The "Benefits" Of Non-Delegation: Using The Non-Delegation Doctrine To Bring More Rigor To Benefit-Cost Analysis, Victor B. Flatt

This article examines the problems of benefit-cost (or cost-benefit) analysis in our regulatory system and posits that a more nuanced version of the “non-delegation” doctrine (made famous in Schechter Poultry) could improve many of the problems associated with the use of benefit-cost analysis. In particular this article notes that many of the problems with benefit-cost analysis are its use by agencies to make large policy decisions, which could be characterized as legislative. The Epistemic Consumption Object And Postsocial Consumption: Expanding Consumer‐Object Theory In Consumer Research, Detlev Zwick, Nikhilesh Dholakia

We introduce the concept of the epistemic consumption object. Such consumption objects are characterized by two interrelated features. First, epistemic consumption objects reveal themselves progressively through interaction, observation, use, examination, and evaluation. Such layered revelation is accompanied by an increasing rather than a decline of the object’s complexity. Second, such objects demonstrate a propensity to change their “face‐in‐action” vis‐à‐vis consumers through the continuous addition or subtraction of properties. The epistemic consumption object is materially elusive and this lack of ontological stability turns the object into a continuous knowledge project for consumers. Continuing his SOP drills he began to excavate the area of the source of the signal to the metal detector using the trowel issued to him for this purpose. He may not have been working to the SOP drill, as it seems likely that, because of the restricted area of work caused by the surrounding rocks, he was digging directly down to the mine, rather than digging across to the mine by excavating a small trench. An explosion occurred when the PMN antipersonnel mine, which was the source of the metal detector signal, detonated.

The potential costs to irrigators, the state economy and the state budget were estimated for different methods of reducing consumptive use (CU) of irrigation water in the Platte and Republican Basins. The policy methods considered included: leased retirement of irrigated land using a willing buyer-willing seller approach; required land retirement with lease payments equal to actual producer losses; retirement of irrigated land by purchasing water rights using a willing buyer-willing seller approach; forced retirement of irrigated land with the purchase price equal to actual market value; allocation with 100 percent producer compensation; and allocation with 50 percent producer compensation. The Effect Of Local Life Circumstances On Female Probationers' Offending, Marie L. Griffin, Gaylene Armstrong

Criminology and Criminal Justice Faculty Publications

This article examines the influence of change in local life circumstances on the short-term criminal behavior of female drug-abusing probationers. Using a binomial hierarchical generalized linear model, we examine the probability that certain “discrete life events” act to modify or change criminal behavior in the short term. The findings indicate that participants' involvement in conventional activities results in the decreased likelihood of engaging in nondrug crimes but an increased likelihood of drug dealing. Faced with this contradiction, we suggest that the dynamics of offending are altered by the nature of the criminal activity itself and the way in which gender …

Official Representations Of The Nation: Comparing The Postage Stamps Of Sudan And Burkina Faso, Michael Kevane

Economics

An analysis of the imagery on postage stamps suggests that regimes in Burkina Faso and Sudan have pursued very different strategies in representing the nation. Sudan's stamps focus on the political center and dominant elite (current regime, Khartoum politicians, and Arab and Islamic identity) while Burkina Faso's stamps focus on society (artists, multiple ethnic groups, and development). Sudan's stamps build an image of the nation as being about the northern-dominated regime in Khartoum (whether military or parliamentary); Burkina Faso's stamps project an image of the nation as multi-ethnic and development-oriented.

This article provides the most comprehensive analysis to date of the New Markets Tax Credits program established by Congress. The purpose of the NMTCs is to use tax credits as incentives for investors to provide equity funds into low income areas. The article reveals that over $2 billion of federal tax subsidies that have been allocated to gentrified projects for the wealthy, rather than the intended beneficiaries – low income residents in the urban core – as Congress intended. The article proposes amendments to the statute and regulations to close unintended loopholes.

