Daubert V. Merrell Dow Pharmaceuticals, Inc.: Epistemiology And Legal Process, Margaret G. Farrell

Cardozo Law Review

Justice Blackmun's majority opinion in Daubert v. Merrell Dow Pharmaceuticals, Inc. acknowledges that law and science have different goals, but it fails to recognize the implications of those differences for legal process. Recent increases in the scientifically-based claims brought in the federal courts, and in the size and complexity of the litigation in which such claims are made, have raised the stakes in the debate. At the same time, scientific concepts of relativity, uncertainty, and multiple causation are at odds with simple, legal notions about fact-finding and cause and effect. Much of my background lies in social ministry, but after ordination the provincial decreed that I was to work in philosophy also. It seemed an odd mix at the time: philosophers tend to be squeamish about the rough-and-tumble of social action, while some social activists give the impression that garlic should be worn to ward off the anemia-inducing influence of philosophers. The combination has given a certain Janus-like quality to my life; but it has worked, and I have felt no need to look back.

Moral exemplars are often depicted as those who go to extraordinary lengths in preventing suffering and eradicating injustice. Thus, figure like Gandhi, Mother Theresa, and Martin Luther King are apt to be identified as moral saints in the sense of being the morally best people. However, any adequate conception of moral excellence must be broader and more complex.
