The U.S. On Tilt: Why The Unlawful Internet Gambling Enforcement Act Is A Bad Bet, Gerd Alexander
The U.S. On Tilt: Why The Unlawful Internet Gambling Enforcement Act Is A Bad Bet, Gerd Alexander
Duke Law & Technology Review
The United States federal government’s attempts to curb Internet gambling are beginning to resemble a game of whack-a-mole. The Unlawful Internet Gambling Enforcement Act of 2006 (the "UIGEA" or "Act") represents its most recent attack on Internet gambling. This iBrief first looks at U.S. attempts to limit Internet gambling and how those efforts have affected gambling law and business. It then discusses how the UIGEA works and highlights some of its major limitations. This iBrief argues that the UIGEA will not only fail to rein in online gambling, but that the U.S. federal government is treading an improvident course towards …

There is a demand-market for technology that facilitates tax fraud. By all accounts the providers in this market are working in a growth industry.
In the short term this is bad news for those concerned with tax policy and information privacy. In the long term however, the fight against technology-assisted fraud is stimulating the development of a more robust technology base within tax administrations, and this is good news for those who believe that a sophisticated technological infrastructure is needed to resolve difficult questions of tax design.
This paper focuses on two technology-accelerants of SME tax fraud - zappers and …

This short article is a follow-up to a piece I wrote two years ago on Hamdan v. Rumsfeld, SSRN No. 913822. While applauding the result in Hamdan, I critiqued the Supreme Court for missing a “teachable moment” and obscuring the great issues at stake in prolixity and mind-numbing technical detail.
In this article, I applaud the Boumediene v. Bush Court not only for its result—that the Constitution’s Suspension Clause can require habeas corpus for aliens held abroad under certain circumstances—but for its reasoning and style as well. This time, the majority of five did not miss its “teachable …

Institutional Repository Supporting Materials
Librarians from the University of Georgia Law Library and University of Maryland Law Library will discuss their experiences implementing Digital Commons' institutional repository product. Issues to be considered includes... - Creating a business plan to persuade law school administrators to establish an institutional repository -- how to justify the expenditure, distinguishing Digital Commons from SSRN, choosing Digital Commons rather than an open source solution - Obtaining content for the repository -- promoting the repository, building buy-in from contributors, establishing content policies, determining types of materials to be included in the repository, self-archiving versus mediated archiving - Copyright permissions -- appending …

This article discusses the sweeping modifications to real estate law practice as legislators, courts, and lawyers attempt to accommodate a number of real world challenges. The authors’ discussion analyzes several of these transitioning influences, such as an increase in environmental concerns, shifts in environmental legislation, the subprime mortgage crisis, the effect Kelo v. New London has on the lawyers’ role in facilitating redevelopment, as well as the influence of new E-sign laws has on drafting real estate documents.
