Western countries' information technology and software intensive firms are increasingly producing software and IT services in developing countries. With this swift advancement in offshoring, there are many issues that can be investigated which will enable companies to maximize their benefits from offshoring. However, significant challenges can occur throughout the lifecycle of offshoring IT service projects that turn the potential benefits into losses. This research investigated CMM/CMMI best practices and their effects on managing and mitigating critical issues associated with offshore development.

There is a dearth of decision-support models or frameworks to aid managers in the Information and Communications Technology (ICT) industry in uniformly assessing the key factors in the decision to standardize innovative technologies. Making the proper decision is consequential and potentially fraught with risks for the firm such as competitive exposure, high expenditures with inadequate returns, restrictive inbound or outbound patent licensing obligations, and related complications.

The objective of the technology assessment (TA) process is to understand problematic and undesirable consequences from the development and application of technology. TA advocates for the engagement of technology experts and stakeholders to understand the effects of technology. However, TA is often criticized that the decision-making process is not transparent - leaving stakeholders wondering if their contributions were heard. Furthermore, the methods have limited capability for conducting tradeoff analysis between the organizational objectives and conflicting stakeholder perspectives that can result in unintended consequences. This paper explains a type of knowledge-supported design thinking related to systems in organizations. It shows how work system theory (WST) provides the basis for the work system method (WSM), various versions of which have been used by many hundreds of MBA and Executive MBA students. Design thinking occurs throughout WSM and is especially prominent at the point where WST/WSM users apply their analysis and develop recommendations for improving an existing work system or creating a new work system. In today's global political and media climate, the stakes are high for corporations, local or otherwise, to create and maintain an `ethical' perception of not only their daily business activities and how they can benefit society or protect the environment, but also their enduring characteristics or `corporate identity' (Conrad, 2011) for numerous, sometimes conflicting stakeholder audiences (Cheney, 1983). Fiduciary Discretion, D. Gordon Smith, Jordan C. Lee

Faculty Scholarship

Discretion is an important feature of all contractual relationships. In this Article, we rely on incomplete contract theory to motivate our study of discretion, with particular attention to fiduciary relationships. We make two contributions to the substantial literature on fiduciary law. First, we describe the role of fiduciary law as “boundary enforcement,” and we urge courts to honor the appropriate exercise of discretion by fiduciaries, even when the beneficiary or the judge might perceive a preferable action after the fact. Second, we answer the question, how should a court define the boundaries of fiduciary discretion? We observe that courts often …

Essays On Corporate Finance, Hari Prasad Adhikari

We compare acquisition activity, method of payment choice, and the long-run value implications of acquisitions by newly public single-class and dual-class US companies. Our results show that dual-class IPO firms make relatively more acquisitions in innovative industries and are less likely to pay with stock as compared to single-class IPO firms. We provide evidence that the reluctance of dual-class firms to pay with stock is not related to the insiders' cash-flow rights but it is significantly positively related to the insiders' voting rights and wedge between the insiders' voting rights and cash-flow rights.
