Deference Under The Separation Of Powers: An Increasingly Acceptable Trait Amongst The Irish Judiciary?, Philip Smith Jun 2010

Deference Under The Separation Of Powers: An Increasingly Acceptable Trait Amongst The Irish Judiciary?, Philip Smith

Dissertations

Deference refers to a certain respect or esteem which is due to a superior or an elder or a tendency of inferiors to acknowledge the legitimacy of superiors’ powers. It is a concept which is becoming increasingly popular in the works of legal commentator’s as of late. This is a direct result of the growing perception that it is a trait which is becoming synonymous with the Irish Judiciary.

The object of this research is to examine whether this accusation is true i.e. have our Superior Courts changed their mindset and adopted a more deferential stance than they used to exhibit. …

Spanish Missions In The Indigenous Landscape:A View From Mission Santa Catalina,Baja California, Lee M. Panich

Faculty Publications

Mission Santa Catalina was founded on the margins of the Spanish colonial frontier in northern Baja California, but over time it became an important place in the indigenous landscape of the region. Dominican friars established the mission at a crossroads of native interaction, and recent archaeological, archival, and ethnographic research suggests that indigenous mission neophytes continued to engage in dynamic social and economic relationships with other native groups throughout the colonial period. At the same time, however, the diverse native peoples who lived at Santa Catalina formed new bonds to each other and to the lands around the mission itself. …

Predicting Community College Tuition And Enrollments And Simulating The Initial Effects Of President Obama's American Graduation Initiative, Allison Frederick Jun 2010

Predicting Community College Tuition And Enrollments And Simulating The Initial Effects Of President Obama's American Graduation Initiative, Allison Frederick

Undergraduate Economic Review

This paper will identify the effects of supply and demand side factors on community college enrollment quantities and tuition prices and predict the initial effects of President Obama’s American Graduation Initiative. This bill proposes $12 billion of government spending, through grants and financial aid, in order to increase the number of community college graduates by 5 million over the next ten years. Limitations regarding the endogeneity of government appropriations prevents the forecasting of government funding increases; however, the model predicts that financial aid increases from the American Graduation Initiative will increase community college enrollments by over half a million.

White Supremacy Culture : A Barrier To Career Upward Mobility For Malaysian Employees In Multinational Corporations (Mncs)?., Chong Kean Woon

Student Works (2010-2019)

This study examines factors that influence White Supremacy Culture, a potential modern discrimination within multinational companies (MNCs) local subsidiaries in Malaysia. Over the years, Malaysia foreign direct investments (FDI) grew substantially, with MNCs from the United States and countries from the Europe being the important sources of Malaysian FDI. As a result, the use of white expatriates from the western countries to hold key posts in local subsidiaries has increased, with the aim to facilitate managerial and technical development as well as knowledge transfer to Malaysians. However, as time goes by, the decision power and autonomy of the local subsidiaries …

Data provenance graphs are form of metadata that can be used to establish a variety of properties of data products that undergo sequences of transformations, typically specified as workflows. Their usefulness for answering user provenance queries is limited, however, unless the graphs are enhanced with domain-specific annotations. In this paper we propose a model and architecture for semantic, domain-aware provenance, and demonstrate its usefulness in answering typical user queries. Furthermore, we discuss the additional benefits and the technical implications of publishing provenance graphs as a form of Linked Data. A prototype implementation of the model is available for data produced …

Design, Planning, And Evaluation Of Upgraded Cattle Handling Facility, Lindsey Kaeli Tulloch Jun 2010

Design, Planning, And Evaluation Of Upgraded Cattle Handling Facility, Lindsey Kaeli Tulloch

BioResource and Agricultural Engineering

This senior project discusses the design, planning, and evaluation of a livestock handling facility for Tulloch Ranches. The facility will be an upgrade to the facility currently used at the ranch in Pine Valley, California. The design parameters for the facility were narrowed down to the following: 1. Must reduce stress to animals during handling. 2. Must be cost effective to save labor and maintenance. 3. Must show improvement from the current set- up. The above parameters combine to form a system that enables the handlers of Tulloch Ranches to manage and work cattle in a more calm and humane …

Newborn Infants Learn During Sleep, William P. Fifer, Dana L. Byrd, Michelle Kaku, Inge-Marie Eigsti, Joseph R. Isler, Jillian Grose-Fifer, Amanda R. Tarullo, Peter D. Balsam

Publications and Research

Newborn infants must rapidly adjust their physiology and behavior to the specific demands of the novel postnatal environment. This adaptation depends, at least in part, on the infant’s ability to learn from experiences. We report here that infants exhibit learning even while asleep. Bioelectrical activity from face and scalp electrodes was recorded from neonates during an eye movement conditioning procedure in which a tone was followed by a puff of air to the eye. Sleeping newborns rapidly learned the predictive relationship between the tone and the puff. Additionally, in the latter part of training, these infants exhibited a frontally maximum …

