sri Lanka after the end of a brutal three decade long civil war in May 2009, through a survey and ethnographic study of one village, Pathemany and its oppressed caste quarter, Bharathy Veethy. Drawing on a study of Pathemany village on agrarian change before the war, this study addresses contemporary questions about land, rural incomes, rural debt and caste structure. The study evaluates reconstruction policies …

Production Of Energy And Environmental Protection As A Prerequisite For Sustainable Development, Diana Baus Feb 2017

Production Of Energy And Environmental Protection As A Prerequisite For Sustainable Development, Diana Baus

Dissertations, Theses, and Capstone Projects

This paper explains why renewable energy is a prerequisite for sustainable development. The development of renewable energy sources is important because renewable energy sources have a very important role in reducing emissions of carbon dioxide (CO2) into the atmosphere, eradicate poverty and increase the employment rate. In the first section the paper introduces renewable energy sources. The focus is on the function of solar energy, wind power, biomass, geothermal energy, and hydroelectric energy and their implementation globally. The second part of the paper elaborates on the economic, political, and social aspects for the development of renewable energy sources. …

Contesting Victimhood: A Linguistic And Legal Anthropological Analysis Of Defendant Experiences In New York’S Human Trafficking Intervention Courts, Mark T. Romig Feb 2017

Contesting Victimhood: A Linguistic And Legal Anthropological Analysis Of Defendant Experiences In New York’S Human Trafficking Intervention Courts, Mark T. Romig

Dissertations, Theses, and Capstone Projects

Human Trafficking Intervention Courts (HTICs) have been operating in New York City in an effort to connect victims of human trafficking to treatment programs. Unfortunately, the net that the courts cast was too wide and people who did not identify as victims of human trafficking were coerced into treatment programs that they did not need or want. Through textual discourse analysis and ethnographic observation, this paper explores the contestation of victimhood in HTICs by focusing on the experiences of defendants and how they are perceived by the police, judges, and other agents of the HTICs. Before entering the HTICs, defendants …
