Part I of this Article provides an overview of § 102 of the Patent Act, the role of prior art in the patentability analysis, and the origin of the limitation on relevant non-patent, nonpublished art to that existing "in this country." Part II then analyzes the constitutional deficiency of the limitation in light of the express and implied purposes of the Intellectual Property Clause as informed by judicial decisions, technological changes, global contraction, and expanded notions of inventive research sources. The inspiration to research and present this paper came from a folklore tale about how Saint Martin created the pig from a piece of fat. The paper will explore the pig in Irish cuisine and culture from ancient times to the present. The paper will discuss the pig in Irish literature and mythology; outline the role the emergence of the potato had on domestic pig keeping, and trace the rise of commercial processing in the nineteenth century to the present day. StockGuard has been initiated to develop a series of biosecurity plans for the animal industries in Western Australia. Through StockGuard, representatives from the animal industries have been working with the Department of Agriculture Western Australian to identify potential threats to each of the animal industries and to develop action plans detailing how these threats can be managed. The overall purpose of StockGuard is to highlight threats to the animal industries before they occur and to develop effective ways to minimise the potential impact of these threats.

The Government recognises that the mackerel fishery is important to both the recreational and commercial fishing sectors. However, the purpose of these arrangements is not to allocate the mackerel resource between the sectors but within the commercial sector. Resources sharing issues are subject to investigation in the Integrated Fisheries Management Review where alternative management frameworks and principles for allocating fish stocks to ensure maximum benefit to the community are examined.

The Integrated Fisheries Management Review Committee was established to develop a strategy to integrate the management and sustainable use of fish resources. The Committee’s report proposes an alternative management framework and a set of guiding principles for allocating fish stocks to ensure optimal benefits are realised for the WA community. The report does not, and was not intended to, address specific allocation issues in particular fisheries – this will be a function of the framework and processes put in place following this review.

The Western Australian cauliflower industry is largely centered around the south-west of the State which, with its cool winter climate and medium to heavy loam soils is well suited to year round cauliflower production and accounts for 77% of State’s output. The Shire of Manjimup alone accounts for about 60% of the State’s cauliflower production. The second most significant region is the Swan Coastal Plain which has lighter soils, and a warmer climate. The Swan Coastal Plain is also suitable for year round production.
