The data gotten is then used for investigating women’s human rights issues in Shariʾa penal tradition regarding zinā (adultery) in Nigeria. The re-emergence of Sharia penal codes adopted by 12 Northern states in Nigeria in 1999 as an operative Islamic law has sparked concerns about rulings amounting to stoning to death in several cases of zinā. This essay identifies an early modern aesthetic that mobilizes the mundane to make a point about the world or the grandiose. Through a close reading of the poetry in the travelogues of the 17th-century Ottoman Damascene scholar ʿAbd al-Ghanī al-Nābulusī (d. 1143/1731), this essay identifies, theorizes, and historicizes early modern Arabic circumstantial verse—what the 19th-century French poet Stéphane Mallarmé calls vers de circonstance. By drawing on Mikhail Bakhtin’s concept of the “chronotope,” this essay shows how the poetry in Nābulusī’s travelogues fits within, and sometimes advances, their linear narrative. جاءت هذه الدراسة البحثية لبيان غاية القتال، ودور التعارض والترجيح في بيان أحكام الأسرى، في القرآن الكريم، والسنة النبوية الشريفة، وذلك من خلال التأصيل لغاية القتال في الإسلام، وإزالة التعارض الظاهري بين النصوص المتعلقة بالأسرى.

وخلصت الدراسة إلى أن اختلاف العلماء في حكم الأسرى كان تبعًا لاختلافهم في إزالة التعارض بين النصوص الشرعية. وأن تطبيق قواعد التعارض فيه ذب عن السنة النبوية الشريفة، وإعمال لها. وأن تطبيق هذه القواعد وفق مقاصد الشريعة الإسلامية هو الضمانة لعدم استخدام ذوي الفكر المتطرف للنصوص على غير الوجه المقصود منها.