Mixed-Income Housing: Assumptions And Realities, Kimberly M. Hoving Jun 2010

Mixed-Income Housing: Assumptions And Realities, Kimberly M. Hoving

Master's Theses

Current Federal, State, and local San Francisco housing policy advocates mixed-income housing as a positive approach to creating living environments for low-income families. Strategies for creating mixed-income housing environments include large-scale public housing re-development efforts, inclusionary housing policies, and the use of discretionary funding for mixed-income development projects. Researchers agree that there is not yet enough evidence to support that mixed-income strategies are achieving positive results and have noted that the expected outcomes for mixed-income strategies are founded upon a number of assumptions. It is assumed that a mix of households at varying income levels will result in greater stability, …

Estimation And Inference With Weak, Semi-Strong, And Strong Identification, Donald W.K. Andrews, Xu Cheng Jun 2010

Estimation And Inference With Weak, Semi-Strong, And Strong Identification, Donald W.K. Andrews, Xu Cheng

Cowles Foundation Discussion Papers

This paper analyzes the properties of standard estimators, tests, and confidence sets (CS’s) for parameters that are unidentified or weakly identified in some parts of the parameter space. The paper also introduces methods to make the tests and CS’s robust to such identification problems. The results apply to a class of extremum estimators and corresponding tests and CS’s that are based on criterion functions that satisfy certain asymptotic stochastic quadratic expansions and that depend on the parameter that determines the strength of identification. This covers a class of models estimated using maximum likelihood (ML), least squares (LS), quantile, generalized method …

Global Economic Crisis: The Need For African Government Interventions For Rapid Economic Recovery And Stability, Hassan T. Sanni

Bullion

The paper reappraises the various measures taken by African governments to curtail the effects of the global economic meltdown. This is with a view to re-emphasizing the need for strong interventions by African governments. The paper is organized into five sections. Aside from the introduction, section two reviews the genesis of the global economic crisis, while section three briefly discusses the impact of the global economic meltdown with greater emphasis on African economies. The global responses as well as African forms of interventions since the global shock are presented in section four of the paper. The summary, recommendations and conclusion …

Banking System Credit As An Instrument Of Economic Growth In Nigeria, Andrew O. Agbada Jun 2010

Banking System Credit As An Instrument Of Economic Growth In Nigeria, Andrew O. Agbada

Bullion

Globally, banks in developing countries are expected to play very vital and effective roles in financing their economic projects and activities as their contribution in ensuring sustainable economic growth. This expectation is as a result of the fact that there is acute shortage of capital in the developing countries of the world. ln this paper, attempt was made to address how banking system credit can be used as an instrument of economic growth in Nigeria. The specific objectives that banking system credit were expected to achieve were also stated. lt's was revealed that though credits have increased tremendously in recent …

Inference Based On Conditional Moment Inequalities, Donald W.K. Andrews, Xiaoxia Shi Jun 2010

Inference Based On Conditional Moment Inequalities, Donald W.K. Andrews, Xiaoxia Shi

Cowles Foundation Discussion Papers

In this paper, we propose an instrumental variable approach to constructing confidence sets (CS’s) for the true parameter in models defined by conditional moment inequalities/equalities. We show that by properly choosing instrument functions, one can transform conditional moment inequalities/equalities into unconditional ones without losing identification power. Based on the unconditional moment inequalities/equalities, we construct CS’s by inverting Cramér–von Mises-type or Kolmogorov–Smirnov-type tests. Critical values are obtained using generalized moment selection (GMS) procedures. We show that the proposed CS’s have correct uniform asymptotic coverage probabilities. New methods are required to establish these results because an infinite-dimensional nuisance parameter affects the asymptotic …

Disproportionality And Learning Disabilities: Parsing Apart Race, Socioeconomic Status, And Language, Dara Shifrer, Chandra Muller, Rebecca Callahan Jun 2010

Disproportionality And Learning Disabilities: Parsing Apart Race, Socioeconomic Status, And Language, Dara Shifrer, Chandra Muller, Rebecca Callahan

Sociology Faculty Publications and Presentations

The disproportionate identification of learning disabilities among certain sociodemographic subgroups, typically groups that are already disadvantaged, is perceived as a persistent problem within the education system. The academic and social experiences of students who are misidentified with a learning disability may be severely restricted, whereas students with a learning disability who are never identified are less likely to receive the accommodations and modifications necessary to learn at their maximum potential. The authors use the Education Longitudinal Study of 2002 to describe national patterns in learning disability identification. Results indicate that sociodemographic characteristics are predictive of identification with a learning disability. …

Getting Past 'Rational Man/Emotional Woman': Comments On Research Programs In Happiness Economics And Interpersonal Relations, Julie A. Nelson Jun 2010

Getting Past 'Rational Man/Emotional Woman': Comments On Research Programs In Happiness Economics And Interpersonal Relations, Julie A. Nelson

Economics Faculty Publication Series

Orthodox neoclassical economics portrays reason as far more important than emotion, autonomy as more characteristic of economic life than social connection, and, more generally, things culturally and cognitively associated with masculinity as more central than things associated with femininity. Research from contemporary neuroscience suggests that such biases are related to certain automatic processes in the brain, and feminist scholarship suggests ways of getting beyond them. The “happiness” and “interpersonal relations” economics research programs have made substantial progress in overcoming a number of these biases, bringing into consideration by economists a wide range of phenomena which were previously neglected. Analysis from …
