Variations On A Theme By Sander: Does A Mediator Have A Philosophical Map?, Sharon Press, Joseph B. Stulberg Jan 2016

Variations On A Theme By Sander: Does A Mediator Have A Philosophical Map?, Sharon Press, Joseph B. Stulberg

Faculty Scholarship

Can a mediator play a constructive role in helping citizens confront and resolve the most divisive issues of our times? We believe the answer is affirmative, but we worry that such a view, though richly grounded in our historical tradition, is now neither widely endorsed nor effectively implemented.

We belong to a group of dispute resolution professionals who learned both from mentors and experience that ADR—and mediation, in particular-offers a philosophical map for conducting problem—solving activities among fellow citizens that systematically supports and advances our most noble aspirations for a fair society. Be it the urban riots of the 1960s …

The Legal Consequences Of Noncompliance With Federal Tax Laws, Allen Madison Jan 2016

The Legal Consequences Of Noncompliance With Federal Tax Laws, Allen Madison

Faculty Publications

This Article addresses the legal consequences a taxpayer should consider when deciding whether to comply with the basic requirements of the federal income tax laws. A taxpayer considering noncompliance should consider the government's authority to assert criminal liability, impose civil tax penalties, and forcibly collect any unpaid tax. Although there are numerous criminal tax offenses, the potential offenses that may affect a taxpayer's decision whether to comply are the failure to file and failure to pay misdemeanors, tax perjury felony, failure to pay addition to tax, and civil fraud penalty. The remaining penalties (over 100 of them) target various types …

Sexbots; An Obloquy, Thomas Simmons Jan 2016

Sexbots; An Obloquy, Thomas Simmons

Faculty Publications

Sexbots may displace humans in the sex trade (or on a wider scale) sometime between the 2020s and the 2050s. Although some perquisites may derive from the proliferation of sexbots (lower levels of sexually transmitted diseases, for example), significant social harms can also be predicted. In anticipation of those harms, lawmakers may endorse targeted regulation or outright bans. The uncertain limits of Lawrence v. Texas and its progeny of sex-toy decisions will present vague constitutional shoals to these aims. The legislating-of-sexbots crusade will also make for strange bedfellows, politically speaking, as social conservatives aiming to maintain traditional values ally with …

Pregnancy Discrimination Under Tide Ix: Compliance Concerns At Law Schools, Liani Balasuriya

Cardozo Journal of Equal Rights & Social Justice

The article examines the protection of pregnant law students under Title IX and highlights significant gaps in compliance and enforcement within law schools. Despite Title IX's prohibition of pregnancy discrimination, the lack of data and inconsistent policies at law schools raise concerns about the adequacy of protections for pregnant students. The analysis advocates for improved data collection, clearer policies, and stronger accountability measures to ensure equitable treatment of pregnant law students.

The Republican Senate And Regular Order, Carl W. Tobias Jan 2016

The Republican Senate And Regular Order, Carl W. Tobias

Law Faculty Publications

Now that the 114th Congress has reached the first session’s conclusion, the purported application of regular order to a major Senate constitutional duty—rendering advice and consent on presidential nominees—merits analysis. This evaluation illuminates serious deficiencies, which plagued 2015 confirmations. Especially important was the GOP’s failure to expeditiously suggest aspirants for White House consideration, and specifically failing to fill “judicial emergencies,” provide hearings and ballots swiftly, conduct floor debates when required rapidly, and confirm more than 11 judges all year. This obstruction has numerous deleterious consequences; the most significant, however, is not fulfilling the constitutional responsibility to proffer advice and consent …
