Footnote Citations?, K.K. Duvivier
Sturm College of Law: Faculty Scholarship
Let's face it-legal citations can interrupt the flow of sentences and make them harder to read. In comparison, the widely used Modem Language Association documentation style recommends short parenthetical citations in text that direct readers to a list of authorities at the end: for example, "(Gilli- gan 105)."Another format commonly used in history, art history, and other disciplines is that of the Chicago Manual of Style. The Chicago note style uses raised numerals in the text to refer readers to authorities in endnotes or footnotes. Although such a footnote style is predominant in law reviews, few have advocated it in …
Foreword: On Academic Fads And Fashions, Cass R. Sunstein
Foreword: On Academic Fads And Fashions, Cass R. Sunstein
Michigan Law Review
Why did critical legal studies disappear? Will it reappear? Why does the Federalist Society prosper? Why, and when, do people write books on constitutional law, rather than tort law or antitrust? Why did people laugh at the notion of "animal rights," and why do they now laugh less? Why do law professors seem increasingly respectful of "textualism" and "originalism," ideas that produced ridicule and contempt just two decades ago? How do book reviewers choose what books to review? Why has law and economics had such staying power? Academics are generally committed to truth, and they are drawn to ideas that …
Democratic Justice In Transition, Marion Smiley
Democratic Justice In Transition, Marion Smiley
Michigan Law Review
Ruti Teitel's Transitional Justice and Ian Shapiro's Democratic Justice come out of very different academic traditions. But they both develop a view of justice that might loosely be called pragmatic by virtue of its treatment of justice as a value that is simultaneously grounded in practice and powerful in bringing about social and political change. Moreover, they both use this shared pragmatic view of justice to provide us with two things that are of great importance to the study of transitional justice and democracy in general. The first is an explanatory framework for understanding how legal institutions and claims about …
Where Is My Body? Stanley Fish's Long Goodbye To Law, Richard Delgado
Where Is My Body? Stanley Fish's Long Goodbye To Law, Richard Delgado
Michigan Law Review
Stanley Fish, author of Doing What Comes Naturally, Is There a Text in This Class?, There's No Such Thing as Free Speech, and It's a Good Thing, Too, and other paradigm-shifting books, and who recently left law teaching for a position in university administration, has written one last volume giving his colleagues in the profession he left behind something to think about. In his previous work, Fish, who taught English and law at Duke University, addressed central legal issues such as meaning, communication, and textual interpretation, challenging such received wisdoms as that every text has a single, determinate meaning, or …
Common Disorders Of The Appendix And Their Treatment, Roger J. Miner
Common Disorders Of The Appendix And Their Treatment, Roger J. Miner
The Journal of Appellate Practice and Process
In the legal profession, an appendix is an integral part to an appellate brief. An appendix is as important as oral argument or the written brief. This essay examines the function of and rules for preparing an appendix. The discussion then identifies common deficiencies of appendices along with the consequences of the disorders.

The Alwd Citation Manual: A Clear Improvement Over The Bluebook, M.H. Sam Jacobson
The Journal of Appellate Practice and Process
The Association of Legal Writing Directors released a new legal citation manual in 2000. The ALWD Citation Manual is designed to meet the needs of legal practitioners rather than the needs of law journals. M.H. Sam Jacobson discusses how well the manual promotes atrribution of ideas and statements and communicates how sources support the text for which they are cited.

Writing Help At Your Fingertips-Readability Scale, K.K. Duvivier
Writing Help At Your Fingertips-Readability Scale, K.K. Duvivier
Sturm College of Law: Faculty Scholarship
Writing well takes constant diligence. We all can use some help. But many of us may not be taking advantage of the tools that are available right at our fingertips. Most of us, especially those who are spelling-challenged, run our documents through spell check. Now, many word processing programs list readability statistics in addition to spelling and grammar advice. For example, in Microsoft Word, go to the 'Tools" category and click on "Spelling and Grammar." At the end of the spell check, Microsoft provides a chart labeled "Readability Statistics." Understanding these readability scales can help improve your writing.

Parallel Citations-Past And Present, K.K. Duvivier
Parallel Citations-Past And Present, K.K. Duvivier
Sturm College of Law: Faculty Scholarship
By quiet decree, the fifteenth edition of the Bluebook changed all of this. The convention of using parallel citations was dropped in every instance except for "state court cases in documents submitted to courts of the state that originally decided them." Parallel citations were no longer required in legal memoranda or law reviews. Furthermore, the fifteenth edition required writers to use only the West version when a single source was listed. This new rule seemed to undermine the value of official citations that traditionally came before the unofficial West versions and suggested a preference for the official source issued by …

UIC John Marshall Journal of Information Technology & Privacy Law
In this bench memo, the Supreme Court of the state of Marshall is asked to decide whether the actions of defendant, Marshall Manatees, evidence a theory of false light invasion of privacy as defined by the Restatement (Second) of Torts and whether defendant's actions of comparing the digital photographic images collected at the Marshall Center to their database and ultimately posting plaintiff's photo on its billboard constituted an actionable claim for misappropriation. Plaintiff, Allen Sanders, attended a professional basketball game where the Marshall Manatees were hosting an opposing team at the Marshall Center. He purchased the ticket online and received …

Vanderbilt Journal of Entertainment & Technology Law
In this issue, the Vanderbilt Journal of Entertainment Law & Practice (JELP) explores two such themes. In the Film/TV section, we present views on the degree to which First Amendment protection extends to expression that arguably entails a negative influence on some audiences. In the Music section, we are pleased to offer two variations on a common theme, in the form of two accounts of the copyright law's reaction to advances in technology. Accompanying these recurrent themes are those of our own, as sections dealing with the Internet and Sports round out this, our fifth issue.

Credit Cards In The United States And Japan, Ronald J. Mann
Credit Cards In The United States And Japan, Ronald J. Mann
Law Quadrangle (formerly Law Quad Notes)
The following essay is excerpted from a paper prepared during fall 2000 during the author's stay in Tokyo as a visiting scholar at the Institutefor Monetary and Economic Studies at the Bank of Japan.
One of the most important aspects of consumer payment systems in the United States is the widespread use of credit cards. American consumers use credit cards to pay for about one-fifth of their purchases each year. That pattern of use is not universal.

A Suggestion On Suggestion, Richard D. Friedman, Stephen J. Ceci
Law Quadrangle (formerly Law Quad Notes)
The following essay is adapted from "The Suggestibility of Children: Scientific Research and Legal Implication" (86.1 Cornell Law Review 33-108 [November 2000]) and appears here with permission of the publisher.
The vulnerabilities of young children have far-reaching implications for the juvenile and criminal justice systems. Arguably, these vulnerabilities may affect how an investigator should interview the child; whether her hearsay statements should be admitted; whether expert evidence concerning her vulnerability should be admitted; and whether a criminal conviction based principally on her testimony should be allowed.

Secondary Legal Sources: A Selected Subject Bibliography Of Treatises, Looseleaf Services And Form Books Seventh Edition, Thomas G. Oatmen
Law Library Publications
This bibliography, now in its seventh edition, is a subject arrangement of selected English language treatises, looseleaf services and form books in the University of Michigan Law Library, current through 2001.
The goal of the bibliography is to list books that provide a starting point for legal research in major areas of American law. It includes only works published since 1990 or those kept current via looseleaf or other supplementation. Books that are kept up-to-date by some sort of supplementation are indicated by a hyphen following the publication date, e.g., "1949-". The bibliography excludes casebooks, journals, popular works and encyclopedias. …
