يهدف هذا البحث إلى تقديم دراسة فقهية تأصيلية مقارنة بالقانون المدني الأردني لموضوع عقد الإعالة؛ وذلك من خلال بيان مفهومه، والكشف عن التكييف الفقهي لهذه الممارسة التعاقدية، والوقوف على الحكم الشرعي لها، ومن ثم إدراج القيود التي ينبغي أن ترد على مجرياتها وتضبط مسيرتها عبر مراحلها المختلفة.

وقد توصلت الدراسة إلى أن بيع الإعالة هو بيع مستحدث تطلبته معطيات الحياة المعاصرة ومستجداتها، ويمكن إلحاقه بالعقود غير المنجزة وتحديداً عقد الهبة بشرط العوض، وينبغي الالتزام بالعديد من القيود والضوابط حتى يكتسب هذا العقد صفة الصلوح من منظور الفقه الإسلامي وتحترم النتائج والآثار المترتبة عليه.

Within the fractured systems and institutions that plague the US, two groups in particular have fallen through the cracks: Black and South Asian Muslims. According to a 2015 report published by human rights organization Muslim Anti Racism Collaborative, over 3.4 million Muslims currently live in the United States. Black Muslims and South Asian Muslims constitute about 20% and 60% of that population, respectively; however, both groups are disregarded and misrepresented in US discourse and media. My analysis offers thick descriptions of these mobile apps, which first appeared in the online “meditation marketplace” in 2020 and 2021, and identifies resonant themes and questions that I believe are fruitful for the study of religion in digital landscapes and for mapping the shifting contours of lived Islam.
