Employment Discrimination—The Equal Employment Opportunity Commission And The Deferral Quagmire, Stephen D. Shawe

The deferral requirements of the equal employment provisions of the 1964 Civil Rights Act were intended to insure state participation in the enforcement of the Act and to lighten the caseload of the E.E.O.C. Their implementation, however, has raised numerous problems that have diminished the effectiveness of the Act. The author traces the history and purpose of these deferral requirements, discusses the problems they have created and suggests some possible solutions.

Recent Legislation: Maryland's Mechanics' Lien Law, Gerald L. Everett

The Maryland General Assembly recently enacted a new mechanics' lien statute in response to a Maryland Court of Appeals decision which held that portions of the former mechanics' lien were incompatible with the due process clauses of the Maryland Declaration of Rights and the fourteenth amendment to the Constitution. The author discusses the defects in the old law noted by the court and the attempt to remedy those defects in the new law.

Evidence seized from automobiles under the guise of an automobile inventory search has often been admitted against criminal defendants. This article analyzes the doctrinal basis behind the inventory search, the justifications for its use and concludes that the inventory search is a subterfuge for an unlawful entry into a constitutionally protected area.

Notes And Comments: Pretrial Detention In Maryland: The Aftermath Of Gerstein V. Pugh, Shelly E. Mintz

In Gerstein v. Pugh the United States Supreme Court held that although a suspect arrested without a warrant is entitled to a judicial determination of probable cause to detain, the procedure for such a determination is not a "critical stage" of the prosecution. The author examines the implementation of the Gerstein decision in Maryland and concludes that the present procedures are inadequate to safeguard Fourth Amendment rights of an accused.

Liability Of The Guarantor Of Secured Indebtedness After Default And Repossession Under The Uniform Commercial Code: A Walk On The Wild Side By The Secured Party, Rick Sachs, Gloria M. Belgrad

A lender who obtains security for and a guarantee of its loan may mistakenly presume that recovery in the event of the borrower's default is assured. As the authors point out, however, numerous pitfalls may await the unwary lender who attempts to secure repayment from the guarantor. This article identifies the problems involved, discusses their treatment by the courts, and makes recommendations for reducing the risks of costly mistakes.

The Uniform Residential Landlord And Tenant Act And Its Potential Effects Upon Maryland Landlord-Tenant Law, Steven G. Davison

The author examines the Uniform Residential Landlord and Tenant Act, which is currently being considered for adoption by the Maryland General Assembly. The Act codifies the recent judicial tendency to treat the landlord-tenant relationship as one governed by contract principles rather than by the principles governing the conveyance of estates in land. The article's major emphasis is on the potential impact of the Act on the common law and the present Maryland statutes governing the landlord-tenant relationship.

Statutory Incorporation Flexibility In Maryland: Drafting Corporate Documents For The Privately-Held Enterprise, Ronald M. Shapiro

The provisions of the Maryland Code governing the incorporation process enable the attorney incorporating a privately- held enterprise to draft corporate documents accommodating the needs of the particular promoting individuals. This article focuses on the drafting of articles of incorporation and bylaws, and places particular emphasis on the options for allocating control and financial interests available within the Maryland statutory framework.

In the wake of the Supreme Court's 1972 decision in Barker v. Wingo, Maryland appellate courts have enforced more rigorously the right of criminal defendants to a speedy trial. This article surveys the application and treatment of the Barker criteria by the Maryland courts in recent decisions.

Notes And Comments: Fcc Implementation Of The Section 315(A) Exemptions: The Disappearance Of The Equal Time Doctrine, Gary R. Greenblatt

As required by the equal time doctrine, broadcast licensees that permit their facilities to be used by legally qualified candidates for public office must provide all other legally qualified candidates for that office equivalent broadcast time. In 1959, Congress amended Section 315(a) of the Communications Act of 1931,. and created four statutory exemptions to the doctrine. The author analyzes the FCC implementation of these exemptions to determine the parameters and application of each to specific circumstances.

Two recent decisions by the Maryland Court of Appeals have brought about substantial changes in the law of libel and slander. The author considers the consequences of these decisions, welcoming the abolition of certain distinctions between written and spoken defamation as well as the adoption of new rules pertaining to recoverable damages. The author, however, expresses reservations as to pronouncements in the decisions that purport to impose new burdens on the plaintiff to establish liability.

Notes And Comments: Maryland Laws On Child Abuse And Neglect: History, Analysis And Reform, Barry L. Steelman

Children in our society are too often the victims of abusive and neglectful parents and guardians. Although Maryland was among the first jurisdictions to enact protective legislation for abused and neglected children, the Maryland legislature must continue to respond to the plight of these victims. The author traces the development of the Maryland child abuse and neglect laws, analyzes the effectiveness of these laws today, and discusses those changes necessary to afford Maryland children the fullest protection possible.