The power of financial accounting to shape corporate behavior is underappreciated. Positive accounting theory teaches that even cosmetic changes in reported earnings can affect share value, not because market participants are unable to see through such changes to the underlying fundamentals, but because of implicit or explicit contracts that are based on reported earnings and transaction costs. However, agency theory suggests that accounting choices and corporate responses to accounting standard changes will not necessarily be those that maximize share value. In the last ten years, we have seen frequent news reports on the spread of the HIV/AIDS virus in the Indian subcontinent, each one stressing the dire economic and social consequences if urgent attention is not paid to the problem. Although the Indian government has responded by adopting many policies and by establishing an organization — the National Aids Control Organization (NACO) — to deal specifically with HIV awareness, treatment for HIV infected individuals, and prevention of further spread of HIV/AIDS, many critics do not find these measures adequate.

Many farm leases, especially those between family members, are not written but are verbal "handshake" agreements. Because nothing is in writing, the parties may have different recollections of their agreement, making lease disputes more difficult to resolve. In legal terms, verbal farm leases in Nebraska may be either "year-to-year" leases or "holdover" leases. Holdover leases result when a written lease terminates but the landlord and tenant continue the lease with an oral agreement, either directly or implied, without entering into a new written lease. The most common legal issue associated with verbal farm leases is how a lease may legally …

In 2005, insured losses from hurricanes and other catastrophes were greater than in any other year in U.S. history. NOAA’s National Hurricane Center estimates that $85 billion of total damages resulted from Hurricanes Katrina and Rita alone. One year later, the region affected by these two hurricanes still struggles to recover, both as a place to live and as a viable economy. Using data from the BLS Quarterly Census of Employment and Wages, the National Ocean Economics Program has developed a data series that allows the economic damage to coastal regions to be seen in a new light: what happens …

This study was undertaken to better understand inmate concerns of the prison environment across 8 dimensions. The 8 dimensions examined in this study were activity, emotional feedback, freedom, privacy, safety, social, structure, and support. To determine the importance of these dimensions among inmates, secondary data were used in an attempt to replicate and validate the findings from Wright's (1985) study which used a prison environment inventory instrument to assess inmate concerns. The secondary data consisted of an inmate sample of 1,054 taken from 30 prisons of minimum, medium, maximum and close security across the states of Tennessee, Kentucky, and Ohio. …

Data were collected from 60 parents of children 5-11 years of age to describe the parental and family factors and explore the associations of these factors with children's Body Mass Index (BMI) percentiles. Mother's made up 81.7% of the sample. Whites/Caucasians comprised 88.3% of the sample. Males comprised 51.6% of the child participants while females comprised 48.3%. Among the child participants, 38.3% had BMI equal to or greater than the 95th percentile, and 6.7% had BMI 85th to less than 95th percentile. The purpose of this study was to determine principals' perceptions of how effective mentoring programs and university-based principal preparation programs are in developing the skills necessary to carry out the 13 critical success factors identified by the Southern Regional Education Board (SREB). A review of the literature addressed what it means to be an effective principal and what an effective mentoring program should look like.

This study explores folk medical beliefs and practices regarding women's health issues and the female body, specifically menstruation, pregnancy, abortion and menopause, in the Southern Appalachian region. This research reveals what information was given to young girls, by whom was it given, and the effect this had on their self-image and on how they communicated about their bodies as they matured. Other key elements include the social restrictions surrounding menstruation and the ways these beliefs were communicated to young girls. The purpose of this study was to explore and document the factors that motivated African American public school administrators in a selected school system in East Tennessee to become school leaders. The study highlighted barriers and challenges, support mechanisms, and perceptions of training. If minority educators are to be actively recruited and retained, there must be an understanding of the factors that motivate them to progressively seek administrative leadership positions.

The African American public school administrators' experiences were collected through 17 one-on-one personal interviews. The interviews were audio-taped, transcribed, coded, and used to answer the 4 research questions.
