A New Classification Of Law For A Foreign, Comparative, And International Research Law Library, Jan Stepan
Vanderbilt Journal of Transnational Law
The Swiss Institute of Comparative Law seated at Lausanne was established by the federal statute of October 6, 1978. The Institute is envisioned as a center for the "documentation of and research into comparative, foreign, and international law." According to the statute and the implementing decree of December 19, 1979, the Institute serves the following purposes:
(1) to supply federal agencies and the federal administration with material and studies that may be needed for decisions concerning legislation and international treaties; (2) to contribute towards international efforts at the harmonization and unification of law; (3) to provide information and expert opinions …

University of Richmond Law Review
The United States Supreme Court's recent decision in Community Communications Co. v. City of Boulder has been aptly described as "a lightning bolt with potentially thunderous repercussions." City of Boulder basically established that local government activity is not immune from federal antitrust laws unless it is undertaken pursuant to a clearly articulated and affirmatively expressed state policy to replace competition with regulation or monopoly public service.

In my days as an undergraduate studying history at Mount Allison, a professor from one of the large American universities visited the campus and told us of "Operation Ben Franklin". A group of eminent historians were engaged in a project whose aim was to electronically re-create the great statesman using the scientific method. Using primary sources such as diaries, letters and documents, and secondary sources such as printed books and journals, in short all available data, the group with the aid of computers was collecting and dissecting Franklin's writings. The goal was to produce each step his mind took in …

The Roles Of Lawbooks, Alfred F. Conard
Michigan Law Review
The Michigan Law Review's annual review of books provides us with an informative sample of the recently published books that are available to inform the lawyer's mind. No doubt the sample is biased by the idiosyncracies of the editors' tastes and of the reviewers' receptivity. But these biases are more likely to enhance than to diminish the significance of the selection.

Law Quadrangle (formerly Law Quad Notes)
In response to the tax limitation movement which received national attention with the passage of California's Proposition 13 and which gave rise to a slate of tax limitation referends on the Michigan ballot in 1978, we began a theoretical and empirical study of the relationship between the size of state and local governing units and issues in public finance.

Clarifying Legal Drafting By Well-Structuring It: An Improved Version Of The Plain Language Game, Layman E. Allen
Other Publications
In order to be plain, language should be well-structured. This is the theory upon which the PLAIN LANGUAGE Game is based. It provides those who aspire to be legal drafters with practice in constructing well-structured statements - a useful skill for expressing clear legal norms. You have already encountered the underlining of part of the term 'well-structured', 'PLAIN LANGUAGE' and 'norm', and may be wondering about it The underlining of the first two letters of each word of a term indicates that the term is a defined term and that it is being used in its defined sense. Thus, a …

This article is intended to be a practical guide to current bibliographies and other research sources dealing with French law. It is addressed to both the legal scholar and the law librarian. Some of the sources are acquisition or selection tools; others are guides to the literature.
This guide includes primarily English and French language publications, but a few works in German are noted as well. Recent sources in particular are included so that the bibliography may serve to update some of the excellent French legal research guides already available.
General sources are given first, and then specific sources. Part …

Evidentiary Foundations, Fundamentals Of Trial Techniques, Thomas F. Guernsey
University of Richmond Law Review
Any lawyering skill should be taught so as to provide the student or lawyer with the opportunity to plan, implement, and reflect on the execution of the skill. In these two books, Professors Imwinkelried and Mauet have accomplished just that. In writing books that are aimed primarily at the law school market, the authors have provided a valuable resource for the student as well as for the beginning trial lawyer.

Copyright Ownership Of Joint Works And Terminations Of Transfers, Harold See

Under the terms of section 24 of the Copyright Act of 1909, the death of Oscar Hammerstein in 1960 resulted in the "partnership" of Richard Rogers and (Mrs.) Oscar Hammerstein (and James and William Hammerstein, and Alice Hammerstein Mathias, his children-the latter two by a previous marriage), in the ownership of such works as Oklahoma, Carousel, and South Pacific. Oscar Hammerstein may have wanted it that way, but want it or not, he was powerless under the Copyright Act to change the arrangement. Numerous works are the product of the combined efforts of more than one author. Such joint authorship …
The Judiciary And Dispute Resolution In Japan: A Survey, Harold See
The Judiciary And Dispute Resolution In Japan: A Survey, Harold See
Law Faculty Scholarship
An overly brief and misleadingly simple history of the evolution of Japanese legal institutions would begin with the proposition that a century and a quarter ago Japan was a feudal society. By "opening" to the West, Japan was forced to "modernize" (Westernize) its laws. As a code system is easier than a common law system to impose wholesale on a society, the continental European civil law countries served as a model for Japan, which patterned its codes primarily on the civil code of Germany and the criminal code of France. After defeat in the Second World War and subsequent occupation …

Federal Regulation Of Consumer-Creditor Relations, Susan B. English
University of Richmond Law Review
As anyone who has taught or practiced in the area of consumer law knows, there have been no texts written until now which attempt to bring together in a concise manner the many statutes and regulations which govern this rapidly developing area of law. Kenneth R. Redden, Professor of Law at the University of Virginia, and James McClellan, Chief Counsel and Staff Director of the Subcommittee on the Separation of Powers of the United States Senate Judiciary Committee, have taken the first step to fill this gap by providing us with a text in the area of consumer-creditor relations.
In Praise Of Book Reviews, Francis A. Allen
In Praise Of Book Reviews, Francis A. Allen
Michigan Law Review
This is the third time in as many years that the Michigan Law Review has presented a substantial canvass of legal and law-relevant literature to its readers. Any institutional practice repeated three times is in a fair way of becoming a tradition, and the tradition of an annual "book-review issue" in this journal seems vigorously alive and well. Accordingly, the present collection of review essays requires no benediction from me. That these remarks are a work of supererogation is even more strongly suggested when one recalls the elegant essay of David Cavers, which helped launch the first collection two years …
Truth And Interpretation In Legal History, G. Edward White
Truth And Interpretation In Legal History, G. Edward White
Michigan Law Review
The essay consists of four sections. Section I discusses the nature of historical explanation, devoting some attention to the roles of "truth," interpretation, and detachment in historical scholarship. Section II continues that discussion by exploring the meaning and the purpose of what I call "interpretive detachment" in the writing of history. Section III considers the theoretical assumptions of Marxist legal historians from the point of view developed in preceding sections. Section IV, taking into account some issues that remain problematic or troublesome, restates my approach.
