Hydrola V. Income Tax Assessor, Elyakim Rubinstein, Esther Hayut, Yoseph Elon Jun 2008

Hydrola V. Income Tax Assessor, Elyakim Rubinstein, Esther Hayut, Yoseph Elon

Translated Opinions

Appeals challenging a decision by the District Court, which partly granted the appeal by the Appellant, who conducted business in states formerly within the Soviet Union, for income tax return for the years 1992-1996. The appeals primarily centered round the Respondent’s reasoning for prohibiting writing off expenses for commissions paid to the Appellant’s agents in the Soviet Union based on two alternative justifications: failure to properly prove the expenses and the unlawfulness of the expenses, which were payments of bribes. The Appellant argues that the sums it paid its agents abroad were made for purposes of its income and that …

The Us Subprime Mbs Crisis: New Legislative Agenda And Potential Ramifications For Foreign Jurisdictions, Yuliya Guseva Jun 2008

The Us Subprime Mbs Crisis: New Legislative Agenda And Potential Ramifications For Foreign Jurisdictions, Yuliya Guseva

Cornell Law School Inter-University Graduate Student Conference Papers

The recent US liquidity crisis, triggered by the failure of mortgage-related securities, produced long-lasting ramifications inside and outside of the US. International financial indicators and the housing markets demonstrate that the mortgage-related liquidity problems keep reverberating throughout the US and the global economy. In the US, even such giants as Freddie Mac and Fannie Mae, which were expected to inject market liquidity, have declared considerable losses from subprime MBS. The ongoing crisis provided a fertile ground for a number of publications and research. However, a range of fundamental issues regarding legislative responses to the US MBS crisis and its international …

A Coordinated Withholding Tax On Deductibility Payments, Reuven S. Avi-Yonah Jun 2008

A Coordinated Withholding Tax On Deductibility Payments, Reuven S. Avi-Yonah

Articles

Prof. Avi-Yonah proposes a 35 percent withholding tax on deductible payments made to a non-U.S. resident, in coordination with other OECD members. The tax is aimed at U.S. residents posing as foreign investors and would be refundable when the beneficial owner shows that the payments have been reported to tax authorities in the owner’s country of residence.

Access To Justice: Report On Selected Reform Initiatives In Canada, Canadian Judicial Council

Canadian Forum on Civil Justice

When the Sub-committee on Access to Justice (Trial Courts) first met we confirmed that we are concerned with access to justice, and in particular with mounting costs in the justice system. While Subcommittee members are aware of important initiatives designed to respond to the issue of costs at the trial level, it was felt that it would be helpful to know more about what is happening across the country so that we can identify promising practices to reduce costs. To that end we agreed that the starting point for the work of the Subcommittee is to develop a focused inventory …

Bionormativity And The Construction Of Parenthood, Katharine K. Baker Jun 2008

Bionormativity And The Construction Of Parenthood, Katharine K. Baker

All Faculty Scholarship

This piece explores the relationship between legal and biological parenthood. It examines how neither history, nor evolutionary biology nor moral philosophy dictate a legal regime in which parenthood must be based on biological connection, but that attraction to a biological (or “bionormative”) regime remains strong. In explaining why, it suggests that much of what attracts people to bionormativity is not biology itself, but the way in which a biological regime constructs parenthood as a private, exclusive and binary enterprise. It is these ancillary qualities of bionormativity that people may care the most about. Today, a variety of forces put pressure …
