In the past several years, the term ‘adaptive management’ has been used a lot with reference to the Platte River Cooperative Agreement. This leads to many questions – what exactly is adaptive management? How does it relate to economic and policy choices? How does it affect management choices made on the Platte River?

Explaining The Value Of Transactional Lawyering, Steven L. Schwarcz

This article attempts, empirically, to explain the value that lawyers add when acting as counsel to parties in business transactions. Contrary to existing scholarship, which is based mostly on theory, this article shows that transactional lawyers add value primarily by reducing regulatory costs, thereby challenging the reigning models of transactional lawyers as “transaction cost engineers” and “reputational intermediaries.” This new model not only helps inform contract theory but also reveals a profoundly different vision than existing models for the future of legal education and the profession.

Individual And Familial Stressors Among Rural Nebraskan, Bilingual, Paraprofessional Educators, Rochelle L. Dalla, William E. Lopez, Vicky O. Jones, Yan Ruth Xia

Department of Child, Youth, and Family Studies: Faculty Publications

Individual (e.g., depression, learning styles) and familial (e.g., social support) factors affecting the psychosocial well-being of bilingual, rural Nebraska, paraprofessional educators were examined. Of 26 participants, 15 were first and 5 were second generation Hispanic immigrants. All were currently (n = 20) or formerly (n = 6) involved in an online, distance education, bachelor’s degree program in elementary education, with English as a second language certification. Results from data analyses are presented, as are suggestions for working with unique populations.

In this article, we explore the degree to which African American state legislators have been able to translate election to office into substantive representation. We are particularly interested in the impact of race and gender on the likelihood of legislative bill submission and passage. While previous studies have focused on inter-group representation, our analysis examines intra-group representation by disaggregating race, gender, and party identification. By doing so, we are able to capture the intra-group variation between various groups such as black Democratic men and black Democratic women and white Democratic women and white Republican women. Pregnancy during adolescence represents a challenge to society as a whole. Its incidence is increasing and brings about social and medical consequences to both the teen mothers and their children. The purpose of this study was to evaluate pregnant teenager involvement in sexual activity and the social context. The group studied comprised 152 pregnant teenagers attending the Department of Pediatrics, Santa Casa de Sao Paulo (SCSP) General Hospital. All information was analyzed. The age at first intercourse was 14.2 years and the average period between first intercourse and pregnancy was 1.4 years. Most pregnancies (75%) were neither planned nor wanted, …

Analisis kinerja fungsi sistem penelitian kesehatan nasional (SPKN) diperlukan untuk identifikasi penguatan dan peningkatan sistem yang mendukung pencapaian pemerataan kesehatan. Penelitian ini bertujuan mengukur skor kinerja fungsi utama SPKN yang meliputi pengelola, pendanaan, mengumpulkan dan memelihara sumber, produksi dan penggunaan riset berdasarkan pendapat stakeholders (peneliti, pembuat kebijakan, dan pengguna). Sumber data yang digunakan adalah pilot study WHO di Jakarta dan Makassar WHO dengan ukuran sampel 278 responden. Analisis dilakukan terhadap skor rata-rata 6 dimensi pendapat meliputi lingkungan; pandangan sistem, pembuatan, penggunaan, akses literur ilmiah dan media. Who Decides?: A Critical Look At Procedural Discretion, Robert G. Bone

Federal civil procedure today relies extensively on trial judge discretion to manage litigation, promote settlements, and otherwise tailor process to individual cases. Even those rules with decisional standards leave trial judges considerable interpretive freedom to make case-specific determinations. This Article criticizes these choices and recommends stricter rules. Many judges and procedure scholars applaud the discretionary approach, and the Advisory Committee seems content to draft vague rules that implement it. The assumption seems to be that trial judges have the expertise and experience to do a good job of tailoring procedures to the needs of particular cases. The assumption is wrong, …

Revitalizing Our Urban Core Without Marginalizing Our Core People: Closing Tax Credit Loopholes For The Wealthy While Generating Ethnic Entrepreneurial Self Help Alternatives To Subsidized Gentrification, Roger M. Groves

This article provides the most comprehensive analysis to date of the New Markets Tax Credits program established by Congress. The purpose of the NMTCs is to use tax credits as incentives for investors to provide equity funds into low income areas. The article reveals that over $2 billion of federal tax subsidies that have been allocated to gentrified projects for the wealthy, rather than the intended beneficiaries – low income residents in the urban core – as Congress intended. The article proposes amendments to the statute and regulations to close unintended loopholes.

The term “global warming” was coined in 1896 by the Swedish chemist Svante August Arrhenius. He observed that as the consumption of hydrocarbon fuels and industrial production had grown over the years, the atmospheric concentration of greenhouse gasses (GHG), mainly carbon dioxide (CO2, which accounts for 80 percent of these gasses), began to correlate with a global increase in temperature. There is now general agreement in the scientific community that it is the burning of these carbon containing fuels that is causing global warming. There are two means to combat this warming: first, to reduce CO2 emissions; second, to offset …

In the face of corporate bankruptcies, the Pension Benefit Guaranty Corporation (“PBGC”) assures workers that their defined benefit pensions will be protected. It is this fact which has motivated recent reform of the PBGC and the overarching defined benefit plan system by Congress. This paper explores those reforms by addressing the reasons for and results of the most recent reform which had as its primary aim restoring the fiscal solvency of the PBGC. The paper challenges popular accounts of the reform process while examining the results of such reform for important stakeholders without resorting to an overly technical discussion of …
