Scandal At Indiana, K-State, And Duke, Richard C. Crepeau

On Sport and Society

In this month of madness, March is going out like a crazed lion. The Final Four has offered excitement at the level of delirium. While off the court the dark underside of intercollegiate athletics had found numerous modes of expression pointing to levels of madness of another kind.

The Evolution Of Sonata Form In The Wind Music Of W.A. Mozart, Brian Alber Mar 2006

The Evolution Of Sonata Form In The Wind Music Of W.A. Mozart, Brian Alber

Institutional Repository Information

Mozart’s wind music occupies a rather small space in the overall scope of his compositional output, numbering a total of ten works. Yet when viewed in the larger context of Mozart’s life, the wind music was written over the span of nine years, encompassing a large period from his youth up to his last decade in Vienna. Ranging from the simple divertimenti (K. 166 and 186) through the Tafelmusik (K. 213, 240, 252, 253 and 270) and finally culminating in the three Serenades (K. 361, 375 and 388), the wind music demonstrates Mozart’s maturation in wind writing, and also serves …

Walt Whitman: Twentieth-Century Mass Media Appearances, Andrew Jewell, Kenneth M. Price Mar 2006

Walt Whitman: Twentieth-Century Mass Media Appearances, Andrew Jewell, Kenneth M. Price

University of Nebraska-Lincoln Libraries: Faculty Publications

Mass media, the various means of communication designed to reach a large portion of the public, include but are not limited to film, radio, television, advertising, popular music, the internet, newspapers, and magazines. Whitman’s appearances in mass media have not been studied much, though they deserve attention because the evolving uses of his image and words can illuminate important aspects of his cultural afterlife. Until the 1960s, Whitman was invoked with surprising frequency as an icon of high literary stature. Advertisers in particular relied on his fame – not on his challenges to orthodox thinking and ordinary social arrangements – …

Beef Export Verification Program For Japan, Mark Halstead, Darrell R. Mark Mar 2006

Beef Export Verification Program For Japan, Mark Halstead, Darrell R. Mark

Cornhusker Economics

After regaining beef export trade with Japan in December 2005, export rule violations prompted Japan to reinstate its beef trade ban on January 20, 2006. While it is uncertain when trade will resume, it is incumbent upon the entire U.S. beef industry to understand the rules for beef export to Japan. These rules are established in USDA’s Beef Export Verification (BEV) Program for Japan. This BEV Program applies to companies, producers, feedlots, slaughterers and fabricators who supply beef and beef offal for export to Japan. Suppliers must comply with the specified product requirements under the USDA BEV Program for Japan …

Flexible Work Arrangements: A Definition And Examples, Workplace Flexibility 2010, Georgetown University Law Center Mar 2006

Flexible Work Arrangements: A Definition And Examples, Workplace Flexibility 2010, Georgetown University Law Center

Memos and Fact Sheets

Workplace Flexibility 2010 defines a “flexible work arrangement” (FWA) as any one of a spectrum of work structures that alters the time and/or place that work gets done on a regular basis. A flexible work arrangement includes:

1. flexibility in the scheduling of hours worked, such as alternative work schedules (e.g., flex time and compressed workweeks), and arrangements regarding shift and break schedules;

2. flexibility in the amount of hours worked, such as part time work and job shares; and

3. flexibility in the place of work, such as working at home or at a satellite location.

A Grammatical Description Of The Early Classic Maya Hieroglyphic Inscriptions, Daniel A. Law Mar 2006

A Grammatical Description Of The Early Classic Maya Hieroglyphic Inscriptions, Daniel A. Law

Theses and Dissertations

The purpose of this thesis is to describe the grammatical system of Classical Ch'olti', the language of the Classic Maya hieroglyphic inscriptions, as attested in inscriptions of the Early Classic (approximately AD 200-600). Around 300 Lowland Maya Hieroglyphic inscriptions have been dated to the Early Classic or before, nearly one third of these remain unpublished. Previous work on the monumental inscriptions of the Early Classic (Mathews 1985; Proskouriakoff 1950) has examined Early Classic monuments primarily as works of art. Mora-Marin (2001) examined the language of inscriptions found on early portable texts, a small subset of the corpus here examined. In …

Commodification And Contract Formation: Placing The Consideration Doctrine On Stronger Foundations, David S. Gamage Mar 2006

Commodification And Contract Formation: Placing The Consideration Doctrine On Stronger Foundations, David S. Gamage

ExpressO

Under the traditional consideration doctrine, a promise is only legally enforceable if it is made in exchange for something of value. This doctrine lies at the heart of contract law, yet it lacks a sound theoretical justification – a fact that has confounded generations of scholars and created a mess of case law.

This paper argues that the failure of traditional justifications for the doctrine comes from two mistaken assumptions. First, previous scholars have assumed that anyone can back a promise with nominal consideration if they wish to do so. We show how social norms against commodification limit the availability …

Quantifying Chlorophyll A Content Through Remote Sensing: A Pilot Study Of Utah Lake, Tiana Davis Mar 2006

Quantifying Chlorophyll A Content Through Remote Sensing: A Pilot Study Of Utah Lake, Tiana Davis

Theses and Dissertations

Utah Lake is a really large but shallow lake located in the arid environment of the Western United States. Due to a variety of factors it is listed by the Environmental Protection Agency as an "impaired water body" and must be closely monitored. Because of its large extent and shallow depth the water quality is heterogeneous and can change rapidly. This means that traditional water quality monitoring methods, which require large investments in field personnel, equipment, and water sample analysis, cannot produce a model that is truly representative of the entire water body. This thesis examines the feasibility of using …

What Kinds Of Stock Ownership Plans Should There Be? Of Esops, Other Sops And “Ownership Societies”, Robert C. Hockett Mar 2006

What Kinds Of Stock Ownership Plans Should There Be? Of Esops, Other Sops And “Ownership Societies”, Robert C. Hockett

Cornell Law Faculty Working Papers

Present-day advocates of an “ownership society” (OS) do not seem to have noticed the means by which, since the 1930s and 1960s respectively, we have worked to become an OS already where homes and “human capital” are concerned. Nor have those advocates considered whether these same means which amount to publicly augmented private financial engineering might be employed to spread shares in business firms as widely as we have spread homes and higher educations. This Article, the third in a trio of pieces devoted to fleshing out what a contemporary OS consistent with American values, endowment psychology and …

Reverse Bifurcation, Dru Stevenson Mar 2006

Reverse Bifurcation, Dru Stevenson

ExpressO

Reverse bifurcation is a trial procedure in which the jury determines damages first, before determining liability. The liability phase of the trial rarely occurs, because the parties usually settle once they know the value of the case. This procedure is already being used in thousands of cases – nearly all the asbestos and Fen-phen cases – but this is the first academic article devoted to the subject. This article explains the history of the procedure and analyzes why it encourages settlements, simplifies jury instructions, and produces better outcomes for the parties.

Evaluating Alternatives For Drinking Water At Deployed Locations, Brian S. Hughes Mar 2006

Evaluating Alternatives For Drinking Water At Deployed Locations, Brian S. Hughes

Theses and Dissertations

Because of potential improvements to water security and cost savings, military decision makers may want to consider new means of providing potable water to Airmen in deployed locations. Drilling for water and field bottling show great potential because of the increased security and lower per unit cost when compared to bottled water from approved sources. However, the selection of the best means to supply water is a hard decision which must balance multiple objectives (e.g., security, palatability, and convenience) against limited resources (e.g., cost, airlift, trucks, and personnel). A multi-objective decision analysis model quantifies a decision-maker's values regarding the many …
