Notes And Comments: Presumptions In Civil Cases: Procedural Effects Under Maryland Law In State And Federal Forums, J. Clinton Kelly

The author surveys the effects of presumptions in civil cases and examines the Maryland decisions on the subject. Observing the divergence between the "bursting bubble" theory of presumptions embodied in Rule 301 of the new Federal Rules of Evidence and the tendency in Maryland to accord presumptions a greater procedural significance, the author scrutinizes the federal-state choice of law question under Federal Rule 302.

Notes And Comments: State V. Evans — A Frontal Attack On The Common Law Of Murder, Kathleen M. Howard

In Mullaney v. Wilbur, the Supreme Court held the common law presumption of murder operating in homicide cases to be unconstitutional as a denial of due process. This article focuses on the seminal Maryland case under Mullaney and surveys the effects of this and other Maryland decisions involving the presumption of murder.

Notes And Comments: Remedying Segregated Public Housing In Metropolitan Baltimore, John B. Weld

As a result of the actions and inactions of local government in the Baltimore metropolitan area, low-income public housing occupied by black families has been effectively confined to low-income black neighborhoods in Baltimore City, fostering a pattern of racial and economic segregation in the metropolitan area. The author examines the establishment of this cycle and considers the judicial and local and federal legislative means available to break it.
