The affinity of international law to natural law goes back a long way to the classic writers of international law. "Natural law" is the method of dispute resolution based on a conscious attempt to perpetuate past similarities in dispute resolution. "International law" has a deep affinity to this natural law method, for it consists of those practices that have "worked" in inter-nation conflict resolution.

A growing number of legal scholars have recently revived the American legal realist thesis that legal theory does not dictate the result in any particular case because legal theory itself is indeterminate. A more radical group has added that theory can never constrain judicial practice. I will present a spectrum of types of legal theories to demonstrate that the position of the more radical group of writers is correct—that legal theory is inherently incapable of identifying which party should win any given case.

Churchill had been given at least forty-eight hours' warning that Coventry would be hit. He could have warned the people of Coventry of the impending attack. Yet Churchill determined that any advance warning to the people of Coventry would have enabled the Germans to deduce that their top secret code had been broken. The coded intercepts provided evidence of the Holocaust in progress. Other ways to reveal information that could have by-passed the code system existed, thus providing warning to the public while maintaining a strategic advantage. We will only be disappointed if we think that a world conference is supposed to solve problems. Is there any point in getting a lot of people together, at great expense, just to address a problem without any prospect of solving it? My answer is a qualified yes. The Speluncean Explorers--Further Proceedings, Anthony D'Amato

Lon L. Fuller's The Case of the Speluncean Explorers is a classic in jurisprudence. The case presents five judicial opinions which clash with each other and produce for the reader an exhilarating excursion into fundamental theories of law and the state and the role of courts vis-i-vis legislatures and executives. Though the issues articulated by Fuller are timeless, the past thirty years in jurisprudential scholarship have produced at least one major new vantage point—the "rights thesis".

Legal certainty decreases over time. Rules and principles of law become more and more uncertain in content and in application because legal systems are biased in favor of unravelling those rules and principles. In this article I attempt to show what these biases are, and why commentators who have argued that the law tends toward certainty are wrong, then describe various attempts which have been made at restoring certainty, and why these attempts have generally not worked. My conclusion is that these proposals are at best holding actions, and that the tendency toward increasing uncertainty in the law is inexorable.

Comments on Westen article The Empty Idea of Equality. The only way we know what direction to move in making reductions and increases in burdens is to have a concept of equality in mind. The only way we can know that one burden is 'great' and another burden is 'considerably lesser,' to use the words in Westen's standard, is to compare the burdens. But comparison presupposes a measure of equality, for we cannot know that one burden is greater than another unless we first have a concept of when the two burdens are equal. Now more than ever in making decisions about water, including the protection of source water, there is concern about the process and context in which decisions are made. Historically, government agencies have dominated decision making using a top down approach. More recently, however, a wider array of participants is included in water-related decision making processes. Goals underlying this shift can include democratizing the process, adding legitimacy to the outcomes, strengthening the capacity of local communities, and increasing likelihood of plan implementation.

In January 2008, Nebraska Governor Dave Heineman hosted the Governor’s Summit for Expanded Learning Opportunities. The Summit explored collaborative efforts of schools and community leaders to create expanded learning opportunities for Nebraska’s children and youth. Following the event, Governor Heineman asked the Nebraska Children and Families Foundation and the Nebraska Community Learning Centers Network to map funding for expanded learning opportunities in Nebraska.

Begun in 2006, the Fusion Project connects new refugees and their communities with local community resources in Lincoln, Nebraska. One of three goals of the Fusion Project is equipping Lincoln’s mainstream community to work with four refugee communities: African, Asian, Eastern European, and Middle Eastern. The University of Nebraska Public Policy Center evaluated the Fusion Project with respect to this goal using the information gathered through two facilitated focus groups. Personalised Travel Planning, a form of mobility management planning targeted at the trip-origin (in other words at residential areas), has proved to be a reliable and cost-effective means of reducing car usage in favour of other more sustainable travel forms. These direct-marketing schemes, which target communities with individually tailored travel information materials, succeed in reducing car usage with no investment in hard infrastructure. The concept, when subjected to rigorous academic and other independent scrutiny, has reportedly achieved consistent mode transfers away from car-usage of five to fifteen per cent. Purpose – This paper seeks to offer a rationale and practical suggestions for the integration of visual literacy instruction and information literacy instruction practice and theory.

Design/methodology/approach – The paper aligns visual literacy and information literacy competency standards, revealing connections and opportunities for practical integration during library instruction and traditional classroom instruction.

Findings – On analysis of 11 visual literacy competencies, three exhibit a strong relationship with the ACRL's Information Literacy Competency Standards.

Persons with dementia experience continual declines in a number of abilities. Language abilities are particularly hard hit and become increasingly impaired as the underlying disease progresses. These language impairments make verbal communication very challenging for family and professional caregivers. As a result, caregivers may inadvertently punish verbal behavior, thereby exacerbating the deterioration of verbal repertoires. Although the topography of language impairments associated with dementia have been well described, less empirical work has been conducted concerning how to minimize these impairments and their deleterious effects. Graduate students in economics are often introduced to some very useful mathematical tools that many outside the discipline may not associate with training in economics. This essay looks at some of these tools and concepts, including constrained optimization, separating hyperplanes, supporting hyperplanes, and ‘duality.’ Applications of these tools are explored including topics from machine learning and bioinformatics.

Family Coping As A Protective Factor For Poor Children, Catherine Decarlo Santiago

Electronic Theses and Dissertations

This study examined family influences on coping and adjustment among 90 low-income Latino middle school children (46% Female; Average age = 11.38, SD = .66) and their primary caregivers (93% Female; Average age = 36.12, SD = 6.13). All participants identified as Hispanic/Latino, with 75% of families identifying as Mexican-origin Latino, 77% of parents identifying as immigrants, and 32% of children identifying immigrants. All children participating in the study were receiving free or reduced lunch, a poverty indicator. Hierarchical linear modeling analyses revealed that family reframing is related to fewer symptoms of psychopathology and that familism enhances the protective effect …
