Punitive Damages, Liquidated Damages, And Clauses Penale In Contract Actions: A Comparative Analysis Of The American Common Law And The French Code Civil, Charles R. Calleros

Although American common law allows punitive damages for reckless or intentional torts, it will neither allow a jury to assess punitive damages for breach of contract nor permit enforcement of a contractual damages clause that is deemed to be punitive. This approach is rooted in an early Chancery practice of granting equitable relief from oppressive penal bonds and has been more recently justified as a means of facilitating efficient breach. Economic efficiency, however, can be accomplished even if punitive damages could be assessed for intentional breach, because the parties would have an incentive to negotiate a release from the first …

Preliminary results for the 2006 University of Nebraska–Lincoln Nebraska Farm Real Estate Market Developments Survey show patterns of change and contrast. Overall, the average per-acre value of Nebraska farmland climbed 9.6 percent during the year ending February 1, 2006 (Figure 1 and Table 1). However, based on these preliminary findings, the annual changes across regions and types of land varied widely.

The Impact Of Economic Factors And Acquisition Reforms On The Cost Of Defense Weapon Systems, James P. Smirnoff

Cost overruns in weapon system purchases have plagued the Department of Defense (DoD) throughout its history and have resulted in schedule delays and potentially reduced combat capability. This thesis created an empirical model that begins to explain those cost overruns. The model describes how changes in defense budgets, consolidation of the defense industry, acquisition reform, war, and cost estimating error are related to cost overruns. The cost performance of 186 major weapon system programs managed by the Air Force, Army, and Navy from 1970 to 2002 was described using a panel regression model. The Acropolis At Kaminaljuyu: A Study Of Late Classic Occupation, Kelleigh Waimarie Cole

The Late Classic Period at Kaminaljuyú is one of the most poorly understood periods of occupation, possibly because the artifacts and architecture lack the ornate decoration found in earlier periods. One of the largest and best preserved areas of the site is located in the Parque Arqueológico de Kaminaljuyú in Zone 7 of Guatemala City. A major focal point of architecture atKaminaljuyú is the Acropolis, which has been the focus of various excavations, particularly the work of Gustavo Espinoza from 1958 to 1962. Despite this research, much of the important documentation and artifacts recovered from these excavations have been lost. …

Buried Online: State Laws That Limit E-Commerce In Caskets, Jerry Ellig, Asheesh Agarwal

Consumers seeking to purchase caskets online could benefit from the Supreme Court’s 2005 decision that states cannot discriminate against interstate direct wine shipment. Federal courts have reached conflicting conclusions when asked whether state laws requiring casket sellers to be licensed funeral directors violate the U.S. Constitution’s Due Process Clause. In Powers v. Harris, the 10th Circuit even offered an unprecedented ruling that economic protectionism is a legitimate state interest that can justify otherwise unconstitutional policies. In Granholm v. Heald, however, the Supreme Court declared that discriminatory barriers to interstate wine shipment must be justified by a legitimate state interest, and …

A Computer-Based Course To Teach Speech Acts: Prototype For The Technology Assisted Language Learning Program, Laura Morales Dorlando

The following report discusses the design and formative evaluation of a prototype for a computer-based course to teach speech acts as part of the Technology Assisted Language Learning (TALL) program. The report includes a literature review on speech acts and current methods and strategies for language teaching and instructional design. Next, there is a description of the lessons and the design process, as well as a summary of the formative evaluation. Following is the prototype of the lesson on apologies. The report concludes with a discussion of the project's limitations and suggestions for future research.

The purposes of this study were threefold: 1.) to duplicate previous studies by demonstrating differences in victim blame attribution, minimization of rape, and degree of excusing the perpetrator between homosexual and heterosexual victims; 2.) determine if similar patterns will be shown with male victims as with female victims in the demonstration of rape myths when the victim and perpetrator are acquainted or strangers; and 3.) test the mediation effect of homophobia on perceptions of male rape victims. 119 university students participated. Participants read a scenario in which a homosexual or heterosexual was raped by a male stranger or acquaintance. Participants …

Access to assisted suicide has been the center of a federal standoff between Congress and the state of Oregon since 1998, but few academic papers on American federalism acknowledge this development. Through the initiative and referendum process, Oregonians gave themselves the right to assisted suicide in 1998. Congress reacted immediately, attempting to overturn the Oregon law with national legislation. By historical and constitutional precedent states control issues related to events of daily life such as birth, death, marriage, and healthcare issues. Multinational operations are carried out to achieve military and diplomatic objectives in various regions. Such operations derive a great deal of benefits from sharing budgets, political legitimacy, sharing each national experience and technological resources, and so forth. However, a coalition, one structure of multinational operations, often involves serious challenges in such areas as command and control, logistic support, communication and language, training, and intelligence and information due to its ad hoc characteristics. This research reviews general problems in a coalition operation, and develops the Coalition Operation Planning Model to assist coalition commanders or staff in producing an efficient operational plan. …
