Law's Legitimacy: Lon Fuller In A Consequentialist Frame, Daniel L. Feldman

This thesis argues that Lon Fuller’s approach to jurisprudence offers more important support to the rule of law than has been generally recognized. It argues further that a consequentialist lens allows clearer views of Fuller’s strengths in this regard, despite Fuller’s own resistance to consequentialism and despite consequentialism’s blindness to some of Fuller’s depth and texture. This thesis supplies a formula, although one intended only as a guide to thinking, not for actual computation, to drive judicial decision-making. The inputs into this formula are six values widely shared in the United States, modified by case-by-case salience. Kantian deontology strongly influences …

Coleridge’s prose works, published and unpublished, demonstrate a thorough and critical testing and understanding of British and German philosophical responses to skepticism and the ability of philosophy to progress by maintaining a double-minded and conflicted suture of both the practical or imaginative eclipse of knowledge and theorizing the hypothetical epistemological absolute that explains the relativity of facticity. Any inadequate method of inquiry stagnates within attempting a purely figurative or purely demonstrative solution to skepticism. In popular consciousness and culture, equality is often considered to be the preeminent socialist value. Equality, on this view, sits at the heart of the socialist ideal, and those who ascribe great value to equality will, other things being equal, find themselves more predisposed towards socialism than those who do not. However, in recent years egalitarian accounts of the socialist ideal have increasingly come under criticism from defenders of an alternative, freedom-based approach to understanding the values that underpin socialist commitment. Individual relativism, also known as ethical subjectivism, is an attractive theory about morality. It argues that morality is a matter relative to the individual in a way akin to personal taste. For example, subjectivists regard the ethical judgment ‘Stealing is wrong’ as comparable with the judgment of taste ‘I dislike Brussels sprouts’. Yet, subjectivism is not nihilism. While nihilism denies the existence of moral value, duties, principles and truths, subjectivism claims that they exist, but they are subjective like taste. A long-standing political-theological critique contends that liberalism lacks the capacity to address theological challenges, and qualitative political challenges more generally. This charge is prevalent in our current age of crises, when the capacity to address such challenges is essential to any political tradition’s self-legitimation. I argue that the liberal tradition, broadly conceived, has long contended with theological challenges, particularly during modern revolutionary periods. Theological discourses, especially eschatological ones, circulate widely in these moments. This thesis consists of three papers on substructural approaches to semantic paradoxes. The first paper introduces a formal system, based on a nontransitive substructural logic, which has exactly the valid and antivalid inferences of classical logic at every level of (meta)inference, but which I argue is still not classical logic. In the second essay, I introduce infinite-premise versions of several semantic paradoxes, and show that noncontractive substructural approaches do not solve these paradoxes. Philosophers in the past have argued that the way the word “interpret” is used within creative fields unhelpfully conflates the notions of deriving and creating content. Arguing against this, I propose that the blurring of these two notions accurately describes how addressees interpret speakers, performers interpret scores, and audiences interpret art and music. Even speakers can be described as creative interpreters in this sense, as articulating a thought into an utterance requires an interpretive effort. The question facing sociology is whether it is a field or a discipline. If it is a field, then there is no need for theorizing. However, if sociology is a discipline, then problem-solving cannot be disentangled from theorizing without a loss of intelligibility – the inability to explain the social as the concept of the discipline. Through the quasi-realism of problem-solving as a course of activity, this chapter presents cognitive sociology as a paradigm appropriate to the concept of the social understood as an ongoing course of activity. Few would dispute that stories are powerful: they have the capacity to inform, to persuade, and to engage our imaginations and sympathies. However, the contemporary philosophical literature on stories focuses exclusively on the functions of narrative stories, and in particular on the role that novels can serve in cultivating our moral and political competencies. I argue that this narrow focus is theoretically pernicious in two ways. First, it leads to an unfortunate myopia regarding the value of non-narrative storytelling practices. It is generally assumed that the expressions of a natural language are largely arbitrary. That is, any expressions that display a nonarbitrary connection between what their utterances sound like and what they mean are small in number and of no real theoretical importance.

This thesis challenges such a position. I argue that nonarbitrariness is a pervasive feature of natural language and that understanding the sound/meaning connections that exist in language is necessary if to appreciate how languages work.

The music of Italian composer Sylvano Bussotti (1931–2021) presents intentional challenges to interpretation and canonization. These particular challenges and Bussotti’s reasoning for implementing them are interrogated in this dissertation by reading the score to Bussotti’s La Passion selon Sade (1966) through contemporaneous European social theory, philosophy, and political developments. La Passion selon Sade is a theatre piece for a chamber ensemble, with a primary vocal and dramatic role written for mezzo-soprano Catherine Berberian, with whom Bussotti frequently collaborated. This dissertation examines core metaphysical properties of nonbinary and genderqueer categories in dominant U.S. contexts. I address a prevailing argument that these categories, by definition, resist the gender binary and are therefore radical modes of existing. In response, I put forth a view of ‘nonbinary’ and ‘genderqueer’ that I call the Diachronic Approach, which describes these categories as yet another set of tools within an imperialistic gender system, much like ‘man’ or ‘woman.’ In other words, they are what I refer to as imperialistic social categories. In this dissertation I set out a theory of humor ethics and, in particular, I establish what difference humorousness makes to an instance of speech’s moral value. I set out by making the case for this approach to the topic, demonstrating that focusing on how humorous speech differs, morally, from non-humorous speech allows us to avoid getting caught up in prior ethical debates that are not strictly about humor itself – a shortcoming that is common to many treatments of humor ethics in the existing literature. Following the 2016 American Presidential election, celebrity endorsements proved to be a more narrow gauge of public opinion than ever.
